DESCRIPTION OF THE PROPOSAL Project Location: Williams Production RMT Co. Parachute Creek Gas Plant Expansion located at 4289 County Road #215 Paralute, Colorado. Site Description: As seen in ike picture in View 1, the use is on valley bottom land on a site that is less than 10 acres and -i avered in na � +ad'seed grasses. The proposed use is labeled in the picture as the larger industrial use area on the right side (north) of t. picture next to the existing American Soda Plant CO2 production facility. Project Description: The proposed Parachute Creek Gas Plant expansion is a 9.59 acre expansion to the ex%I g plant on 20+1- which was permitted in 2002 by Garfield County Resolution 2002-67 d ted June 17, 2002. The plant is located within a 1,333 -acre parcel owned by Williams P duction RMT Co. The existing plant and the proposed expansion are well placed within this property to reduce impacts on adjacent properties. Please see Figure 1. This work may include loopinof the current 16" gathering line and a possible interconnection of the Parachute Creek Gas Plant and the Grand Valley Plant utilizinig an existing 8" line. There are 5 new buildings proposed for the plant expansion and are sized for maximum sizing and may be constructed in smaller dimensions. These are: a. Office/Control Building - 75' wide x 75' long x 15' eave height. b. The plant operates 24 hours a day, 7 days a week and 365 days per year. The current plant employs 12 full time employees and 12 tanker trucks serve the plant every 24 hours. The plant expansion is expected to add 5 full-time employees to the plant and will add 6 tanker trucks loading at the plant each day. This electrical upgrade has been sized to serve the plant expansion as well. Construction Schedule: r Overlot grading of the site occurred in July 2004. Steel pinstallation is anticipated to occur in August/September 2004. 4 Equipment foundations are to be poured in October/November 2004. There were a number of signage and striping issues that Garfield County requested in addition to a traffic analysis. 6. Garfield County Oil and Gas Auditor (Doug Dennison) (Exhibit I) Issue(s): none A meeting was held on August 26, 2004 with Doug Dennison and the Applicant at his office. The draft application and draft site plan was reviewed with Mr. Dennison. 8. Garfield County Contract Engineer (Michael Erion) (Exhibit J) Issue(s): access, water, sewer and industrial operation requirements Note: Michael Erion P.E., the Garfield County Contract Engineer has reviewed the proposed use and fords that the application appears to meet technical requirements of Section 5.03, all specific items in 5.03.07 and the standards in 5.03.08 of the Garfield County Zoning Regulation of 1978 as Amended. (2;treet improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed ,fr use. f Staff' Comment: The Applicant met Kraig Kuberry and Marvin Stephens on August 3, 2004 at the intersection of County Road #215 and Man Camp Road. Their comments are reflected on a map dated 8/25/04 by Construction Surveys found in the Application which details the improvements to be made at the intersection. All of the improvements shown on the plan regarding signage such as 6 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC 12/6/04 rly installation of 2 new "Do Not Enter Signs", installation of the delineator post and installation of 2 plant directional signs will occur upon approval of the special use permit. There is an existing Garfield County Access permit for the intersection. Improvements regarding ,triping of the acceleration and deceleration lanes at the southwest side of County Road #215 will occur as the weather permits in Spring 2005. All of the costs of the improvements as shown on the plan will be paid for by Williams Production RMT Co. Please fmd attached a traffic analysis prepared by Holt, Felsberg and Ullevig. Traffic counts were taken visually on-site over 2- 24 hour periods. The traffic analysis considers the existing and proposed level of service at the Mancamp Road/County Road #215 intersection is a Level of Service A. Staff notes that above information illustrates that the existing intersection with some striping and signage improvements provides the safety necessary to serve the plant expansion and other traffic on County Road #215. C. (3) Design of the proposed use is organized to minimize impact on and from; adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. taff Comment: The Applicant proposes to use paint colors for the proposed use as per COGCC Rule #804. Visual Impact Mitigation which states "Production Facilities constructed or substantially repainted after May 30, 1992 which are observable from any public highway shall be painted with