PROPERTY OWNER: Williams Production RMT, (owner) - parcel to be used to access their existing pipeline. Project representative: Jimmy Smith, Wagon Wheel Consulting, Inc. LOCATION ! ACCESS: Parcel # 2409-321-00-110, N of Interstate 70, access from Highway 6 , west of CR 215 SITE INFORMATION: 18 acres EXISTING & ADJACENT ZONING: RESOURCE LANDS (RL) Zone District I. REQUEST This proposal is to install a natural gas compressor facility with two (2) Caterpillar model 3512 gas- fired compressors that will gather, compress and dehydrate natural gas from an existing low pressure pipe system to the east then discharge it into the existing Williams 20" high pressure pipeline. Additional equipment necessary at this location includes a slug receiver to collect liquids from the low pressure field operations and a glycol re -boiler to condition the gas to enter the Trans -Colorado Pipeline west of Debeque. Tanks for the temporary storage of produced water will be included on the site. It is anticipated that 10-20 barrels a day of produced liquids will be generated by the two compressor units, and those liquids will be trucked to an Hoover Express Compressor Station SUP — BOCC — 4/13/2009- Page 2 approved disposal site generating 1 to 2 trips each month. The site will cover 4.9 acres, is proposed to be secured with an 8' chain link fence and have no full time exterior lighting other than that for nighttime maintenance or emergencies. The 1.4 mile pipeline will be installed in a 75' construction right-of-way that will revert to a permanent 50' right-of-way easement after construction. On private land 4' of cover shall be put in place and 5' cover for the pipeline in the CDOT right-of-way for Highway 6 & 24. Hoover Express Compressor Station SUP — BOCC — 4/13/2009- Page 13 II. BACKGROUND Referral to Planning Commission Staff brought the application to the attention of the BOCC to determine if a referral to the Planning Commission was necessary. The BOCC did not refer the application to the Planning Commission. 111. SITE DESCRIPTION The compressor site is situated in a canyon north of 1-70 off a frontage road that dead -ends west of the site. The site was previously disturbed as part of the construction of 1-70, with piles of cracked asphalt and topsoil berms on it. It is out of the wash for Smith Gulch. There are no residences nearby, as the property north of the interstate is vacant or Federally - owned. (The nearest residential boundary is 4430 feet away, located south of 1-70 and north of Highway 24 and the railroad line, just east of Traveler's Highlands industrial subdivision. The residence itself is more than 2 miles away.) IV. ZONING & ADJACENT USES The subject property is zoned Resource Lands (RL). The type of use requested falls under the definition of "Site for extraction, processing, storage of material handling of natural resources" contemplated as special use in the zone district. The adjacent parcels are Federally -owned (BLM) and zoned `Open Space.' V. REVIEW CRITERIA FOR SPECIAL USE PERMITS (SECTION 5:03) Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall conform to all requirements listed in the Zoning Resolution, as well as the following standards: 1. Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Response The compressor station operates 365 days a year, 24 hours each day as a facility generally monitored remotely, but supervised by 1 employee on-site once for 1 -2 hours per 24-hour period. The general understanding is that the station is monitored 24 hours a day by personnel, but there are no living quarters on the site. A portable toilet on the site meets the sanitation demands for the personnel operating the site, including the build -out to 5 compressor units. There is no demand for water as part of the sanitary facility or compressor station/pipeline operation; potable water for employee use will be provided by employees. During the `construction phase, up to 44 people are anticipated to travel to the site. Portable sanitary facilities are used at the site to accommodate the sanitation need. The sanitary facilities may need to be serviced more often during the `construction phase'. The construction phase for the pipeline and compressor station is anticipated to be about 4 weeks. Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. Response The 'construction phase' is estimated to last four weeks for the installation of the 2 compressors and pipeline. During construction the site is expected to generate 80-88 trips (40-44 in, out) with half of them being private pickup trucks and rest delivery of heavier equipment and trailers. The route used for the pipeline is Highway 0/24, and a dirt frontage off Highway 6/24 is access for the compressor station. All of the truck travel will be traveling on CDOT roads. After construction there will be minimal traffic generated by the operation. The normal trip generation in the operative function of the site is: two (2) trip daily by pickup (1in, 1 out, once daily) for monitoring and four trips (2 in, 2 out) monthly by water tanker for produced water removal purposes. No improvements to State Hwy 6/24 were requested in response to this Compressor /pipeline installation. A valid utility permit is required and has been secured from CDOT. All vehicles involved in this installation shall meet the requirements set forth by Garfield County Road & Bridge. 3. Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. Response The property is located in an area that has limited human occupation, and the site is bounded on three sides by steep canyon walls. An 8 -foot chain link fence is to surround the entire compressor facility to provide security and keep wildlife from entering the site. As a condition of approval, the equipment and fencing on the site is painted with a neutral shade of tan (or `beetle green' as recommended on forested BLM sites) non -reflective paint to minimize glare and be more visually inconspicuous. There is no fulltime lighting proposed for the site, only emergency lighting and that to accommodate night maintenance, provided by a generator. It shall be directed downward and inward as a condition of approval. It is the Applicant's intent that the compressors be operated so that noise levels will comply with the `light industrial' standards set forth by COGCC 800 series regulations. The noise assessment indicated that the noise levels would be slightly higher than the nighttime Hoover Express Compressor Station SUP —8©CC-4/13/2009- Page 1 5 minimum without noise attenuation devices. Sound attenuation measures as per the sound study and wildlife recommendations shall be a condition of approval. Section 5.03.07 !Industrial Operationsj Pursuant to Section 5.03.07 of the Zoning Resolution, a permit for Industrial Operations requires the submittal of an impact statement on the proposed use describing its location, scope, design, and construction schedule, including an explanation of its operational characteristics. The impact statement is required to address the following: (A) Existing lawful use of water through depletion or pollution of surface run- off, stream flow or ground water. Response Because there are ephemeral water courses on the site, a 404 permit was required from the US Army Corps of Engineers, and has been issued. The facility site has been designed to insure protection of ground water and nearby streams through the development and implementation of a Storm Water Management Plan for the area. Staff notes that this plan is general to the area, and recommends as a condition of approval that a site specific plan be appended to the general plan for the compressor site and pipeline location. (B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations. Response Vapor, smoke and vibration related to construction are transient effects that will end with the construction phase, and not continue into the operational phase. Dust, particularly in the construction of the pipeline shall be mitigated as a condition of approval. As a condition of approval, glare from the site will be mitigated with the requirement of non -reflective paint in a neutral color. Compressors produce considerable volumes of noise and vibration, and their noise levels are regulated by the COGCC Series 800 regulations of the Colorado Revised Statutes. A modeled acoustic analysis was performed by HRL Compliance Solutions, Inc. The sound analysis for the site indicated that the operations without noise attenuation measures will not perform within required nighttime dBl levels for light industrial standards at the nearest property boundary. Further, the wildlife study of the application recommends noise attenuation to reduce impacts on wildlife behavior, primarily large mammals. Noise generated will have little impact on the closest residential property because the distance from the site is substantial and the home is across the interstate highway, which has its own contribution to ambient noise. Hoover Express Compressor Station SUP — BOCC— 4/13/2009- Page 1 6 The Applicant had recommended that the first two compressors be installed and operated as outdoor units until market conditions required the addition of the other three (3) units to complete the station with five (5). At the time the additional units were proposed to be installed, the Applicant stated that a structure would be constructed to house all the compressors, Staff recommends a condition of approval be that all compressor units be enclosed within a structure to bring the noise within light industrial standards. Response The site is located within overall range land for mule deer, elk, mountain lion and black bear as identified on the Division of Wildlife's wildlife distribution maps. The site and pipeline area Hoover Express Compressor Station SUP — BOCC — 4/13/2009- Page pipeline area are also identified as winter range for elk and mule deer, and severe winter range for mule deer, as well. While there are areas on the parcel (away from the compressor site and pipeline route) that are suitable for plant species of concern, there were none found growing in project construction routes, nor were there any species federally listed as `threatened' or `endangered'. There were no Federally -listed animal species identified in the project area. Birds of conservation concern (BOCC), including three species of raptors, were seen in the area, including golden eagles, red-tailed hawk and bald eagles. An active red-tailed hawk nest was identified near the pipeline route. Wildlife stipulations from the Colorado Division of Wildlife call for avoidance of active red-tailed hawk nests by a distance of .33 mile during the months between March 15th and July 15th. As a condition of approval, a certified wildlife biologist shall inspect the nest sites to confirm occupation, and if a nest is active, construction within .33 mile of this location shall not be undertaken between March 15th and July 15tH The rocky outcrops and forest cover also provides desirable habitat for raptors and other birds, as well a preferred hunting area for mountain lions. This hunting activity is related to value of the foothills habitat and the concentration of mule deer, an important prey species. This area is not noted as a `conflict area' for mountain lion, however. A small spring in Smith Gulch provides a limited surface water source used by wildlife. Some of the 4.9 -acre site