HomeMy WebLinkAbout6.0 Resolution 2004-1231111111 11111 111111 111 111111111111 HEM BEIER 664628 12/08/2004 10 33A 01645 P297 M ALSDORF 1 of 5 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, November 1", A.D. 2004, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2004-123 A RESOLUTION CONCERNED WITH THE APPROVAL OF THE USE OF INDUSTRIAL SUPPORT FACILITIES TO ALLOW PROCESSING FACILITIES AND A PIPELINE AND A CORRECTION TO FIVE (5) SCRIVENER'S ERRORS IN RESOLUTION 2004 -116 WHEREAS, the Board has received an Application from Williams Production RMT Co. for a SUP to allow Industrial Support Facilities with Processing Facilities and a Pipeline in the R/L (Resource Lands zone district; and WHEREAS, the uses listed above are allowed at 4289 County Road 215, 4 miles north of Parachute, also in Section 4, Township 7 South and in Sections 27, 28, 29, 32, 33 and 34 Township 6 South all in Range 96 west of the 6th Principle Meridian, Garfield County, Colorado; and WHEREAS, the previous resolution (2004-116, signed 11/15/04 and recorded 11/18/04) contained five (5) errors inconsistent with the official minutes of the public hearing with the Board of County Commissioners of Garfield County, Colorado ("Board"), for the proposed Special Use Permit ("SUP") and this Resolution shall replace in full, the previous resolution listed above; and WHEREAS, the changes as listed below shall replace but not alter the substance of the remaining conditions or the intent of the original use as approved and this new resolution has been created to reiterate and clarify the extent of the original approval; and WHEREAS, the conditions of approval required by the Board and memorialized in Resolution 2004-116 shall be appropriately altered and replaced with the changes contemplated in this resolution; and the conditions as listed later in this correction resolution replace the conditions 1 111111 11111 1111111111 11111 1111111 11111 111 11111 1111 1111 664628 12/08/2004 10:33A 61645 P298 M ALSDORF 2 of 5 R 0.00 D 0.00 GARFIELD COUNTY CO in resolution 2004-116 by removing and fully discarding four (4) conditions previously numbered 8, 10, 13, 18 and replacing a fifth condition, #15 which is now replaced by the new condition #12), WHEREAS, the Board held a public hearing on the 1st day of November, 2004, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said SUP; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. The Hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of a Special Use (Sections 5:03, 5:03:07, 5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit is hereby approved subject to compliance with all of the following specific conditions: 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. The Applicant shall comply with all State and Federal regulations and standards, such as Noise Abatement, Water and Air Quality. 4. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation shall comply with applicable Federal, State, and County laws, regulations and standards. 5. Any changes to the Special Use Permit for all uses as listed in the application as amended and the exhibits as attached shall require a new Special Use Permit. 7. The applicant shall submit a Watershed Permit to the Town of Parachute and obtain an approval, which shall be submitted to the Garfield County Building and Planning Department, prior to issuance of the Special Use Permit. 8. The Applicant shall prepare and submit a Fire Protection Plan for the proposed facility and submit said plan to the Grand Valley Fire Protection District for approval which shall also be submitted to the Garfield County Building and Planning Department prior to issuance of the Special Use Permit. The Applicant shall also submit information indicating whether all access points meet the standards of Section 902 - Fire Department Access of the 1997 Uniform Fire Code for the proposed facility and submit said information to the Grand Valley Fire Protection District for approval and to the Garfield County Building and Planning Department prior to issuance of the Special Use Permit. 9. The Applicant shall paint the deceleration (D -cell) and acceleration (X -cell) lanes on County Road 215 and shall notify the Garfield County Road and Bridge Department for inspection when said painting is complete prior to issuance of the Special Use Permit. 10. The Applicant shall provide -a plan for berming or containing and ultimately diverting storm wash from the Williams gas plant away from the proposed use. This shall be submitted, reviewed and approved by the Garfield County Building and Planning Department and their Contract Engineer, Michael Erion, P.E. prior to issuance of the Special Use Permit. 11. The Applicant shall maintain and observe that all bi-products produced, waste streams consisting of spent desiccant, used oil, used lubricants, spent carbon and waste water as well as potentially, other waste materials yet to be determined, but not exclusively limited to those listed or within the application, shall be properly removed from the site and stored, recycled or disposed of in a manner that is a best management practice and considered an industry standard. 12. The Applicant shall adhere to all recommendations and requirements produced in the Storm Water Management Plan which includes a Spill Prevention Maintenance Plan. 13. The Applicant shall provide a weed management plan with a written commitment to inspect, monitor and be responsible for the management of any of "Garfield County's Noxious Weeds" that may emerge on private lands that are disturbed by the pipeline which shall be in effect for the life of the pipeline. Said plan shall be submitted to the Garfield County Vegetation Management Department for approval and the Garfield County Building and Planning Department prior to issuance of the Special Use Permit. 14. The Applicant shall submit information regarding plans for site rehabilitation upon abandonment of the proposed use to the Garfield County Building and Planning Department prior to issuance of the Special Use Permit. 16. The Applicant shall submit a revegetation plan that includes a plant material list as per the requirements of the Garfield County Vegetation Management Department for approval prior to issuance of the Special Use Permit. 17. The Applicant shall quantify the surface area disturbed by the pipeline so that the Garfield County Vegetation Management Department can determine a security amount for revegetation and the Applicant shall post said revegetation security amount with the County for the pipeline prior to issuance of the Special Use Permit.