uniform, non -contrasting, non -reflective color tones, (similar to Munsell Soil Color Coding System) and with colors matched to but slightly darker than the surrounding landscape." The existing plant has utilized the Munsell Soil Color "Desert Brown" and the plant expansion will match the existing plant color of Desert Brown. The application also addresses flares of which there is one (1) on-site with one (1) additional flare to be added to the site; both shown on the sit plan. The plant flares are smokeless and will produce a glare when the plant is flaring. Oaring does not occur very often. This is a, safety feature of the plant that cannot be hidden or obscured. Industrial Operations: All industrial operations must meet the standards set forth in Section 5.03.07 and 5.03.08. Section5.03.07 states the following: (1) The applicant for a permit for industrial operations shall prepare and 7 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC 12/6/04 • CO submit to the Planning Director ten (10) copies of an impact statement on the proposed use describing its location, scope, design and construction schedule, including an explanation of its operational characteristics. One (1) copy of the impact statement shall be filed with the County Commissioners by the Planning Director. The impact statement shall address: Existing lawful use of water through depletion or pollution of surface run-off stream flow or ground water; Staff Comment: The information illustrated in the application indicates that Williams Production RMT Co, has prepared mitigation plans for stormwater management and spill prevention controls and countermeasures that meet the requirements set forth by Garfield County, the State of Colorado and the USEPA. They are: 1 Construction Stormwater Management Plan prepared by Cordilleran Compliance Services, Inc. dated 7/7/04. 2) Spill Prevention Control and Countermeasure Plan prepared by Cordilleran Compliance Services, Inc. Additionally, the applicant was required to submit a Watershed Permit Application to the Town of Parachute and obtain an approval; the approved permit was to then be submitted to the Garfield County Building and Planning Department prior to issuance of the Special Use Permit. The Applicant has satisfactorily met the requirements of the Town of Parachute and received a Watershed Permit on December 9, 2004 and received by the Building ing Department. e impact statement shall a ire ,acts qqn adjacent land from the generation of vapor, dust, smok-, noise, Ow or vibration, or other emanations, Staff Comment: Comment: Please see the impact analysis as stated in each section below. 1. for -.Please see attached copy of Air Pollution Control Division Construction Permit in the Application. 2. iktst — The Applicant has provided adequate information in a statement in the application regarding dust control policy at the Parachute Creek Gas Plant. 3. Smoke - See copy of Air Pollution Control Division Construction Permit attached in 11.1.B.1. in the Application. 4. Noise - The Applicant has indicated that the Parachute Creek Gas 8 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC 12/6/04 /ant will ve the following equipment installed that will produce noise: A. 3- Model 3612 Residue Gas Compressors, with 2- Model 3612 Residue Gas Compressors added in the future as -needed. B. 2 - Model 3512 Propane Refrigeration Engines C. 4 - Model 3516 Ernergency Generators Each of these engines and generators will have residential quality exhaust silencers installed. Additionally, a pre-engineered steel building will enclose the emergency engines and generators. The silencers are a Best Management Practice and will help ensure that the compressors meet regulations set forth by the State of Colorado for noise at property boundaries. As per rule 802 - Noise Abatement, of the Colorado Oil and Gas Conservation Commission, noise emissions from this plant to adjacent industrial uses are 80 db(A) from 7:00 a.m. to 7:00 p.m. and 75 db(A) from 7:00 p.m. to 7:00 a.m. Industrial uses are the predominant uses in the area. The nearest residential units are located as follows: 1. A residence located on the east side of County Road #215, 3,770 ft. (.71 mile) south of the Parachute Creek Gas Plant entrance on County Road #215. 2. A residence 15,130 lineal feet (2.87 miles) to the south from the plant expansion boundary. COGCC Rule 802 (1) gives guidance regarding taking sound measurements. "If there are no occupied building units impacted, sound levels shall be measured at a distance of twenty-five (25) feet or more from the property line radiating the noise. Sound levels at occupied building units shall be measured as near as practicable to the exterior edge of the occupied building unit closest to the area radiating the noise." The Applicant has indicated that they will hire an acoustical engineer to take sound read'ngs after start-up of the plant. These sound readings will be pr duced in a report form and will be submitted to Garfield County for their information. As per Colorado State Statute, Williams Productio RMT Co. will be responsible for meeting these noise abatement req ements. 