D. 19 , there were present: Larry Velasquez Commissioner Chairman Flaven J. Cerise , Commissioner Eugene "Jim" Drinkhouse , commissioner Earl Rhodes , County Attorney Mildred Alsdorf , Clerk of the Board meeting of the Board of County Commissioners for Garfield County, Colorado, 2 Tuesday , the day of when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 84-33 RESOLUTION CONCERNED NGSIRURALHE FIREPPROVAL OF AN PROTECTION DISTRICTED SERVICE PLAN FOR THE GLENWOOD WHEREAS, revisions and modifications to the service plan for the Glenwood Springs Rural Fire Protection District were filed with the Clerk and Recorder of Garfield County, Colorado, together with a Notice of Hearing and a processing fee, as specified by law, after which Notice of a Public Hearing was duly published, as required by law, and the required service by United States mail made upon other municipalities and Districts; WHEREAS, said public hearing was conducted, pursuant to said Notice; WHEREAS, under the provisions of the Special District Control Act, Title 3.2, Article 1, Part 2, Colorado Revised Statutes, the Board of County Commissioners is designated as the approving authority and is requied to review the revision and modification of any service plan filed with reference to need, service and economic feasibility, and the Commissioners, having taken into account the original approved service plan, the proposed revisions and modifications to said service plan, and the testimony, evidence and exhibits submitted at the public hearing; and WHEREAS, the Commissioners have studied said revisions and modifications to the servcie plan and related materials, and have determined that the same adequately meet the conditions necessary under the Statute for approval and, therefore, have determined to enter and adopt a Resolution of Approval of the revised modified service plan for the Glenwood Springs Rural Fire Protection District.. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County: Section 1: That the Board of County Commissioners of Garfield County, Colorado, does hereby determine that all of the requirements of the Special District Control Act, being Title 32, Article 1, Part 2, Colorado Revised Statutes, have been met and fulfilled in due time and manner, and that all notices have been duly given, as therein required. Section 2: That, upon thorough and complete consideration of the revisions and modifications to the service plan for the Glenwood Springs Rural Fire Protection District, and all of the facts brought to light at the public hearing on said revisions and modifications, the Board of County Commissioners of Garfield County, Colorado, does find, determine and declare as follows: a. That there is sufficient existing and projected need for the organized service in the area to be serviced by the District, pursuant to said revised and modified service plan, to justify said revision and modification. b. That existing service in the District area, exclusive of those services provided by the District, pursuant to said revised and modified service plan, is inadequate for present and projected needs. c. That no adequate service is or will be available to the area to be served by the District, pursuant to the revised and modified service plan, through municipal or quasi -municipal corporations within a reasonable time and on a comparable basis. d. That the District appears to be capable of providing economic and sufficient service to the area witin its boundaries, pursuant to said revised and modified service plan. e. That the area included in the District appears to have the financial ability to discharge the proposed indebtedness to be incurred on a reasonable basis, pursuant to said revised and modified service plan. f. That the facility and service standards of the District, set forth in said revised and modified service plan, are compatible with the facility and service standards of adjacent municipalities and special districts. g. That the revised and modified proposal is in substantial compliance with a master plan, if any, adopted pursuant to Section 30-28-108, C.R.S. Section 3: That, upon thorough and complete consideration of said revised and modified service plan, and all of the facts brought to light at the public hearing thereon, said revised andd odified d service plan shall be, and the same is, hereby approved condition. Section 4: That it is hereby ordered that copies of this Resolution be filed in the records of Garfield County, Colorado, and submitted to the Petitioner District for delivery to the District Court for such further proceedings, as may be deemed appropriate by the Court.
