PROJECT INFORMATION AND STAFF COMMENTS
I. GENERAL PROJECT DESCRIPTION
The Application is requesting Limited lmpact Review for a Water Storage Facility and
Material Handling - Water Draw Facility along Parachute Creek. The Water Draw
facility will replace an existing truck pull-out along Garden Gulch Road where pumping
water from Parachute Creek currently is conducted. The existing use involves a
parking area and turn around, gas powered pump and suction hoses extended on
grade to the creek along a stabilized embankment.
The proposed use will upgrade and formalize the use through the construction of a
pump station adjacent to the creek, a fill station with storage and a water pipeline
connecting the pump station to the fill station. The proposed construction is
summarized below and shown on the attached site plans:
. Pump House (10'x 12') on a concrete slab. Elevated steel structure over Parachute Creek including a suction pipe and
retractable hose.
. Electric pump
. 10" water pipeline approximately 900 ft. in length
o Truck Fill Station with four 400 bbls water tanks, six truck bays, and related
access driveways and vehicle circulation.
o Re-v€getation and reclamation of approximately 1/3 of an acre of disturbed area
adjacent to Parachute Creek.

The facility is unmanned with exception of vehicles that are being filled with water and
maintenance and operation of the Pump House. Sanitation facilities are available at
the security station adjacent to the Water Filling Facility. A dust mitigation plan is in
place for the site. The Water Fill facility is immediately adjacent to the Chevron PDC
Energy Vehicle Safety Area.

II. LOCATION . SITE DESCRIPTION
The site is located in an area characterized by open space, agricultural ranching
activities, natural vegetation, and oil and gas operations. Existing vegetation
surrounding the site consists of mixed sagebrush, gambel oak, and riparian vegetation
along Parachute Creek. The site has moderate slopes and minimal additional
disturbance is anticipated by the proposal.

III. PUBLIC COMMENTS AND REFFERAL AGENCY GOMMENTS
Public Notice was provided for the Board's public hearing in accordance with the
Unified Land Use Resolution of 2008, as amended. No public comments have been
received at this time. Comments from referral agencies and County Departments are
summarized below and attached as Exhibits.
1. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering:o Discussed Staffing and water supply waiver justification.. Verification that no Flood Plain impacts or permitting is required.o ULUR Section 7-207 requirements for Drainage and Detention Plans.o The recommended double screen intake on the retractable pump hose for
wildlife protection.o Clarification on top soil salvage guidelines in reclamation plan.o Metering of water pump to comply with water rights limitations.. Documentation that SWSP plans are current and/or extensions timely
submitted.. Traffic information on any impacts on County Road 215.. Other waiver requests were reviewed with no comments generated.
2. Garfield County Road and Bridge Department: No written comments received.
Verbal comments indicated that no impacts on the County Road were anticipated.
3. Garfield County Vegetation Manager, Steve Anthony. lndicated that the reclamation
plan is acceptable and the project is not recommended for long term security. He
also requested that certified weed free straw be used for erosion control.
Garfield County Environmental Health: Noted the following topics.
. Proximity of the facility to Parachute Creek and precautions to ensure
vehicles are not leaking fluids.. Benefit of water storage lessening impacts during low -flow periods.
Grand Valley Fire Protection District: Did not submit formal comments but noted by
email that issues were not anticipated.
Colorado Division of Water Resources: lndicated that as long as the applicant
maintains their Substitute Water Supply Plan, or obtains a court decreed plan for
augmentation, and diverts pursuant to said plan, their office had no objection to the
application.
The Garfield County Flood Plain Manager, Gale Carmoney was consulted
regarding any County flood plain permitting requirements. He confirmed that there
is no current FEMA Flood Plain mapping on this section of Parachute Creek. His