has been previously disturbed. The site's fencing will not present a hazard to wildlife. There is no human habitation onsite and the limited foodstuffs and refuse accumulated is emptied often enough to prevent the aftraction and habituation of black bears and coyotes. The limited human presence and a facility mitigated for noise disturbance would reduce the adverse effects on elk and deer populations. Recommendations for sound attenuation in the wildlife report is also supported by Staff as a condition of approval. (D) Affirmatively show the impacts of truck and automobile traffic to and from such uses and their impacts to areas in the County. Response As noted earlier, the compressor facility, once fully operational, is expected to generate limited vehicle trips per day into and out of the facility. Most of this truck travel will be traveling Highway 6/24 which is capable of handling the additional trips. There is no proposed increase of occupancy of the site. This existing road meets the County's standards. The initial traffic is related to construction. The delivery of the compressor equipment and related materials will follow. Vehicles range from pickup trucks to semi -trucks with trailers to transport heavy loads, such as compressor, parts. 7 Hoover Express Compressor Station SUP — BOCC 4/13/2009- Page 1 There is no mention from the Applicant regarding measures to treat fugitive dust during construction, but this shall be a condition of approval. (E) That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s). Response The operations at the facility will not involve any abutting property, provided the noise is attenuated. The proposed facility will not encroach upon existing setbacks or reduce current separation distances to abutting properties. Staff agrees that the existing facility is located well within required setbacks and is sufficiently separated from adjacent properties in all directions. (F) Mitigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section 5.03.08 of this Resolution Special Use Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issued; Response A plan for site rehabilitation has been submitted and shall be implemented for on-going weed abatement and reclamation, should the site be abandoned. It is stated that the site would be returned to rangeland in the event that the site use is ended. Both Tong -term and short-term securities are mentioned in the referral comments by Garfield County Vegetation Management and Garfield County Planning Department's Project Engineer, and shall be conditions of approval. (B) The County Commissioners may require security before a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners; Response In the past, the Board has required, as a condition of approval that "A sufficient monetary security, determined by the Board of County Commissioners, to ensure rehabilitation of the site once operation has ceased shall be provided by the Applicant,, Hoover Express Compressor Station SUP — BCCC — 4/13/2009- Page Both Long-term and short-term securities are mentioned in the referral comments by Garfield County Vegetation Management and Garfield County Planning Department's Project Engineer, and shall be conditions of approval. Section 5.03.08 findustrial Performance Standards! Pursuant to section 5.03.08 of the Zoning Resolution, all Industrial Operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards: (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (2) Vibration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards. (4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. (5) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas: (A) Storage of flammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply with the national, state and local fire codes and written recommendations / comments from the appropriate local protection district regarding compliance with the appropriate codes; (B) At the discretion of the County Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall adequate to conceal such facilities from adjacent property; (C) No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural causes or forces; (D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and the following standards: Hoover Express Compressor Station SUP — BOCC— 4/13/2009- Page 1 10 1. The minimum lot size is five (5) acres and is not a platted subdivision. 2. The equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. 3. All equipment storage will be enclosed in an area with screening at least eight (8) feet in height and obscured from view at the same elevation or lower. Screening may include berming, landscaping, sight obscuring fencing or a combination of any of these methods. 4. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m., Mon. -Fri. 5. Loading and unloading of vehicles shall be conducted on private property and may not be conducted on any public right-of-way. (E) Any storage area for uses not associated with natural resources shall not exceed ten (f 0) acres in size. (F) Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. (6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. Staff Response Should the Board approve the request for the Compressor Station, Staff suggests the industrial performance standards be considered conditions of approval as they are specifically intended to ensure that any industrial use such as the proposed Compressor function in accordance with the proper best management practices and within the parameters of the State statutes. There is no proposed storage for heavy equipment on the site after the construction period, and no proposed full time lighting. The requirement for screening should not be required as the site is remote, bounded