5. Glare - Please see discussion in V(B)(3) of this report that 9 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC i 2/6/04 adequately discusses mitigation of this impact 6. Vibration — the Applicant identifies in the application that vibrations produced by rotating equipment such as the residue gas compressors will be minimized through concrete foundation design and geotechnical reports. The Hanover Company will be supplying and installing the compressor and will be designing the concrete foundations and has experience in design of thousands of compressors and compressor foundations worldwide. Minimization of vibration is also important to prolong equipment life and is a goal of foundation design. All six (6) sections of impact mitigation in the above information illustrates that Williams Production RMT Co. has shown how proposed vapor, dust, smoke, noise, glare and vibration controls meets the requirements set forth by Garfield County, the State of Colorado and the USEPA. ,. . ' • . ,. •. -animals through the creation of azardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions; 1, Staff Comment: the Applicant met with the Colorado Division of Wildlife for an on-site meeting on August 30, 2004 with J.T. Romatzke regarding the project. In general, Mr. Romatzke agreed 1Y" with the 8' tall chain link fence installation at the perimeter of the plant site and will tie directly into the existing chainlike fence that surrounds the existing plant. fU The Applicant has included a letter in the Application materials (2002) from Perry Will with the Colorado Division of Wildlife. Item #4 in the letter deals specifically with the Parachute Creek Gas Plant 2002 Special Use Permit Application and notes "The biggest wildlife impact is the loss of the acreage at the plant site (1Oac). The area was an alfalfa field and heavily utilized by deer for transition and winter forage. The Division of Wildlife supports fencing the entire site for protection of the site and to keep wildlife from entering." Additionally, please note the attached article regarding Williams Production RMT Co., Principal Environmental Specialist, and Dave Cesark's efforts in cooperation with the Colorado Division of Wildlife. The Applicant and CDOW have worked together to produce a Wildlife Enhancement Plan on neighboring Williams Production RMT Co. property that will aid in protection of riparian areas, reduce overgrazing, removing noxious weeds and will improve habitat for mule deer, native wild turkey and rainbow and brown trout. 10 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC 12/6/04 The Applicant has submitted detailed and thoughtful information to illustrate that Williams Production RMT Co. can successfully follow the recommendations set forth by the Colorado Division of Wildlife. s { Affirmatively show the impacts of truck and automobile traffic to and from such uses and their impacts to areas in the County; Staff Comment: The information submitted in the application illustrates that Williams Production RMT Co. has shown that the existing and proposed level of service at the Mancamp Road/Garfield County Road #215 intersection is a Level of Service A. The two items below attempt to provide quantifiable impacts and alternately propose mitigation of the increase to traffic on existing roads. 0-1 ' 1. Traffic Analysis Prepared by Holt, Felsberg and Ullivig. 2. Letter and attached plan noting Improvements Plan for the Mancamp Road/Garfield County Road #215 intersection. Please see submittal #5 "Garfield County Road & Bridge Department Access Issues". (E)That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s); Staff Comment: As noted in the Application, the Parachute Creek Gas Plant Expansion is abutted to the North by Puckett, to the East by Exxon Mobil to the Southeast by Tom Brown, Inc. and American Soda and the Southwest by BLM and Puckett. All of the nearest adjacent uses are industrial. The distance to the nearest BLM corner from the existing Parachute Creek Gas Plant boundary is approximately 3,000 lineal feet (.57 miles). The Parachute Creek Gas Plant Expansion is within a 1,333 acre parcel owned by Williams Production RMT Co. that aids in buffering the plant. The existing industrial uses adjacent also help to buffer this