A. The Board of County Commissioners ol Garlield County, Colorado, received an
application for a Land Use Change Permit for a Limited Impact Review fbr a Compressor
Station and relatecl support infrastructure, also known as thc Noble Energy Itulison Contpressor
Stati<ln. on property owned by Joan I.. Savage. 'l'he Application was submittcd in conjunction
with Noble Energy lnc.
B. The compressor station is located on 5.74 acres of an approxirnately 663 acre
parcel owned by Joan L. Savage. It is accessed by private roads off of County Itoad 329. 'fhe
site is approximately 3.5 miles southeast of Rulison, Colorado.
C. 'l'he Compressor Station sitc is looated within the parcel of land described in the
Deed of Personal Representative for Joan L. Savage, Personal Represcntative of the Estate of

Recorder. T'he compressorsite is located within theEl/2, Section 8, Township 7 South, Range
94 West of the 6* p.-., Garfield County, Colorado and further described in the Site PIan
attached as Exhibit "A" and the Site l-egal Description attached as Exhibit "B".
D. The subject properry is contained within the Rual Zone District and a Land Use
Change Pemrit for a Compressor Station requires approval through a Limited Impact Review
Process by Garfield County.
E. lhe Board of County Commissioners is authorized to approve, deny or approve
with conditions a Land Use Change Permit for a Cornpressor Station, pursuant to Sections 1-301
and 4-105 of the Garfield County Unified l-and Use Resolution of 2008, as amended.
F. 'I'he Board of County Commissioners opened the public hearing on the 3'd day of
October, 201I upon the question of whether the Land Use Change Permit application, LIPA
6893, should be granted or denied, during which hearing the public and interested persons were
given the opportunity to express their opinions regarding the application.
G. The Board of County Comrnissioners closed the public hearing on the 3'd day of
October, 2011 to make a final decision.
H. l-he Board of County Commissioners on the basis of substantial competent
evidence produced at the aforementioned hearing has made the follorving determinations of fact:
That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted or could be
submitted and that all interested parties were heard at that meeting.
That for the above stated and other reasons, the Land Use Change Permit for a
compressor Station is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of Garfield Counfy.
That the application, if all conditions are met, is in conforrnance with the
applicable Sections of the Garfield County Unified Land Use Resolution of 2008,
as amended and in general conformance with the Garfield County Comprehensive
Plan 2030.

RESOLUTION
NOW THEREFORE, BE IT RESOLYED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Land Use Change Permit, LIPA 6893,to allow a Compressor Station and
related support inftastructure as depicted on Exhibit "A" is hereby approved subject to
com. pliance withthe following conditions:
That all representations made by the Applicant in the application, and at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Commissioners.
That the operation of the Noble Energy tnc. Rulison Compressor Station be done in
accordance with all applicable Federal, State, and local regulations goveming the
operation of this type of facility.
Prior to operation of any additional compressor units, the Applicant shall demonstrate
firll compliance with all CDPFIE Air Quatity construction and operations permitting
requirements.
Prior to operation of any additional compressor units, the Applicant shall
supplement theii noise analysis to confirm compliance with State regulations on
maximum noise generation including operation during nighttime hoqrs (7:00 p.m. to
7:00 a.m.). The updated study shall also provide clarification as to the type of sound
attenuating buildings and type of hospital grade ,mufflers to be installed. The
Applicant shall maintain compliance with State regulations on maximum noise
generation and the County may require additional noise analyses at the time of
building permit review associated with the installation of additional compressor units
to veri$ compliance
All equipment and structures associated with this permit shalt be painted with non-
reflective paint in neutral colors to reduce glare and mitigate any visual impacts.
Al1 structures and fences shall obtain building permits from the Garfield County
Building and Planning Department if required by County regulations.
All exterior lighting witl be the minimum amormt necessary or required by the
building code and industry standards, and shall be directed inward and downward,
except that provisions may be made to allow for safety lighting.

The Applicant shall comply with the recommendations of the Garfield County
Vegetaii-on Manager and shall provide a calculation of the disturbed area outside the
industrial footprint, and shall provicle reclamation security as determined by the
Vegetation Manager in accordance with the County Regulations. If the area of
disttrrbance outsidi the industrial footprint is less than % acre then no reclarnation
security will be required. The Security shall be held by Garfield County until
vegetation has been successfully reestablished according to the Reclamation
Standards in the Garfield County Weed Management Plan. It is the responsibility of
the applicant to contact the County, upon successful re-vegetation establishment to
,"qr"rt an inspection for security release consideration. The reclamation standards at
the date of permit issuance are cited in Section(s) 4.06, 4.07, and 4.08 of the Garfield
County Weed management Plan (Resolution No. 2002-94).
The Applicant shall maintain compliance with the existing weed management plan
including management of any weed or thistle problems on the site. As may be
determined necessary by the Garfield County Vegetation Manager, arurual site visits
may be conducted to ensure that any weed problems a.re properly managed.
Compliance with the Applicant's Storm Water Management Plan, Storm Water
Discharge Permit and Best Management Practices shall be required.
Prior to operation of any newly inLstalled compressor units, the Applicant shall
comply with the Spill Protection Conlrol and Counter Measures Plan (SPCC) existing
ur of the date of this Resolution. ,A.pplicant shall also provide the Building and
Plaping Department with a new SPCC plan within 6 months of completion of all 6
co*pr"iro. units. The Applicant shall include with said update documentation of
safety and emergency procedures, ter;hnology and equipment required for operation
of the facility in compliance wittr all Federal, State, or Local, and industry
requirements.
Prior to issuance of the Land Use Change Permit the Applicant shall provide the
Building and Planning Department with a copy of the Emergency Response Plan for
the sitq and a letter lrom the Rifl,e Fire Protection District or other acceptable
evidence indicating that the Applicant satisfied the Fire District's SPCC Plan
questions and related concerns contained in their email correspondence dated
September 27,2011.
