Dear Mr. Phillips:
I am responding to your request for a Department of the Anny
permit to distharge fill material into waters of the United
States in conjunciion with the installation of a L2 inch diameter
natural gas pipeline from Rifle to Avon in western Colorado. The
project itart point is located in Section 13, Township 6 South,
nange 94 West in Garfield County, and ends in Section 10,
Township 5 South, Range 82 West in Eagle County, Colorado.
The proposed route of the project will cross 21 perenlial
streams, Lnd- 75 internittent streams. Both the Colorado River
and the Roaring Fork River will be crossed by the pipe. A number
of wetlands wj.ll also be crossed; it is estimated that less than
one acre of wetlands will actually be impacted, and that none
will be destroyed. The pipeline installation wiII be
accomplished in two phases, one in L994, the other a year later.
The Chief of Engineers has issued nationwide general pernit
number 12 which authorizes the discharge of dredged and fill
material in waters of the United States for utility line backfill
and bedding. Your project can be constructed under this
authority provided Lhe-work meets the terms and conditions listed
on the enclosed information sheet, the conditions listed in
attachment 3 of your application submittal, and the special
conditions listed below.
SPECIAL CONDITIONS:
1. Whenever possible, stream crossings will be accomplished by
utilizing existing disturbed streambeds and streambanks.
2. Streambanks and streambeds will be returned to original
contours and the cuts will be stabilized with naterials similar
to what existed prior to the cut. Streambank stability is a
major concern, and areas which are currently most disturbed shall
be selected for crossings. Restoration of such areas shall be
enhanced to insure physical stability.
3. Crossing of running streams which have naturally reproducing
brown trout or rainbow trout populations will be restricted to
those periods during which construction effects will minimj-ze the
impact on the natural propagat,ion and survivability of those
species. Determination of the restricted periods will be
performed by the Colorado Division of Wildlife. You will
coordinate with the Colorado Division of Wildlife to obtain the
reguired information. A copy of the restricted periods for the
pernitteets crossings will be provided to the Corps of Engineers
inmediately after receipt.
4. All.construction personnel shall be inforned of the general
and special conditions related to crossing of any waters of the
United States for this project, including information about the
penalties, both civil and criminal, related to violations of the
Clean Water Act.
5. Excess material from excavations in waters of the United
States will be disposed of in an upland site, and drainage waters
from such disposal shall be free of silt before entering a water
of the United States.
5. Storage of construction materials or parking of equipment in
waters of the United States is prohibited.
7. Ditch breaks or plugs of impermeable material may be reguired
to be provided by the pernittee in certain wetland crossings to
prevent pipeline excavation from permanently draining wetlands.
No net loss of wetlands will be incurred due to this project.
8. Corps of Engineers personnel shall be notified at least two
weeks prior to crossing of perennial streamsr so that a
coordinated site visit nay be made with the permittee to discuss
crossing procedures, locations, and stabilization methods.
This verification will be valid for a period of two years
from the date of this letter unless the nationwide general pernit
is modified, suspended, or revoked. You should contact this
office if work will extend beyond this date.

Dear Mr. Bean:
Rocky Mountain Natura] Gas company and public service company of
Colorado are applying for a Special Use Permit to construct a new tweLve(L2) inch steel natural gas transmission pipeline near Rif1e, Colorado.This new pipeline is part of a larger project that will run from Rifle,
Colorado to Avon, Colorado. It is needed to satisfy increasing demandfor natural gas in the Roaring Fork Val1ey and the growing communities
aLong the Interstate 70 (I-70) corridor. This application is for ashort section of the pipeline that wiLl nrn from a point north of the
D&RGW railroad tracks to the south side of the Colorado River, alllocated near the West Rifle Exit on I-70. This application is submit.tedfor this portion only due to the fact that we need to start constructionby the first week in March. The river crossing must be completed byApril 1, L994 due t,o restricti-ons ptaced on us by the BLM and the Fish
and Game Depts. Another apprication wj-Il be submitted in the nearfuture for the rest of the project from Rifl-e to Glenwood Springs thatis slated for construction in May of 1994.

specifications with a proposed construction schedule from March 1, t994to April 1, L994 and will operate continuously upon completion ofconstruction of the project from Rifl_e to Glenwood Springs.

