As per our phone conversation I am providing you with some additional information related to the PDC/Chevron Water
Draw LIR application.
1) Attached please find an addendum to our submittal: a request for waiver of the Water Supply Plan
requirements.
2l The substitute water supply plan for removing water from Parachute Creek expires on July 31, 2013. The
renewal request was submitted on April 8, 2OL3 and a copy of the document is located on page 29 of the
"Water Rights Docs" section of the application submittal.
3) PDC's response to the comment in the wildlife report related to screening the water draw suction hose is in
Section 7.d, page 5 of the tmpact Analysis section of the application submittal.

Waiver Request - Addendum 4llDt2013
Pursuant to Section 4-202 of the Garfield County Unified Land Use Resolution, pDC Energy(PDC) requests a waiver for the Submittal requirement of a Water Supply plan for the pDC -
Chevron Water Draw.
Section 4-203. M. Water Suppty plan
A waiver request shall be considered based on the following criteria:
1. The Applicant shows good cause for the requested waiver;
Response: The purpose of the facility is to draw fresh water from parachute Creek to be
stored, transferred to water trucks and used by PDC for drilling, hydraulic fracturing, dust
suppression, hydromuiching and other related uses. -i-his iacility cioes not require potaoie
water for personnel or freshwater for sanitary facilities or landscaping. Truck drivers will
carry their own potable water. Sanitary facilities will be provided by an existing portable
toilet located near the facility at the Garden Gulch Road security station and vehicle
safety area and does not require a water supply. Landscaping is not being proposed and
a water system is not required for irrigation. These factors support a waiver.
2.The project size, complexity, anticipated impacts, or other factors support a waiver;
Response: The operations of the facility will be similar to other water storage facilities in
relatively remote areas of Garfield County. No potable water will be provid6d at this
facility. Sanitary facilities will not require a source of water. No landscaping is planned
for the facility that would require additional water. These factors support a waiver.
The waiver does not compromise a proper and complete review; and
Response: A proper and complete review of the water draw facility would not be
compromised by the absence of a water supply plan. PDC has supplied documentation
demonstrating water rights associated with drawing water from Parachute Creek.
The information is not materialto describing the proposal or demonstrating compliance
with approval criteria.

Response: A water supply plan is not materialto describing the purpose, operation andmaintenance of a water draw facility or demonstrating com[liance with applicable
approval criteria.
Pursuant to Section 4-11T of the Garfield
(PDC) requests a waiver for the Standards
Chevron Water Draw.

Section 7'105 Adequate CentratWater Distribution and Wastewater Systems.
A waiver may be approved if the Applicant demonstrates that the following criteria have been
met by the proposed alternative:
Achieves the intent of the subject standard to the same or better degree than the subject
standard; and
Response: The intent of the standard is to assure that new development obtain an
adequate water supply to serve the proposal. These types of development typically
would include residential or commercial uses that require a regular water supply for
drinking, sanitary and landscaping needs. The Water Draw proposal does not require a
water supply for these purposes. The facility witl not have regular personnel staffing the
site. Potable water will be furnished by each truck driver for their personat use. Sanitary
facilities will be provided by a portable toilet currently placed near the site and a
wastewater system will not be warranted. Landscaping is not being proposed and a
water system is not required for irrigation purposes. The intent of the standard is
achieved by these site specific factors.
lmposes no greater impacts on adjacent properties than would occur through
compliance with the specific requirements of this Code.
Response: The adjacent properties primarily contain agricultural and natural gas
extraction uses. Adjacent properties will not be impacted by waiver of the water supply
standard.