input is reflected in the Staff Analysis and draft conditions including requirements
for additional engineering information on flood protection for foundations and the
pumping arm.
8. Other agencies that did not submit comments include: (a) the Colorado
Department of Public Health and Environment; (b) Bureau of Land Management;
(c) Town of Parachute; and (d) Colorado Parks and Wildlife.
IV. STAFF COMMENTS AND ANALYSIS
ln accordance with the ULUR, the Applicant has provided detailed responses to
Section 4-203, Submittal Requirements, applicable sections of Article Vll, Divisions 1,
2, and 3, and Section 7-1101 lndustrial Use Standards. The Application materials
include an lmpact Analysis and related consultant reports, technical studies, and plans.
Key topics for the review are summarized in the following sections.
Drainaqe, Storm Water. Stream Protection, and Armv Corp of Enoineers
1. The Water Draw component of the facility is located adjacent to Parachute
Creek. The pump house is shown on the site plans at approximately 26 ft. from the
high water line of the creek. Section 7-203 of the ULUR allows for allows for irrigation
and water diversion facilities within the 35 ft. stream setback - buffer. This would
include the proposed extension arm and retractable pump hoses proposed by the
Applicant. The code does however, preclude structures which would include the pump
house, lncreasing the setback for the pump house by approximately 9 ft. to meet the
35 ft. standard appears feasible. An alternative is the granting of a waiver from Section
7-203 for the proposed location with a 26 ft. setback as shown on the site plan.
2. Relocation of the truck filling activity and truck traffic to a location approximately
900 ft. from Parachute Creek represents a significant reduction in potential
environmental impacts including drainage or leakage of fluids from water trucks. ln
addition the pump will be electric powered also reducing the potential for impacts
including noise and spills from gasoline powered pumps.
3. There is no current flood plain mapping on this section of Parachute Creek and
the Application includes confirmation from the Army Corp of Engineers that no
permitting with the Corp is required. The proposed pump house is located
approximately 13 ft. above the typical water surface level of Parachute Creek. Given
the lack of formal flood plain mapping the Application should be supplemented with a
qualified professional's opinion letter that the pump house location is not anticipated to
be subject to flood plain impacts. Engineering should be provided for the proposed
foundations demonstrating protection from scour during a high water event and for the
pumping arm demonstrating that it has no impact on high water events and carrying
capacity of the creek. The pumping arm needs to be designed to avoid potential
damage from debris with a retractable or shortened design to be considered.
4. Storm Water Management Plans, Erosion and Sediment Control Plans and
Drainage Plans have been provided. Existing best management practices are in place
and additional facilities and installations are proposed. The plans should be
supplemented with calculations of storm water detention volumes necessary to protect
the Creek. The Applicant shall maintain compliance with said plans and any required
CDPHE Permitting.
Section 7-1 101 Standards for lndustrial Vehicle Safety Areas
5. The Application provides detailed responses to this Section including noting the
lack of outside storage, the fencing of the facilities, loading only on the Applicant's
property, the lack of any industrial wastes being produced, and no nuisance impacts.
Access - Traffic
6. The Application documents the legal access to the site along with a description
of the roadway as currently in use, the minimal traffic impacts associated with the use,
and construction related traffic activity. The Traffic Study should be updated in
accordance with referral comments from the County's Consulting Engineer to address
any impacts to County Road 215.
7. Signage identifying the potential for additional truck movements should be
considered for this section of Garden Gulch Road. The driveway access into the Water
Pumping facility should maintain clear vision areas with removal of vegetation if
needed.
Re-veqetation, Weed Control and Reclamation
8. The site is included in long term reclamation plans for the atea. Comments from
the County Vegetation Manager indicated his comfort level with the current plans
including integrated weed management. Use of weed free straw for storm-water
management should be required pursuant to the County Vegetation Manager's referral
comments.
L Boring for a portion of the proposed pipeline will significantly reduce surface
impacts. Revegetation of the open trench construction is proposed in accordance with
re-vegetation plans.
Safety
10. An Emergency Response Plan was provided with the Application submittal. The
plan and contact information should be kept updated.
Substitute Water Supply Plan and Renewals
11. The Applicant shall maintain their Substitute Water Supply Plan including
current and future renewals or obtain a court decreed plan for augmentation in
accordance with the referral comments from the Colorado Division of Water Resources
referral comments.
Article Vll Standards as Applicable
12. The Applicant has adequately addressed the applicable provisions of Article Vll
subject to compliance with conditions of approval. A general summary is provided
below:
There is no potable water demand for the facility based on the type of use.
A portable toilet is located adjacent to the site at the guard station and should be
maintained for use by this facility.
No new roads are proposed and existing roads provide legal access to the site.
The Applicant's Geologic Hazards Report does not identify major geologic or
soils hazards with the exception of landslide potential and slope hazards.
Based on Staffs site visit clarification of this part of the report's conclusion
should be provided to establish the lack of hazards affecting the proposed use.
No impacts on agricultural uses or adjoining properties are anticipated based on
the type of use.o A wildlife study was provided for the site and concluded that no threatened,
endangered, or sensitive wildlife species (for Garfield County) were observed or
would be expected to occur in the project area.. The study also included a general finding that no special status plants were
detected on their site visit and that no BLM sensitive plant species would be
affected by this project.o There is no storage of chemicals, fuel, or oil and gas products on the site. No
Spill Prevention Control and Countermeasure Plans (SPCC) are required but
the site plan does include a detention containment area.. No installations requiring Air Quality Permits from the CDPHE are proposed.. The Application included a Dust Mitigation Plan.o A Class I Cultural Resources Study was conducted by Flattops Archaeological
Consultants with a finding of "no historic properties affected".
V. COMPREHENSIVE PLAN
The Comprehensive Plan 2030 designates the site as lndustrial. Excerpts from Land
Use Description Section Chapter 2 and Section 9, Mineral Extraction are provided
below.
Chapter 2 - Land Use Designations
lndustrial (l) Description: lndoor manufacturing, outdoor equipment
storage, busrness parks, energy processing and uses that produce odor,
noise, light, and or emissions.
Section I - Natural Resources

