Currently, West Glenwood Sanitation District owns the parcel that the existing plant resides on. The resulting expansion will expand the plant to the east, thus requiring WGSD to acquire two separate parcels. These parcels are: 1) Gilstrap Enterprises Subdivision, Lot 12; 2) a parcel originally owned by Colorado Department of Transportation (CDOT), which is currently deeded to the City of Glenwood Springs for use as a public right of way for access to the Gilstrap Subdivision (before it can be purchased by WGSD, it must first be deeded back to CDOT, appraised, and then sold to WGSD); and 3) a strip of land three (3) feet wide created by a survey discrepancy between the existing plant property and the two adjoining parcels. The current status of these land transfers is as follows: • WGSD has an agreement with Gilstrap Enterprises Subdivision to purchase Lot 12. Currently they are in the closing process. Closing date is expected in October. • The City of Glenwood Springs has not yet deeded the parcel back to CDOT. The city will not start this process until a pre -annexation agreement has been approved. A copy of this agreement is attached. The pre -annexation agreement has been negotiated with City staff, but could not go to City Council until title to the three (3) foot strip of land had been obtained. • Deeds for the three (3) foot strip of land between the existing plant site and the adjacent city property were received on September 21, and are now being recorded. It is evident that the land transfer and the site application are mutually contingent upon each being approved. For this reason we are submitting the site application at this time for the purpose to allow the City to begin its process of deeding the parcel to CDOT. In order for this site application to be considered complete, we will need the following additional information: 1. Proposed effluent limitations as developed in coordination with the Planning and Standards Section of the Division. 2. Analysis of existing facilities including performance of those facilities. 3. Analysis of treatment alternatives considered, including the proposed expansion in relation to existing 201 or 208 water quality comprehensive plans. 4. Flood plain and natural hazard analysis, specifically a detailed map showing the exact location of the 100 year flood plain in relation to the existing and proposed plant. 5.. Control of Site, specifically evidence or proof of ownership or long term lease for the life of the project on propertie(s). 8. Institutional arrangements such as contract and/or covenant terms for all users which will be finalized to accomplish acceptable wastewater treatment. 9. Throughput control or management capabilities for controlling the wastewater throughput and treatment within the capacity limitations of the proposed treatment works, i.e., user contracts, operating agreements, pretreatment requirements. 10. Financial system which has been developed to provide for necessary capital and continued operation, maintenance, and replacement through the life of the project. Setbacks to occupied dwellings from components of the plant expansion. A copy of the signed site application is enclosed for your reference. The Colorado Department of Public Health and Environment ("CDPHE") is the reviewing agency of the Site Application. The site application was submitted to CDPHE, and CDPHE wrote a letter determining that the application was incomplete, and additional items would need to be submitted to continue the site application process. The main item that increased the time of this process was acquisition of a parcel of land adjacent to the WGSD parcel, owned by the Colorado Department of Transportation ("CDOT"). In November 2000, the WGSD has purchased the above mentioned CDOT parcel. In conversation with CDPHE, it was determined that typically most site applications do not have such a large time lag from the time of governmental authorities signatures to the submission time. As a result, CDPHE has asked that the governmental authorities review the site application to see if they are agreeable to their previous recommendation in 1998. Based upon CDPHE's recommendation, this site application is being sent to you for your re -review. I would Tike for you to review this and notify me within thirty (30) calendar days of your decision. If you need additional time, additional materials or maps, or my presence at a meeting, please do not hesitate to contact me at 945-1004. You recommend that the Board of County Commissioners recommend to the Colorado Department of Health to deny the District's Site Application so that the District's expansion is consistent with the City of Glenwood Springs' plans to develop a regional facility. For the reasons stated in this letter, we believe the Board of County Commissioners should recommend approval of the Site Application with the condition that the expansion conform with a future consolidation with the City and construction of a regional plant. Please see the enclosed letter dated April 12, 2001 regarding wastewater treatment service consolidation. As you can see, the District is presently coordinating with the City regarding the 201 Facilities Plan, which the District initially commissioned, and the City is now taking the lead in completing the Plan. Consolidation and construction of a regional plant is a high priority for the District, as evidenced by the fact that the District initiated the March 21st meeting with the City. The District will work closely with the City in completing the Plan and ensure its plant expansion plans integrate the possibility of consolidation. The completion of the 201 Facilities Plan will be a lengthy process and its conclusions regarding the economics and feasibility of consolidation are still unknown. In other words, it will be several years before consolidation occurs and a regional plant is constructed. According to the enclosed April 2, 2001 report prepared by Wright Water Engineering, the City's plant will not need to expand for 8 years. In comparison, the District's wastewater treatment plant's average capacity is currently at 77 %, and peak flows reach 93 % of capacity. If the District's expansion is denied, it will not be capable of serving new customers, and there will not be a regional plant to accept these customers. The Garfield County Comprehensive Plan, as mentioned in your staff report, discourages the proliferation of private sewer systems and special districts. Denial of the District's Site Application will be contrary to the County Comprehensive Plan because if the District is not capable of serving new customers, private systems will proliferate. Finally, Garfield County approved the District's Site Application in 1998. The Colorado Department of Health's request that the County reexamine the Application was a courtesy as a result of the delay in processing the Application. There is no legal requirement that the County approve the Site Application again. As mentioned before, the District shares your concerns regarding the expenditure of public monies on a plant expansion that may be consolidated with a regional plant in the near future. The District's need for a plant expansion is immediate and it will ensure that its design incorporates a future consolidation. Rather than a recommendation of denial of the District's Site Application