(Boundary Line Adjustment) (Parcel Number: 218534400021 (unplatted)) - Unaddressed parcel located approximately 1.7 miles south of the City of Glenwood Springs on 4-Mile Road (Parcel Number 218534300023), Glenwood Springs, CO 81601, and, - Unaddressed parcel located approximately 1.7 miles south of the City of Glenwood Springs on 4-Mile Road (Parcel Number 218534400021), Glenwood Springs, CO 81601. Amend the Final Plat of the 1st Amended Final Plat of Sunlight Parkway (9.924 acres to 16.66 acres) with land conveying from metes and bounds Parcel 218534400021 (42.102 acres to 35.366 acres). This is being processed as an Amended Final Plat application for the platted parcel and one Boundary Line Adjustment for the unplatted parcel. Rural Approval with Conditions I. DESCRIPTION OF PROPOSAL. REQUEST The Applicant is requesting to amend the Final Plat of Sunlight Parkway (also known as the Sewage Treatment Area of the Sunlight View Subdivision) by increasing its size from 9.924 acres to 16.66 acres while reducing the size of adjacent unplatted metes and bounds parcel from 42.102 acres to 35.366 acres. This is being processed as an Amended Final Plat application for the platted parcel and a Boundary Line Adjustment for the unplatted parcel. The Sunlight Parkway parcel currently has the sewage treatment facility for Sunlight View Subdivision while the unplatted parcel is undeveloped. Both parcels are owned William and Charlotte Zilm. ln addition to amending the property boundaries, the Applicant is proposing to vacate a 7.5' utility easement, 12.5' utility easement and an access easement as a part of this amended plat as well. Staff understands that the sewage treatment facility will be removed from the platted parcel in the rtearfuture as the Sunlight View Subdivision will be connected to City sewer. No changes are proposed to the existing access or utilities as a result of the amended plat. ln addition, no nonconforming conditions have been identified that will be a result of the lot line or easement modifications. The Applicant requested a waiver from the submittal requirements for an lmprovements Agreement and Codes, Covenants and Restrictions (CCRs). These requests are deemed appropriate for the Application as no new improvements are proposed or required as a result of the Amended Plat and no new CCRs are proposed. II. AUTHORITY - APPLICABLE REGULATIONS The Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat Review and Tables 5-103 Common Review procedures. Section 4-103 and 4-101 address details of the review procedures. The Application has been determined to be complete including waiver requests addressing the fact that an lmprovements Agreement is not warranted for the Plat Amendment Request and no new CCRs are proposed. Public notice was required forthe Director's Decision in accordance with Sections 4-103 and 4-101 . The Applicant has provided evidence of completion of the required notice for the Directors Decision. III. STAFF ANALYSIS 1. The Applicant's proposals were reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: 1. Does not increase the number of lots; and - The proposed Amended Plat will not increase fhe number of lots. 2. Does not result in a major relocation of a road or add any new roads; or - The proposed Amended Plat will not result in a major relocation of a road or add new roads. 3. Will correct technical errors such as surveying or drafting errors. - The Amended Plat has not been proposed to correct technical errors. 2. No conflicts with the existing underlying zoning have been noted including lots size and setbacks. 3. No changes to existing utility locations, drainage easements or access are proposed as part of the amended plat process. lt is proposed to abandon two utility easements and an access easement, all of which are not currently used or anticipated to be used in the future. 4. The Applicant completed the County Public Notice lnformation form indicating that public notice was sent on October 1,2014. Certified mail receipts were also provided. Staff has reviewed the Applicants representations and evidence regarding public notice and it appears the requirements have been adequately satisfied. 5. The Application was reviewed by the Garfield County contract engineer, Chris Hale, PE of Mountain Cross Engineering (See Exhibit 2). Mr. Hale had no comments. 6. The County Surveyor has reviewed the plats and has indicated that he has no comments (See Exhibit 3). !V. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that the Sunlight Parkway Amended Final Plat Application meets the requirements and standards of the Garfield County Land Use and Development Code as amended and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval. 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat shall be subject to final review and approval by the County prior to submittal of the plat for final execution. All standard plat certificates and signature blocks shall be included on the final plat. 3. For recording purposes, the final Mylar shall be created in black and white only.
