Anthony Perry A tract of land located in portions of Sections 21 and 28, T3S, R87W; located in the Sweetwater area of Garfield County, north of County Road 161. The site consists of approximately 253 acres. Individual Well Individual Sewage Disposal System C.R. 161 NR/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in an area not shown on the Comprehensive Plan Management Districts Map in the Sweetwater Creek area. IL DESCRIPTION OF THE PROPOSAL A . Site Description The site is located on the north facing slopes of the Sweetwater Creek drainage. Improvements presently on the property include a lodge, main residence, 2 mobile homes for employees, six ( 6) guest cabins and various out buildings. The majority of these buildings sit on a bench that was an open meadow prior to the existing resort being built. B. Project Description. The applicant is requesting to expand an existing resort by the addition of three (3) one bedroom guest cabins and a two bedroom guest cabin. This would expand the total visitor capacity up to 26 people, from the existing 16 guests.(See plaif ~ In addition to the expa nsion of the guest capacity, the applicants are -I· proposing to expand the lodge, replace the employee mobile homes with a two story structure that will house the manager's family on one floor and have bunk house for up to four employees on the other floor. There will be other improvements to the barn. The previously noted main house will be split off the main resort parcel on a 35 acre tract. The portion of the ranch not devoted to the resort complex will be split into seven (7) thirty-five acre tracts to generate capital for the resort improvements. The resort will be served by separate ISDS systems and water is provided from a spring, that is a chlorinated system. III. MAJOR ISSUES AND CONCERNS I. Zoning. A resort is allowed by Special Use Permit in the AIRJRD zone district. A resort is defined as: Dude ranch or guest ranch; hunting or fishing camp, cross country or trail skiing lodge (any of which shall not exceed twelve (12) dwelling units or forty-eight ( 48) beds or visitor capacity), land used for the purpose of recreation, which provides lodging recreational activities, dining facilities, commissary and other needs operated on the site for guests or members. This application meets the basic criteria in terms of visitor capacity and /or dwelling units and can be classified as a resort. There is no minimum size for a facility, nor definition of what type of recreation the land has to be used. 2. Sewer. The applicant's engineer has included plans for new ISD systems to treat sewage from the upgraded facilities. The capacity of each of these systems is less than 2,000 gallons per day, as such, the proposed sewage disposal is in compliance with County sewage disposal system requirements. 3. Ownership: The application includes the property that will be sold as 35 acre tracts to investors. Since these tracts will be under separate ownership in the future, it would be appropriate to legally describe the property that will contain the resort facilities for the Special Use permit and not encumber any of the other properties with SUP conditions of approval. IV. SUGGESTED FINDINGS I. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, subject to the following conditions: 1. All representations of the applicant, either within the application, or stated before the Board of County Commissioners, shall be considered conditions of ~ z- 2. ~3. The resort will comply with the State Department of Health, Consumer Protection Division, licensing requirements for a commercial kitchen, if required.