use. (Plgtigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section S. 03.08 of this Resolution Staff Comment: The Applicant has indicated that no other mitigation is proposed and no other impacts are expected to result from the proposed use. (2) Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan_ for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use 11 Williams Production RMT Parachute Creels Gas Plant Expansion BOCC 12/6/04 will be issued; Staff Comment: A Site Rehabilitation Plan as submitted in the application has been utilized for the existing Parachute Creek Gas Plant SUP and has been revised with items that have been added below as per comments from Steve Anthony of the Vegetation Management Department of Garfield County An inventory of noxious weeds was completed for the riparian area consisting o approximately 100 acres within the 1,333 -acre parcel owned by Williams Production RMT Co. This was completed as part of the Parachute Creek Wildlife Enhancement Project. 2.3 acres of tamarisk was identified and was eradicated in Spring 2004. Additionally, hounds tongue and various thistles were identified and eradicated. Steve Anthony has identified that a revegetation bond will be required by Garfieldounty for the new and existing plant site totaling approximately =es of surface disturbance. He additionally recommends that a revegetation security in the amount o $20,000 I ($1,0001acre)1 e secured by the County prior to issuance of the SUP Note: The majority of the mitigation strategies in-place in the existing Parachute Creek Gas Plant and will be extended to the expansion. Listed in detail below are features of this plan: Reclamation: Two phases of reclamation are planned. Soil stockpiles and areas disturbed by construction that will not be utilized during plant expansion operation will be reclaimed immediately following plant expansion construction. Final reclamation will be performed within one year of plant expansion closure and removal. The objectives of reclamation will be as follows: 1. Stabilization of the disturbed areas will be conducted by providing wind and water erosion control to reduce soil loss. 2. Utilize the prescribed seed mixtures and additional vegetation practices as described below to establish a self-sustaining vegetative rangeland cover for cattle pasture use. Facility and structure removal: The plant expansion will be abandoned in accordance with Colorado oil and gas conservation commission regulations in place at the time of facility abandonment. Equipment will be removed from the site. 12 Williams Production RMT Parachute Creek Gas Plant Expansion BOCC 12/6/04 Backfilling, grading, and re -contouring: Reclaimed areas will be sloped to 3:1 or less. Topsoil Replacement: Soil salvaged during plant expansion construction activities will be redistributed over the soil surface after subsoil has been replaced and additional backfilling; grading, and re- contouring steps have been completed as described below. Soil will be replaced by using front-end loaders, track -hoes, and dozers. Soil will not be replaced when it is excessively wet and frozen so as to jeopardize soil structure. Seedbed Preparation/Soil Tillage: Seedbed preparation and soil tillage will be completed after the application of subsoil, topsoil, and any soil amendments. Soil tillage will be to a minimum depth of 4" utilizing a disk, chisel plow, or harrow. Seedbed preparation will also include removal of coarse fragments (rock material) that exceed 35% to 40% of the soil surface as well as rocks 8" in diameter that occupy more than 10% of the soil surface. Seeding Methods and Times: Soil stockpiles and areas disturbed by construction that will not be utilized during plant expansion operation will be seeded. If seeding is performed in the spring, it will be accomplished by may 15; if fall seeding is performed it will be completed after august 30 and before the soil freezes. Seeding efforts will consist of drill seeding with a rangeland drill to a planting depth of '/d" to 1/2 on slopes 3:1 or flatter. Broadcast seeding followed by harrowing or hand raking to lightly cover the seed with soil will be used on slopes steeper than 3:1, or on areas inaccessible for drill seeding equipment. All areas to be reclaimed will be mulched no later than 24 hours after seeding with a certified weed -free straw or grass hay material. Grass hay mulch will be applied at 1 1/2 tons per acre, or straw mulch will be applied at 2 tons per acre. Mulch material will be crimped into the soil surface with a commercial mulch crimper, a straight disc, or bulldozer tracks if too steep to otherwise crimp mulch in place. Weed Control Plan: A qualified person will inspect the plant expansion area and will inventory and map