E. The Board is authorized to approve, deny or approve with conditions a Land Use Change Psrmit ptrrsuant to the Unified [,and Use Resolution of 2008, as amended F. The Board of County Commissioners opened a public hearing on the 3d day of January, 2011 for consideration of whether tle proposed Land Use Change Permit should be granted or denied during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. G. The Board of County Commissioners closed the public hearing on the 3'd day of January, 2011 to make a final decision. H. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That. proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard atthat meeting. 3. That for the above stated and other reasions the proposed Land Use Change Permit to allow for Material Handling is in the best intsr€st of the healtb, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County if recommended conditions of approval are adopted- 4- ThaL with the adoption of recommended conditions, the application has adequately rnet the requirements of the Garfield County Unified Land Use Resolution of2008, as arnended- RESOLUTION NOW THEREFORE, BE IT RESOLVED by the Board of Cormty Commissioners of Garfield County, Colorado, that: A The forgoing Recitals are incorporated by this reference as part ofthe resolution. B- The r,and use change Permit for a Material rlandting thrcugh a Limited Impact Review is hereby approved subject to compliance with the following conditions: 1. That all representations made by the Applicant in the application and at the public hearing before the Board of Courty Commissioners, shail be conditions of approval unless qpecfficatly altered bythe Board of County Commissioners- 2 ?q"#Hi*H[:H',,T,H::3i: mt ] rr t 2- Prior to issuance of the Land Use Change Pennit the Appticant shall obtain alt required federal, state and local per.mits. Prior io issuance of the I-and Use Change permit theAppticant shall provide information regarding the potential levels of emissions that vril result from this use to Building and Planning and any air emission permits that may be required from CDPTIE shall be provided once issued- 3. Prior to issuance of the Land Use Change Permit the Applicant shall provide a list of equipment tlat will exist on the site in operation qf this *", * well as perrrits that may be required for that equipment. This includes, but is not limited to, air permits- 4- Operation of the facility must be in accordance with all Federal, State and Localregulations and permits goveming the operation of this facility. 5. Induskial activities shall be required to comply with the following standards: (1) The volume of the sound generated. shall be so operated that the volume of soundinherenfly and recurrently generated does not exceed tle Statutory requirements;(2) Vibration generated: every use shall be so operated th"t fl; grormd vibration inherently and recurrently generated is not perceptible withort instuments at any point ofany borindary line of the property; (3) Emissions o{ smoke and particulate matter: every use shall be so operated so as tocomply with all Federal, State and Cormty air quality laws, reguLations and standards;(4) Every use shall be so operated fhat it does noi emit heai, glare, radiation or fumeswhich substBntiatly interfere with the existing ixe of the adjo"inin[ property or whichcogstitutes a public nuisance or hazard.