To address Garfield County Zoning ResolutiorL 79-1, conclusions of the
Environmental- Assessment are submitted as follows:
Pipeline construction and operation will noL have any adverse impact
upon existing 1awfu1 use of water through depletion or pollution of
surface run-off, stream flow or ground water. No water is required
to operate the pipeline. Approximately nine (9) acre feet of water
will be required to hydrotest the total pipeline, from Rifle to
Glenwood Springs, upon completion of construction. Said water to be
disposed of in accordance with the National Pollutant Discharge
Elimination System (NPDES). No sewage will be generated from
pipeline operation.
Installation will be on a valid right-of-way. There wilL be no long
term adverse impact on adjacent land from generat,ion of vapor, dusL,
smoke, noise, glare, vibration or other emanations. During
construction, certain of these conditions may be encountered but will
be mitigated when necessary by measures described in the
Environmental Assessment (see Appendix A - Resource Protection
Measures) Time spent on any parceJ- should be minimal.
Impact on wildlife and/or domestic animals will not be long term as
t.his pipeline is to be buried and the ground reseeded. Some short-
term disrupt,ion may occur during construction.
Pipeline construction will cause some short-term traffic impact.
Construction personnel in Ehe vicinity will add to overall traffic.
Minor delays wil-l- occur on roads crossed by the pipeline. Because
appropriatse traffic conErols (as defi-ned by the Colorado Department
of Transportation and the Manual of Uniform Traffic Control Devices)
would be used during construction and no publj-c roads woul-d be
completely closed, the flow of t.raffic around construction sites
would be maintained. Upon complet,ion of construction, traffic will
return to prior 1eveIs wit.h no long-term impact.
No adverse impact to abuttlng property will occur due to pipeline
operation. The pipeline is to be underground.
Mitigation measures for all of the previously mentioned concerns are
described in the Environmental Assessment Appendix A - Resource
Prot,ection Measures. Minimal impact will result from this project.

Rocky Mountain Natural Gas Companyts revegetation policy is as folLows:
On crossed private land currently growing crops (hay, etc. ) , the
company prefers to pay the landowner the cost to reseed his field.
This a11ows the landowner to selecL the seed mix he desires and the
appropriate time for planting.
On crossed private land not currently growing crops, the company will
reseed or pay the landowner to reseed with a common seed mix used in
that area.
On crossed non-private land specific seed mixtures will be planted as
determined in the environmental assessment.
Hopefully the informalion and materials provided herein satisfy the
reguiremenLs to issue the special use permit. Please contact this
office should addiEional information be needed. Otherwise, it wi}l be
appreciated that the permit be processed at your earliest convenience as
construction is sl-ated to begin on March 1, L994.

binding on the holder, its successors, or assigns, untiL they have fully
satisfied the obligations and/or liabilities accruing herein before or on
account of the expiration, or prior termination, of the grant.

RentaI:
For and in consideration of the rights granted, the holder agrees to pay
the Bureau of Land Management fair market value rental as determined by the
authorized officer unless specifically exempted from such payment by
regulation. Provided, however, that the rental may be adjusted by the
authorized officer, whenever necessary, to reflect changes in the fair
market rental value as determined by the application of sound business
management principles, and so far as practicable and feasibj-e, in
accordance with comparable commercial practices.
4. Terms and Conditions:
a. This grant or permit is issued subject to the holder's compliance with all
applicable regulations contained in TitIe 43 Code of Federal Regulations
part 2BOO.
b. Upon grant termination by the authorized officer, aII improvements shalI be
removed from the public lands within 18O days, or otherwise disposed of as
provided in paragraph (4)(d) or as directed b," the authorized officer.
c. Each grant issued for a term of 20 years or more shall, at a minimum, be
reviewed by the authorized officer at the enci of the 20th year and at
regular intervals thereafter not to exceed 10 1'ears' Provided, hovrever,
that a right-of-way or permit granted herein nay be reviewed at any time
deemed necessary by the authorized officer.

STIPULATIONS
1. The Authorized Officer or his representative shall be contacted atIeast 48 hours prior to the anticipated start of construction the project.
A pre-construction conference with the earth movlng contractor ie requiredat the time of notification. The operator shal} inform the Authorizedofficer on a weekly basis during construction as to the status of the
proj ect .
2. The operator or his contractor will contact the Authorized Officer's
Representative 48 hours before starting reclamation work and prior tocompletion of reclamation work.
3. Wildfires begun or sighted during construction of the project wiII be
reported immediately to the Grand Junction Fire Dispatch office at 303-
244-3lOO. The operator is liable for the full cost of fire suppression of
all fires on or in the vicinity of the project set or caused by his
employees, whether set directly or indirectly as a result of operations.
4. The holder shall survey and clearly mark the centerline and exterior
Iimits of the right-of-way. Blading of vegetation is restricted to the 50
foot right-of-way. Blading down to mineral soil should be limited to the
area to be trenched. The travel Iane and topsoil/trench material pile
area should only be grubbed of vegetation and the topsoil le-.ft in p1ace.
5. The pipeline will utitrze existing roads and jeep trails as the travel-
lane within the 5O foot right-of-way to minimize disturbance.