the proposed project area for any listed Garfield county noxious weeds. Based on this inventory and mapping, methods, materials, and timing of weed control measures will be specified. The vast majority of the plant expansion area will be graveled and will be devoid of vegetation. Such commitments, bonds or check shall be payable to and held by the County Commissioners; Staff Comment: The Applicant will present information at the Public Hearing regarding existing infrastructure from past industrial Special Use Permits which may be in place at this time on the proposed SUP site. The BOCC may examine this information and determine if a reclamation security is appropriate to execute the site rehabilitation plan as submitted by the Applicant. (C)Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. (A. 93-061) ection 5.03.08 states the following: Industrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards; (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision; Staff Comment: See discussion in (V)(B)(3) of this report that adequately discusses mitigation of this impact )Storage of flammable or explosive solids or gasses shall be in accordance with accepted standards and laws and shall comply with the national, state, and local fire codes and written comments/recommendations from the appropriate local protection district regarding compliance with the appropriate codes. Staff Comment: The Applicant cites that on August 4, August 24 and August 30, 2004 meetings were held with the Applicant and David Blair of the Grand Valley Fire Protection District (GVFPD) at Parachute Creek Gas Plant Site. The items noted below were discussed during these meetings regarding fire protection issues at the Parachute Creek Gas Plant, are provided in the application and shall be included as conditions of approval. (5) 1. Plant Safety Systems and Plant Design Plant spacing is designed as to minimize impact of fire and allow obstructed access for outside fire fighting equipment (i.e. trucks). L storage tanks are set back from county road 215 as per NFPA acing requirements. Plant safety systems include gas and fire detection, which either shuts down or isolates specific equipment and/or plant when activated. Emergency flare system is designed per API 520, 521, to insure adequate emergency flaring. The new Control Room monitors the plant 24 hours per day, 7 days per week. This Control Room is set back from the process as per NFPA spacing requirements. Fire extinguishers are located throughout the plant, so plant personnel can fight incipient stage fires. • 2. Loading Rack and Truck Drivers Truck drivers are given a safety briefing / safety orientation when they arrive to haul there first load from our plant. Truck drivers must check-in at the office by signing in, at which time they are given a loading ticket. They then travel to the loading rack and hook-up. Once they have achieved a proper ground, the control room receives a signal and allows loading to begin. Safety equipment at the loading rack includes breakaway valves which shutdown the flow of liquid in the event of a line problem. Also, an Emergency Shut Down (ESD) button is located near the rack, which shuts down the loading process in the event of an emergency when manually activated. 3. Fire Training Fire extinguisher training is provided to Williams employees on a annual basis. 4. Emergency Response Plan The current emergency response plan (ERP) will be updated to include the plant expansion and will be reviewed with the GVFPD. A copy is also available via the Local Emergency Planning Committee (LEPC). Perimeter access for GVFPD will be provided and clearance under piperacks at certain locations for vehicle crossings will be provided. A gate in the southern plant chainlink fence will be provided for emergency access to the new flare. 5. General Staff Comments: (1) Staff finds that the proposed use has been thoroughly planned and well presented; the Applicant has made a deliberate effort to mitigate and anticipate all impacts produced. Additionally, the proposed use will provide the benefit of allowing production levels to increase as the market demands increase. IV. RECOMMENDED FINDINGS 1. That pryer publication, public notice, and posting was provided as required by law for t'he--hearings before the P annin om ission and before the Board of County Commissioners. 2. That the hearings ' before the Planning Commission and the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. That the application is compliance with the standards set forth in Section 4:00 of the Garfield Countyoiiingifesolution of 1978, as amended. 