Mr. Hardcastle: On this date, November 1, 2004, I met with Mr. Ed Cooley of American Soda L.L.P. and toured the new carbon dioxide gas plant. We reviewed the intended operation and use of the equipment to be placed inside this building and determined that portable fire extinguishers. mounted in the building, will be adequate for this facilities fire protection plan. We also discussed the access / egress road to the facility and Mr, Cooley has stated that when completed, the road will be as proposed on the drawings (although not specifically marked), a 25' wide, all-weather road, which will meet the requirements of the existing 1997 UFC. I have stated to Mr. Cooley that the current drawings adequately locate the road and I will red line my copy to show such. After meeting with Mr. Cooley, the Grand Valley Fire Protection District has no further concerns or needs any additional clarifications regarding this project. The Permitee has executed the Bank's assignment of certificate of deposit form providing that only the BOCC shall have access to the funds until the BOCC releases the funds back to the Permitee or the CD(s)/ account(s) is (are) forfeited to the BOCC under terms of this Agreement. A copy of such assignment document is attached to and incorporated herein by this reference as "Exhibit A". 4. Receipt(s) for the identified CD(s)/account(s) has/have been delivered to the BOCC at the Office of the Garfield County Treasurer or the Building and Planning Department, to be held by theTreasurer on behalf of the BOCC as proof of the Permitee's financial responsibility under terms of the SUP and this Agreement. 5. Permitee has provided the BOCC with the Bank' s signature sheet/card and the BOCC Chairmanhas completed the card for return to the Bank. A copy of the executed 2 signature card/sheet is attached to and incorporated herein by this reference as "Exhibit B". 6. The BOCC may deliver a letter, signed by the BOCC Chairman, regarding Permitee's default under the SUP to the Bank and present for payment any certificate of deposit receipt/account held hereunder and convert the same to cash if the BOCC determines that the site reclamation and/or soil management and re -vegetation and/or improvement, identified in Paragraph 2, above, which was to have been performed by the Permitee remains wholly or partially unperformed. No other condition precedent need by fulfilled to entitle the BOCC to receive the amount of the certificate(s) of deposit/account(s). 7. Upon completion of site reclamation and/or soil management and re -vegetation and/or improvements by the BOCC, if the cost of such work is less than the amount received from the Bank, the excess funds shall be refunded to the Permitee by the BOCC. 8. The BOCC is hereby granted a right of entry by the Permitee on the land covered by the SUP to execute the work contemplated as the responsibility of Permitee in the SUP Resolution. 9. Permitee's obligations shall continue until the BOCC releases the Permitee from the provisions of this Agreement or orders the certificate(s) of deposit/account(s) forfeited to the BOCC in accordance with this Agreement by conversion of the CD(s) to cash/draft on the account(s). Release shall be accomplished by the BOCC's delivery of a written release, signed by the BOCC Chairman, to the'Permitee and a copy to the Bank. 10. It is recognized that a period of months or years may be required before determination can be made that site reclamation, soil management and re -vegetation, or completion of the improvements specified in Paragraph 2, above, has (have) been satisfactorily completed. Therefore, this Agreement shall enure to and be binding upon the successors and assigns of Permitee, Bank, and the BOCC. 11. Permitee and Bank warrant that: a. The CD(s)/account(s) were set up as Public Funds Account (s) under Section 11-10.5-101, et seq., C.R. S., as amended, the Colorado Public Deposit Protection Act, [and the CD(s) are denominated as such]. b. The CD(s)/ account(s) were issued on an automatically renewable term [and such term shall be stated on the face of the document]. c. Permitee signed the tax payer identification area on the Bank's signature sheet /card; therefore interest on the referenced CD(s)/account(s) will not 3 accrue against the principal but will be paid out to the Permitee by the Bank in the regular course of business. d. The only approved endorsement signature on the CD(s)/account(s) is that of the Chairman of the BOCC or his/her authorized representative. e. The Bank has placed a lock or hold on the CD(s)/ account(s) until such time as the funds are released by the BOCC or the CD(s)/account(s) is (are) forfeited to the BOCC under terms of this Agreement. 12. Permitee shall notify the BOCC immediately of any event which may impair the security identified above. 13. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which, when taken together, shall be deemed one -in -the -same instrument. Facsimile signatures on behalf of any party to this Agreement shall be effective for all purposes as an original. 14. This Agreement shall be governed by the laws of the State of Colorado and venue for any action dealing with this Agreement shall be in the District Court of Garfield County, Colorado. 15. Mr. Hardcastle: I have reviewed the material sent to this office and offer the following comments. • The Grand Valley Fire Protection District has no particular concerns with this project, its location or its intended use. • The application does not address fire protection for the facility. It is assumed that the applicant will have portable fire extinguishers located at the facility. These should prove adequate. The applicant has stated that they will be storing "lubricating oils and other regulated materials" in a manner consistent with the National Fire Code. This is acceptable to the District. • The applicant has not addressed access / egress into the property. The applicant has shown on two of the maps provided, what appears to be an access / egress road, but it is not identified as such. On the map provided in section "1", there is a set of parallel lines drawn with a dimension of 30'-0" shown. On the map provided in section "3", there is three dashed lines running parallel to the proposed gas line route. There are existing dashed lines indicating other un -improved roads in the area. It assumed that this is to access / egress into the site. On page 2 of the actual application for special use permit, the applicant has stated, "Access to project facilities within the Site is provided by existing paved and gravel roads." The only requirement of the District is that when completed, the access / egress road meet the requirements of the of Section 902 — Fire Department Access of the 1997 Uniform Fire Code, and includes enough room to turn equipment around. Condition #16 asks for a Weed Management Plan. Mr. Cooley has provided that and it is acceptable. Condition #20 asks for a Revegetation Plan. That has also been sent to me and is acceptable. Mr. Cooley has stated that the surface area to be disturbed is 2.75 acres. Based on that calculation I am requesting American Soda provide a revegetation security in the amount of $2750 (2.75 acres x $1000/acre). My comments are as follows: 1. Noxious Weeds A. Weed Management -The applicant shall provide a weed management plan with a written commitment to inspect, monitor, and be responsible for the management of any of Garfield County's Noxious Weeds that may emerge on private lands that are disturbed by the pipeline. This shall be in effect for the life of the pipeline. It is requested that the applicant respond to any complaints regarding pipeline noxious weeds in a timely manner. 2. Revegetation A. Revegetation Plan -The applicant needs to submit a revegetation plan that includes a plant material list. B. Revegetation Security -It is the recommendation of this department that the applicant post a revegetation security for the parts of the pipeline that is on private property. Please quantify the surface area disturbed on private land so that we may determine a security amount. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. The ground and slopes will be graded back to a stable contour, allowing for proper drainage and re -vegetated in accordance with the re -vegetation plan which is incorporated as part of this Rehabilitation Plan. Soil preparation prior to fertilizing and seeding shall be by tilling to loosen soil to a minimum depth of six (6) inches. This should be accomplished when backfilling is completed and access is in place to the sites. Fertilizer shall be applied prior to soil preparation if the tillage follows soon after backfilling. The seed planting will be conducted using a drill seeder so that seed is incorporated into the soil at a depth of Y4 to 1/2 inch and some scattered on surface. Hay mulch where required will be weed free grass hay applied uniformly at a rate of 1 1/2 tons per acre and crimped or mechanically anchored into the soil. I will also be sending a copy of the letter noticing Williams Energy of the approval of their application as well.