on three sides by steep canyon -walls, without water to support a stand of planted trees. The parcel boundary of the nearest potentially affected residential boundary is more than 8/10 of a mile distant, and the residence itself is more than 2 miles distant, with the interstate between the facility and the residence. Hoover Express Corepressor Station SUP — BOCC— 471.3/2009- Page The site is not situated so as to allow vibration to emanate beyond the boundaries, nor have fumes or other emanations off-site. The site is not proposed to be used for storage, aside from limited produced water, which shall, as a condition of approval, be properly stored in approved containers inside an adequately sized spill containment basin. As mentioned previously, as a condition of approval, the Storm Water Management Plan shall be appended to include site-specific information for this permitted use. Section 9.03.05 [Periodic Review of SUPJ Pursuant to section 9.03.05 of the Zoning Resolution: Any Special Use Permits may be made subject to a periodic review not less than every six (6) months if required by the County Commissioners. The purpose of such review shall be to determine compliance or noncompliance with any performance requirements associated with the granting of the Special Use Permit. The County Commissioners shall indicate that such a review is required and shall establish the time periods at the time of issuance of a Special Use Permit. Such review shall be conducted in such manner and by such persons as the County Commissioners deem appropriate to make the review effective and meaningful. Upon the completion of each review, the Commissioners may determine that the permit operations are in compliance and continue the permit, or determine the operations are not in compliance and either suspend the permit or require the permittee to bring the operation into compliance by a certain specified date. Such periodic review shall be limited to those performance requirements and conditions imposed at the time of the original issuance of the Special Use Permit. Staff does not recommend periodic review of the site as the conditions will serve as a mechanism for operating within the necessary standards of the permit. VI. REFERRAL AGENCY COMMENTS Staff referred this to a number of referral agencies for comment: A. Garfield County Planning Dept. Project Engineer, John Niewoehner PE: Email, 3.30.09 No concerns regarding the Hoover Express Compressor Station. Just the normal comments: • Short-term financial security for the re -vegetation of the pipeline. We will be looking for our typical $2.500 per acre security. I think the bond .should he given to you but Steve Anthony should be kept informed They will need to contact Steve Anthony to get the security released • Long-term financial security is needed lo guarantee the eventual reclamation of the land occupied by the compressor station. They will need to provide a cost estimate for the removal of all structures and the reclamation of the land. We will need to adjust the amount ofr inflation and request a bond for that amount. (Per Article XIII of the Land Use Code) 11 Hoover Express Compressor Station SUP — BOCC — 4/13/2009- Page 112 B. Garfield County Road & Bridge Dept., Jake Mall, Administrative Foreman: Letter, 3.5.09 • Garfield County Road & Bridge Department has no objection to this application with the following comments. • This application has no impact on Garfield County Roads as all access are on CDOT Highways and private property. C. Garfield County Vegetation Management Dept., Steve Anthony, Director: Letter 3.20.09 Integrated Vegetation and Weed Management • The weed inventory and weed management plan is acceptable. • It is recommended that the applicant cut and treat the inventoried tamarisk prior to the construction of the pipeline. • During construction, before leaving the site, all off road major construction equipment (graders, dozers, etc) working in areas of diffuse knapweed should be power washed to remove seeds, soil, and vegetative matter. • The submitted vegetation and weed management plan is acceptable. Reclamation Two securities are requested. These securities should be done separately since the time frame for security release is in the short term for the pipeline. Compressor Station • The applicant has quantified the surface area to be disturbed. A revegetation security of $20,000 for the compressor station is requested (5 acres x $4000/acre-$4000/acre is the long-term revegetaion per acre security rate). Pipeline • The surface area disturbed by !he pipeline will be about 12 acres. A revegetation security of'$30,000 (12 acres x $2500/acre) is requested. • The applicant shall provide the Vegetation Management Department with the original tags from each seed bag. • The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the responsibility of the applicant to contact the County, upon successful revegetation establishment, to request an inspection for security release consideration. Erosion control Any straw or hay bales used in erosion control shall be cert f ed weedfree. D. No comments received: • Garfield County Oil & Gas Liaison, • Garfield County Environmental Health Department, • Colorado Division of Wildlife (CDOW), • Grand Valley Fire Protection District, Town of Parachute. Hoover Express Compressor Station SUP — BOCC— 4/13/2009- Page 1 13 VII. RECOMMENDED FINDINGS 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07, 5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978, as amended. VIII. STAFF RECOMMENDATION Due to the following conditions: • the limited nature of potential impacts to surrounding properties, • the remote location of the property, • the proposed is required to operated within compliance for noise and mitigate glare and other emanations, Staff recommends the Board approve the request for a Special Use Permit for the Hoover Express Natural Gas Compressor Station and related pipeline with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board. 