1. Ensure that natural, scenic, ecological, and critical wildlife habitat
resources are protected and /or impacts mitigated.
4. Ensure the appropriate reclamation of land after extraction
processes.
Section 9 - Mineral Extraction - Policies
2. Mineral resource extraction activities will protect critical wildlife habitat
as identified by sfafe and federal agencies. Development within these
designations that cannot be designed, constructed and conducted so as
to have a minimum adverse impact upon such habitat or fhese wildlife
specles shall be discouraged.
4. Facilities that are appurtenances to oil/ gas development activities
(compressors, etc.) are considered appropriate in all land uses so long as
they meet the respective mitigation requirements of the ULUR to maintain
compatibility with surrounding land uses.
The location and design of the proposed facility is in general conformance with the
Comprehensive Plan Policies subject to proper mitigation of impacts. The Application
notes the reclamation of an area of existing impacts adjacent to Parachute Creek.

VI. SUGGESTED FINDINGS
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons the proposed Land Use Change
Permit for the Chevron - PDC Energy Water Storage and Material Handling - Water
Draw Facility is in the best interest of the health, safety, convenience, order, prosperity
and welfare of the citizens of Garfield County.
4. That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5. That with the adoption of conditions and granting of waivers from the
landscaping plan, water supply plan requirements, and river setbacUbuffer the
application has adequately met the requirements of the Garfield County Unified Land
Use Resolution of 2008, as amended.
V!I. RECOMMENDATION
The following recommended conditions of approval are provided for the Board of
Cou nty Commissioners consideration.
1. That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.
2. That the operation of the Chevron - PDC Water Storage and Material Handling -
Water Draw Facility shall be done in accordance with all applicable Federal, State,
and local regulations governing the operation of this type of facility.
Conditions Prior to lssuance
Prior to the issuance of the Land Use Change Permit, the Applicant shall provide
a supplement to the Geo-Hazard report including a more definitive determination
regarding the lack of any geologica! hazards including landslide and slope
hazards noted in the original report.
Prior to issuance of the Land Use Change Permit, the Applicant shall provide a
supplement to the Traffic Analysis including a determination of minimal or no
impact on County Road 215, including a determination that no improvements are
needed at the County Road 215 intersection.

Prior to the issuance of the Land Use Change Permit, the Applicant shall provide
confirmation from the County's Flood Plain Manager that no flood plain permitting
requirements apply to the proposal. The Applicant shall also provide an opinion
from a qualified professional that the pump house location is an acceptable
location and not anticipated to be subject to unreasonable flood impacts.
Prior to issuance of the Land Use Change Permit, the Applicant shall provide
preliminary engineering for the following: a) protection of foundations from scour
during high water events; b) the pumping arm extension demonstrating protection
from damage during high water events including from debris; c) the option of a
retractable design; c) confirmation that the proposed facilities will not impact the
carrying capacity of the creek during a high water event.
Waiver Approvals
Waivers from Section 4-203 regarding Water Supply Plans and Landscape Plans
are approved pursuant to the approval criteria contained in Section 4-202 of the
ULUR provided that the uses on the site maintain consistency with the Application
representations regarding the limited uses and activity on the site.
A Waiver from Article Vll Standards regarding Protection of Wetlands and
Waterbodies (Section 7-203) is approved pursuant to the approval criteria
contained in Section 4-117 of the ULUR provided the use and site plan location
for the pump house maintain consistency with the Application representations. ln
lieu of said waiver the Applicant can relocate the pump house to create a
conforming 35 ft. setback from the typical and ordinary high water line of
Parachute Creek.
Other Gonditions
The facility shall maintain compliance with CDPHE Storm Water Management
Permits and requirements, Drainage and Grading Plans, Erosion and Sediment
Control PIans, including Re-vegetation, and Reclamation Plans. The plans shall
be supplemented with calculations of storm water detention volumes necessary to
protect the Creek. Re-vegetation shall be initiated during the next growing season
following completion of construction and shall include: a) stabilization and riparian
plantings on the disturbed bank adjacent to Parachute Creek; and b) native
seeding along the pipeline disturbance.
The Applicant shall maintain their Substitute Water Supply Plan including current
and future renewals or obtain a court decreed plan for augmentation in
accordance with the referral comments from the Colorado Division of Water
Resources referral comments.