based upon your concerns, we believe it will be more appropriate to recommend approval, as you did in 1998, with the condition that the District continue coordinating and planning with the City for consolidated wastewater treatment services and the construction a regional Plant. As I mentioned to you, two members of the District's Board of Directors and the District's plant manager met with two City Council members and the City Manager on March 21, 2001 to discuss the consolidation of wastewater treatment facilities. Both parties agreed that consolidation is important and should be investigated further. In 1995, the District commissioned a 201 Facilities Plan from JB Flood Engineers; however, this report was never completed. The City, at the March 21" meeting, committed to finishing the 201 Plan at its expense to fully analyze the potential for a regional wastewater treatment plant. The City will be contacting JB Flood Engineers for this purpose. The parties did not establish a time -frame in which the Plan would be -completed. For your information, I have included a letter dated April 2, 2001 from Wright Water Engineers regarding the status and future capacity of the City's wastewater treatment facility. Our review consisted of reviewing data from the Colorado Department of Health, interviews with City staff and consultation with Louis Meyer, P.E. (Schmueser Gordon Meyer) and Jim Flood, P.E. (J.B. Flood Engineers). In predicting future plant excess capacity, it is important to estimate the rate that future taps will be added to the system. For this 'analysis, we have relied on your estimate of probable sewer hookups over the next five years; which we understand to be 780 taps, not including any SpringRidge II taps. The City's sewer plan was originally designed for a capacity to treat 2.30 MGD (million gallons per day). Its current capacity, as estimated by the City staff, is 1.80 MGD. According to Robin Millyard, the current usage is 1.25 MOD. Under normal circumstances the plant can take on an additional 0.19 MGD (543 single-family units) before the City is required to begin planning for expansion or a new facility. It can take on 0.46 MGD more before the City must begin construction of a new facility. Figures 1 and 2 show the past and projected hydraulic (MGD) and orgainic (BOD) loading for the treatment plant. Figure 3 shows the historic and estimated future hydraulic loading of the plant. This projected loading includes the addition of 4 new taps from SpringRidge II each year. This graph indicates that the City should begin design on an expansion or a new facility in 2004 and be under construction by 2009. If no taps from SpringRidge II were added, it would theoretically allow the City to delay the start of planning by 45 days. SpringRidge's 83 taps would equate to about 1.6% of the 1.8 MGD capacity. Not all of these homes are new homes so assume that 60% or 93 (60% of 154) homes' are new homes and new taps. Therefore, the above represents a five (5) year inventory or impact on the plant spread over five years. Based on a meeting a few weeks ago involving a few representatives fromthe plant Glenwood Board, the Glenwood Springs City Council and City staff, it is my under West the City agreed to support the District's plant expansion plans and site application withding that understanding that the expanded facilities would be compatible with a regional treat the that the City is planning to be located across the river from the West Glenwood plant, on facility Cardinell Homestead property. As we discussed, the District intends to reduce the capacity of its plant expansion from .75 mgd that was initially submitted in its pending Site Application to approximately .60 mgd. The District's engineer will provide you the new requested plant capacity and detail the specific components of the plant that will be constructed and retrofitted as part of the expansion. You agreed to process the District's Site Application within 45 days of receiving this information and that new sign -offs will not be required by Glenwood Springs or Garfield County. CDPHE will condition its approval of this Site Application on the District not seeking another expansion to its wastewater treatment plant. The District will cooperate with the drafting of the City of Glenwood Springs 201 Plan and it will continue to participate in negotiations regarding a regional consolidated facility. Although we all agreed consolidation is in the best interest of all parties, the timing and economics of constructing a regional facility require the District to proceed immediately with this plant expansion to resolve the issues it has with its current plant. As Mr. Schroeder stated, the District's Site Application is finally proceeding towards approval with the Colorado Department of Public Health and Environment. CDPHE agreed to process the District's Site Application on the condition that the District would not seek another expansion of its plant at this site. Enclosed is a letter from this office dated November 11, 2003 that summarizes our meeting with CDPHE. Mr. Schroeder's letter indicated that the approval of the Site Application was also conditioned on the District consolidating with a future regional treatment plant to be constructed by the City and located on the Cardinell Ranch Site. I want to clarify that consolidation is not a stated condition; however, it is implied that if the District needs a future expansion, it will look at consolidation at that future date because it will not expand at its current site. The District may never need a future expansion, and if it does, estimating a date of a potential consolidation is pure speculation at this point. Thank you for your letter dated February 2, 2004 granting the District Site Application approval for its wastewater treatment plant expansion. The District has been seeking this approval for several years and it is very pleased to finally be able to update and expand its treatment facilities. We are, however, compelled to clarify one point mentioned in your letter. In paragraph 3, you state: "[w]hen the City of Glenwood Springs constructs a new wastewater treatment facility, it will be a regional plant. West Glenwood Springs Sanitation District has agreed to participate in this regional consolidated facility and has agreed that no further expansions of the present facilities will occur." Emphasis added. This issue and condition was discussed at length with Dwain Watson and Tom Schaffer during a meeting on November 6, 2003. The District did indeed agree that it will seek no further expansions of its present facilities, but it made no firm commitment to participate with the City of Glenwood Springs when it decides to construct a regional facility. It is implied that if the District needs a future expansion, it will look at consolidation at that future date because it cannot expand again at its current site. However, the District may never need a future expansion, and if it does, it may or may not coincide with the City.'s schedule. The District will continue to cooperate with the City's planning efforts to construct a regional wastewater treatment plant, but the District's participation in such a plant is not a foregone conclusion at this point. I have enclosed a letter from us to Mr. Watson and Mr. Schaffer dated November 11, 2003 summarizing the agreement.