4. That for the above stated and other reasons, the proposed subdivision is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County; V. STAFF RECOMMENDATION At this time, Staff` submits this application with the recommendation from the Planning Commission that the Board of County Commissioners APPROVE the Special Use Permit for the Williams Production RMT Co. Revegetation bond is be required by Garfield County for the new and existing plant site totaling approximately 20 acres of surface disturbance and a security in the amount of $20,000 ($1,000/acre) shall be secured by Garfield County prior to issuance of the SUP. The security shall be held by the County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. The Grand Valley Fire Protection District (GVFPD) shall review the proposed use and respond in writing to the Garfield County Building and Planning Department noting that all concerns of the District have been met. (RESOURCE) has reviewed the special use permit application from Williams Production RMT for the proposed upgrade and expansion to the Parachute Gas Plant facility located north of Parachute. The submittal includes a notebook entitled, Parachute Creek Gas Plant Expansion, Garfield County Special Use Permit Application. Our comments are outlined below. SUMMARY The proposed special use permit application appears to meet the technical criteria for the special use requirements in Section 5.03, the specific requirements in Section 5.03.07, and the standards in Section 5.03.08 of the Garfield County Zoning regulations. The requirements of each section are more specifically discussed below. SPECIAL USE GENERAL REQUIREMENTS The general requirements for any special use include providing adequate water and wastewater service and adequate road improvements and/or access for the proposed use. The existing and proposed special use will utilize an existing potable water system and an existing ISDS. The existing water and wastewater systems are adequate for the proposed special use. The existing facility is accessed from County Road 215. The application indicates that the characteristics of the traffic to and from the site will operate at a level of service A. The applicant has worked with the road and Bridge Department to develop a plan for acceleration/deceleration lanes and signage to address safety issues at the access intersection. This plan should be specifically identified in any approval of the Special Use Permit. INDUSTRIAL OPERATIONS REQUIREMENTS Section 5.03.07 of the County Zoning Regulations outlines additional specific criteria for industrial operations. These criteria require that the applicant prepare and submit an impact statement of the proposed use. The Applicant's impact statement affirmatively addresses the items outlined in Section 5.03.07. These issues include storm water management, spill prevention control, water supply, dust, smoke, vapor, noise, glare, vibration, wildlife, and traffic. Mitigation measures where appropriate are included in the analysis. The mitigation measures should be included in any approval of the project. BATTLEMENT PARKWAY PO BOX 295 PARACHUTE, CO 81635 (970) 285-9119, FAX (970) 285-9748 December 2, 2004 Garfield County Building & Planning 109 8th Street, Suite 303 Glenwood Springs, CO 81601 Subject: Williams Production RMT Company Special Use Permit for the Parachute Creek Gas Plant Expansion Jim Hardcastle: After our initial response to the Williams Production RMT Company Special Use Permit for the Parachute Creek Gas Plant Expansion a meeting was set up between Williams Production RMT, Phil Vaughan Construction and myself, on August 30, 2004. We went over the plans in detail and what infrastructure was left from the original Daniel's man- camp days. After examining all options, it was determined that the purchase of extra 150# roll around fire extinguishers would be the best option for fire protection of this facility. Additional smaller fire extinguishers will be placed in some of the buildings. The Daniel's man -camp system has been cannibalized to the point of being un -feasible to try and revitalize. The pump house has been gutted of all pumps, controls and piping. The tank on the hill may need major work to place it back into service. Williams Production RMT is aware, in the event of an emergency, water will have to be transported into the side, and that they will most likely have to assist, such as during the gas well incident. As far as the Emergency Response Plan, Williams Production RMT has a current plan for the initial plant and will be modifying it to include the addition. Williams Production RMT has also agreed to set up a site tour for all emergency response personnel after construct. As a result of this meeting, the Grand Valley Fire Protection District has no further concerns with project.