The facility shall maintain compliance with Section 7-306 Lighting, with all lighting
to be directed inward and doward toward the interior of the site. Facilities and
water storage tanks shall be painted a non-glare neutral color to lessen any visual
impacts.
Portable toilet facilities will be provided on site or adjacent to the site at the
Garden Gulch Guard Station.
An Emergency Response Plan was provided with the Application submittal. The
Plan and contact information shall be kept updated.
The Applicant shall comply with their Noxious Weed Management Plan including
the best management practices. Certified weed free straw shall be used for storm
water mitigation.
The Applicant shall install signage at the entrances to the facilities directing traffic
and shall maintain clear vision areas at access points including removal of
vegetation if needed. Signage noting additional truck traffic and turning activity
shall be provided on Garden Gulch Road adjacent to the site. Protection for the
existing pipe structure adjacent to the east entrance of the Fill Facility shall be
maintained in accordance with industry standards.
The Applicant shall comply with the recommendations of the West Water
Engineering lnc. Wildlife lmpact Study as represented in the submittals and
include a second screen fully enclosing the pump intake to allow aquatic wildlife to
escape suction during pumping.

This office has performed a review of the documents provided for the Limited Impact
Application of Chevron for the Water Storage and Water Draw Facility. The submittal was
found to be thorough and well organized. The following cornments were generated:
l. The Applicant should discuss staffrng and ongoing need of employees at the facility to
detennine if the waiver concerning a water supply plan is justified.
2. The application materials do not mention if there is a FEMA floodplain associated with
Parachute Creek and any impacts or permitting that may be required. The Applicant should
verify any efforts necessary.
3. Section V-?A7 of the ULUR has requirements pertaining to attenuation of peak flows and
detaining runoff if the project is within 100'of a water body. Since the proposed pump
house is within this margin of Parachute Creek, the Applicant should provide supporting
documentation and calculations for the peak flows and any detention required.4. One of the recommendations of the Wildlife lmpact study was to install a double screen on
the intake end. No construction details of the screen, pump house, orretractable piping was
included in the application materials; these details are stated to be generated after approvals
are obtained. At a minitnum the retractable double-screened intake should be made a
condition of approval and the design should be submitted to Garfield County for review prior
to construction.
5. Page 8 of the Reclamation Plan has a reference to the Wyoming Department of
Environmental Quality guidelines for topsoil salvage. The Applicant should verify if that is
the intended method to.be used and if there may be a method applicable to the State of
Colorado.
6. The water facility will need to provide some method of metering water pumped from
Parachute Creed to comply with water right commitments. This should be made a condition
of approval pending a design submitted to Garfield County, similar to above.
7. The Substitute Water Supply Plan (SWSP) has conditions of approval that require submiuals
be provided if the SWSP is to extend past July 31,2013. The life of the water facility is

likely intended to extend past July 31,2013 and the deadline for the submittals of May l,
2013, has passed. The Applicant should provide evidence that the paperwork and approvals
for necessary extension of the SWSP are current and/or timely submitted.
8. Table I in the Basic Traffic Study provides only nine months of data. The Applicant should
address if there was other data available for the entire year. The Applicant contends that the
drilling decrease is the reason for the decreased traffic, however decrease in traffic could
have other reasons such as seasonality. Additional traffic counts should be provided if
available.
9. The Basic Traffrc Study provides only information on Garden Gulch Road. The Applicant
should address any impacts that are expected to CR 215.
10. The waiver requests were reviewed and generated no comments.

