Enclosed please find my application for a Special Use Permit
and the $500.00 application fee. With this application I
hope we can finally resolve this situation to the satisfaction
of both the Garfield County Planning and Zoning and also the
County Commissioners.
Regarding the various requirements to be complied with and
submitted with this application I would outline the following:
1. Plans and specifications should be unneccessary as the
two mobile homes in question are already installed on
the property. The southerly most mobile home, however,
will be moved to at least 10 feet from the property
line.
2. Regarding the utility hookups, all these are currently
in place and serving the two existing trailers in question.
Both electric and gas have been inspected and approved
by the various regulating authorities. Sewage taps for
the two mobile homes were approved by the City of Glenwood
Springs and paid for back in September of 1981. Water,
of course, is provided by our existing well which serves
the rest of the trailers and is in compliance with all
the provisions of the State Board of Health. Road access
is provided from 127 Road and utilizes the current road
system within the trailer park.
3. See the enclosed improvement survey completed on 8/16/82
by El Dorado Engineering. It shows the two previously
existing trailers plus the two new trailers in question.
You will also note that it shows the wooden fence erected
by the Hideout which is approximately half on their
property and half on my property.

4. I certainly feel that the addition of two mobile homes
to my existing trailer park consisting of 16 mobile
homes will have no effect on the neighborhood or adjoining
property owners. On the north, the trailer park is
bounded by Three Mile Road (127 Road) and on the south
I own all the property up to approximately the top of
the ridge. At the west end of the property, there are
some single family homes, however, they are over a
1,000 feet from the two trailers in question and are
not even visible. On the east property line Three Mile
Trailer Park is adjacent to the Hideout. As you know,
the Hideout's operation consists of over 50 mobile home
sites of which several are permanent and the balance
are used as an overnight campsite for travelers to the
area. I certainly feel that the mobile home operation
on my property is more than consistent with the mobile
home operation on the Hideout's property.

Re: Two (2) Additional Mobile Home Spaces

Dear Bud:
Confirming last weeks phone conversation, please be advised
that every effort is bein- made to resolve this issue. As
discussed, I called Ms. Terry Bowman in the Planning Department
immediately after the Board of County Commissioners meeting
back in March. Ms. Bowman informed me that the only solution
to the problem was to bring the entire Trailer Pack into
conformance with the new regulations. That certainly was not
the message that I received when this issue was discussed by
the Commissioners. I then contacted Mr. Davis Farrar in the
Planning Department in order to proceed with resolving the
issue. We discussed the fact that the entire situation was
certainly not intentional and that we both agreed that perhaps
some type of compromise was possible. Additionally, it became
very apparent that no one in the Planning Department had ever
been through the Three Mile Trailer Park and had no first
hand knowledge of where the new trailers were located. My
suggestion was that Mr. Farrar visit the trailer park as soon
as possible and give some thought as to how we may commence
with resolving the problem. I had not heard from Mr. Farrar
or anybody else in the County since that conversation until
last week when I contacted Mr. Farrar upon hearing that my
tenant, Mr. Merion, had been given notice to vacate his trailers
by November 1, 1982. During this conversation, Mr. Farrar
agreed that he was remiss in not returning my call back in
March. I was at this time informed that Mr. Farrar was leaving
the County in order to accept a position with the City of
Carbondale. I then inquired about the possibility of obtaining
some type of variance from the Board of Adjustments and was
referred to you. In our^.onversation, you indicated that the
Board of Adjustments can only approve requests concerning a
hardship caused by zoning. It was your interpretation that
although we most certainly have a serious problem here, this
problem is not a hardship due to zoning.

Again in our discussion, you indicated that your interpretation
of regulation 5.02.02 is that only the addition shall conform
to all provisions of resolution 5.02. This is good news but
it is certainly contrary to all information obtained to date
from Ms. Bowman in the Planning Department. In reviewing the
regulations, the only problem I foresee is relative to fire
protection and the installation of a fire hydrant. As mentioned,
the existing trailer park is serviced by a well with only
enough storage capacity to provide domestic water. In terms
of lot size, set backs, and the like, there is no reason why
the two (2) new trailers cannot conform to the regulations.
As you suggested, I will have an improvement survey of the
two (2) new trailers completed at which time we can schedule
a meeting to review conformance with the regulations.
In the interim, I would appreciate being notified of any
progress or other events relating to this situation.

SUBJECT: Three Mile Trailer Park
The purpose of this memo is to confirm the direction that the
Board of County Commissioners gave us in regards to the above
zoning violation. It was the instruction of the Board that
Mr. Merian and his son-in-law be informed by letter of the
Board's position that they have until November 1, 1982, in
which to vacate the Three Mile Trailer Park. If at that time
they have not vacated the property, it will be necessary for
the Board to file an action in the Garfield County District
Court in order to enforce the Garfield County Zoning Resolution.

department notify you by mail that you have until November 1,
1982 to vacate the Three Mile Trailer Park.
If at that time you have not vacated the property, it will be
necessary for the Board to take legal action against you.