'7. This grant is subject to the plan of development as described in the
Environmental Analysis, EA # CO-07A-O4-L2. The desription of the proposed
action and Appendix A, Resource Protection Measures, of the EA are defined
as the plan of development.
B. Use of pesticides shall comply with the applicable Federal and state
Iaws. Pesticides shall be used only in accordance with their registered
uses and within limitations imposed by the Secretary of Interior. Prior
to the use of pesticides, the holder shalI obtain from the authorized
officer written approval of a plan showing the type and quantity of
material to be used, pest(s) to be controlled, method of application,
Iocation of storage and disposal of containers/ and any other information
deemed necessary by the authorized officer. Frnergency use of pesticides
shall- be approved in writing by the authorizec officer pri-or to such use.

or upon the naviglble waters of the United Statee, adjoining ehorelines,
or the waterg of the contiguous zor.e in violation of Section 311 of the
Clean Water Act ae amended, 33 U.S.C. 1321t and the regulations issued
thereunder, or applicable lawe of the State of
Colorado and regulations ieeued thereunder. Holder ehall give- immediate
notice of any euch discharge to the authorized officer and auch other
Federal and State officee ae are reguired by law to be given Buch notice.
10. The holder shall comply with all- applicable Federal lawe and
regulatione existing or hereafter enacted or promulgated-. In any event,
th; holder ehall comply with the Toxic Substances Control Act of L976t a€t
amended (15 U.S.C. 2eO1, et seq. ) with regard to any toxic eubetancee that
are ueed, generated by or etored on the right-of-way or on facilitiee
authorized-under thia right-of-way grant. (See 40 CFR, Part 702-799 and
especially, provieione on polychlorinated biphenyls, 40 cFR 761.1-
7G1.193.)- Aaditionally, any release of toxic gubetancee (leake' epiIIe,
etc. ) in excege of reportable quantity established by 40 CFR, Part 117
shali be reported aa reguired by the Comprehensive Environmental Response,
compengation and Liability Act of 1980, section Lo2b. A copy of any
report required or reqluested by any Federal agency or State government as
a iesult of a reportable release or spill of any toxic eubstancee ehall be
furnished to the authorized officer concurrent with the filing of the
reports to the involved Federal agency or State government.
11. The holder of Right-of-Way No. COC-54361, agrees to indemnify the
United States againet any liability arising from the release of any
hazardoue waste (ae these terms are defined in the Comprehensive
Environmental Response, Compensation and Liability Act of 1980, 42 U.S.C.
9501, et eeq. or Lhe Resource Conservation and Recovery Act of L976, 42
U.S.C. 6901 et seq.) on the right-of-way (unless the release or threatened
release ie wholly unrelated to the right-of-way holder'e activity on the
right-of-way. Thia agreement applies without regard to whether a releaee
is caused Uy ttre holder, its agent, or unrelated third parties.
12. Thirty daye prior to termination of the right-of-way, the holder
shall contact the authorized officer to arrange a joint inspection of the
right-of-way. Thie inepection wiII be held to agree to an acceptable
teimination (and rehabilitation) plan. This plan ehal1 include but is not
Iimited to, removal of facilities, drainage structures, or surface
material, recontouring, topsoiling, or seeding. The authorized officer
must approve the plan in writing prior to the holder's commencement of any
termination activities.
13. Holder ehall congtruct, operate, and maintain the facilitiee and
structures within this grant in strict conformity with the descriptive and
technical data which hae been furnished to the Bureau of Land Management
in connection with the application for this grant. Any relocation,
additional construction, or use which is not in accordance with such data
may not be initiated without the prior written approval of the authorized
officer.

L4. Grantor understands that the transmj-ssion pipeline (s) tobe installed upon said easement may be owned by one ormore natural gas utilities and Lhe Colorado publ-ic
Utilities Commission may subsequently determine which gasutility may provide gas service to landowners along therout.e of the proposed transmission pipeline (s) . Forpurposes of t.his cl-ause, each gas utility participatingin the transmission pipeline (s) shall- be deemed an owner.
In further consideration for said easement, d[ owner ofthe gas transmission pipeline (s) to be constructed uponsaid land hereby agrees to install four free taps uponGrantor's real estate for the purpose of supplying 9as,so long as such pipeline (s) shaIl be maintained, for use
upon said real estate for Grantor's domestic purposes andnot for resale.