We have reviewed the Chewon-PDC Energy Water Storage and Water Draw Facility Limited Impact
Review application. The applicant is proposing to develop a permanent pump facility at an existing
truck pumping site on Parachute Creek. The water is diverted pursuant to a Substitute Water Supply
Plan (SWSP) approved by this office.
The SWSP began in zoro and has been renewed through July 3r, 2013; an application to extend the
SWSP through July 3r, 2014 has been received by this office. The applicant has submitted an
application to the Division 5 Water Court, court case no. o9CWr6, to decree a permanent Plan for
Augmentation; however the case has not yet been decreed.
The SWSP allows for pumping at the Parachute Creek PDC Diversion, on Parachute Creek, and at the
Sinclair Pump and Pipeline, on the Colorado River. The two points of diversion are currently limited
to a combined 245 AF per year at z cfs simultaneously for industrial uses associated with hydrocarbon
exploration and production operations. The applicant has requested that this amount be reduced
from 24S AF to r53 AF for the zor3-2o14 renewal period. Pursuant to the SWSP, diversions at the
Parachute Creek pumping facility must cease if there is a "call" on Parachute Creek; in this situation
pumping can only occur at the Sinclair Pump and Pipeline. This facility would be directly affected by
such a situation.
So long as the applicant maintains their SWSP, or obtains a court decreed plan for augmentation, and
diverts pursuant to said plan, this office has no objections to this application. If you or the applicant

I have fewer questions and comments after our tour earlier this week, which addressed most of them. However, there
are a few things Chevron and PDC should pay attention to:
- While this facility will reduce the proximity of vehicles to Parachute Creek , the site is still fairly close to the creek
and special precautions should be taken to ensure that vehicles are not leaking fluids that could migrate down
into the creek.
- Storageofwaterduringhighflowtimeswillhelptoalleviatepumpingofwaterduringlow-flowperiods. Thank

The traffic assessment performed for the proposed water draw and vehicle safety area (VSA)
included a summary of the existing traffic, both volume and truck percentages, along Garden
Gulch Road and the recent trending volume reductions along the roadway. lt also assesses the
expected traffic, both volume and truck percentages, to the proposed facilities and the level of
inclusion of the traffic as a subset of the existing volumes. Taking into account these
considerations, it is expected that there will not be an appreciable increase in volume or shift in
proportion of heavy trucks as compared to the total site traffic along Garden Gulch Road or its
intersection with CR 215. Therefore, it is not expected that the proposed facilities will create
additional impact on the portions of these roadways currently utilized by site traffic and will not

As noted in the Conclusions and Summary of the Geological and Soil Hazards Report dated
March 2013 and included in the application:
According to the information provided by Garfield County, Colorado - GIS
Department pertaining to the location of the proposed Water Draw and Pump
House Facility, with the exception of slope hazards, the overall geologic and soil
hazards appear to be low.
Stormwater controls and Best Management Practices (BMPs) should take into
consideration the geology and soil types present at this location. These
engineering controls and practices should be used temporarily and permanently
to divert stormwater away from the construction areas and to prevent additional
weight which could trigger a debris flow or landslide. Catchment basins should
be sited and designed so as not to add weight to potentially unstable areas.
The hazards identified in the Geologic Hazard Report are general in nature, and typify concerns
which should be addressed during construction and operation to mitigate these risks. No
immediate risks relating to the landslide and slope hazards beyond those which can be found
throughout the Parachute Creek valley exist in proximity to the proposed facility.

This letter is a follow-up to Staff Report: Chevron - PDC Water Draw (File No. LIPA 7533), dated June 10,
2013. The following text and attached documents are intended to accommodate the request for additional
information as detailed in Conditions of Approval(COAs) #5 & #16.
COA #5: Prior to the issuance of the Land Use Change Permit, the Applicant shall provide confirmation
from the County's Flood Plain Manager that no flood plain permitting requirements apply to the proposal.
The Applicant shall also provide an opinion from a qualified professional that the pump house location is
an acceptable location and not anticipated to be subject to unreasonable flood impacts.
RESPONSE to COA#S: As a result of phone contacUdiscussion with the Garfield County Flood Plain
Manager Gale Carmoney on June 5, 2013, Mr. Carmoney confirmed no flood ptain oermittinq
requirements aoplv to the proposal.
COA #16: The Applicant shall comply with the recommendations of the West Water Engineering lnc.
Wildlife lmpact Study as represented in the submittals and include a second screen fully enclosing the
pump intake to allow aquatic wildlife to escape suction during pumping.