2. That the operation of the facility be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. That the Applicant shall comply with the fire protection provisions included in the rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC) and the International Fire Code as the Code pertains to the operation of this facility. 4. Vibration generated: the Compressor shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. Emissions of smoke and particulate matter: the Compressor shall be so operated so as to comply with all Federal, State and County air quality laws, regulations and Hoover Express Compressor .Station SUP — BOCC — 4/13/2009- Page 1 14 standards. 6. Emission of heat, glare, radiation and fumes: the Compressor shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. 7. Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes, COGCC Series 800 and noise attenuation measures shall ensure that the recommendations of the wildlife study and sound study are met. 8. No storage of heavy equipment or materials is proposed or permitted. 9. No human occupation of this site is allowed at any time. 10. A qualified wildlife biologist shall provide an assessment to determine that no active raptor nests are in use as nest sites within the stipulated distances from the construction of the compressor site and pipeline. Should an active nest be found within that distance determined to be a disturbance for a sensitive species, construction activity shall not take place during that time period defined in Table A of the Wildlife Study, page 15. 11. Any lighting shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. 12. Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. 13. The general Storm Water Management Plan and Spill Containment & Counter Measure Plans for this site shall be appended with site-specific plans. This plan shall include adequate design for the spill containment basin for the produced water tanks on site. 14. Two (2) compressor units shall be installed on the site under this Special Use Permit. Proper building and grading permits are to be obtained prior to the issuance of a Special Use Permit. 15. Three (3) additional compressor units may be installed at a future date. Proper building permits to be secured prior to the installation of the compressor units and the enclosure that will provide noise attenuation for all five (5) compressors on this site. 16. An estimate for site reclamation of the compressor site shall be provided the Garfield County Planning Department Project Engineer to determine the required security Hoover Express Compressor Station SUP — BOCC— 4/13/2009- Page 1 15 amount, and that security must be in place prior to the issuance of the Special Use Permit. 17. A reclamation security of $4000 per acre shall be submitted for the 4.9 -acre site disturbance, as per the Garfield County Vegetation Manager. If the use as a compressor plant is ended, reclamation shall be initiated within 60 days and meet the requirements set forth in the reclamation plan in place on the date the Special Use Permit issued, or the site reclamation standards in place at the time of use cessation, whichever is more stringent. The reclamation standards at the date of permit issuance are cited in Section 4.06, 4.07 and 4.08 of the Garfield County Weed Management Plan (Resolution #2002-94). 18. Securities for revegetation as per the Garfield County Vegetation Management Director shall be required to be in place prior to the issuance of this permit. 19. Recommendations for vegetation management from the Garfield County Vegetation Management Department for pre-treatment of tamarisk shall serve as a requirement, and documentation shall be provided the Garfield County Vegetation Management Department prior to construction. 20. Dust mitigation on the sites and access roads must be performed to prevent fugitive dust. IX. My comments are as follows: Integrated Vegetation and Weed Management • The weed inventory and weed management plan is acceptable. It is recommended that the applicant cut and treat the inventoried tamarisk prior to the construction of the pipeline. • During construction, before leaving the site, all off road major construction equipment (graders, dozers, etc) working in areas of diffuse knapweed should be power washed to remove seeds, soil, and vegetative matter. • The submitted vegetation and weed management plan is acceptable. Reclamation Two securities are requested. These securities should be done separately since the time frame for security release is in the short term for the pipeline. Compressor Station • The applicant has quantified the surface area to be disturbed. A revegetation security of $20,000 for the compressor station is requested. (5 acres x $4000/acre-$4000/acre is the long-term revegetaion per acre security rate). Pipeline • The surface area disturbed by the pipeline will be about 12 acres. A revegetation security of $30,000 (12 acres x $2500/acre) is requested. • The applicant shall provide the Vegetation Management Department with the original tags from each seed bag. • The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the responsibility of the applicant to contact the County, upon successful revegetation establishment, to request an inspection for security release consideration. Erosion control • Any straw or hay bales used in erosion control shall be certified weed free.
