N/A A/R/RD L I RELATIONSFIIP TO T'I:IE COMPREHENSIVF PLAN The subject property is located in Distriot C - ltural Areas wilh Minor Environmental Constraints and District F - Rural Areas with Major Environmental Constraints as designated by the Garl-reld County Comprehensive Management District's map. DESCRIPI'ION OF TIIE PROPOSAL Site anrl Project Description: Rocky MounLain Natural Gas Company and Public Service Company of Colorado are requesting a Special Use Permit to construct a twelve (12) inch steel natural gas pipeline near the Rifle/I-70 interchange. The SUP is being requested for a short section of the pipeline that will extend from a point north of the D&RGW railroad tracks to the south side of the Colorado River. The segment is part of a larger project that will eventually extend from Rifle to Avon. The applicants arerequesting approval for only this portion due to construction constraints placed on the project by BLM and Fish and Game. Completion of this section, consistent with these requirements, must be completed by April l, 1994. An additional application will be subrnitted to the County at a Iater date. A project bounclary map o{'the SUP is attached on page 3 L III. MAJOR ISSTIE,S AND CONCERNS l. The applicants have submitted easement agreements for the pipeline from all affected private property owners in Garheld County. 2. No agreement to cross I-70lrom the Colorado Department of Transportation has been provided, although the applicant has indicated that the required approval from CDOT is in process. Staff suggests that CDOT approval be A. e 33- submitted prior to any construction. The project will require a nationwide 404 permit from the Army Corps of Engineers. The 404 permit has not been approved, but is currently in progress. Staffsuggest that Army Corp approval be submitted to the County prior to any construction. All mitigation measures associated with the project are described in Appendix A of tlle_Environmental Assessment (see copy of mitigation measures on pages37.iltt No materials or equipment storage are proposed as a portion of the application. Permanent impacls ftom l.he proposed development should be minimal. No above-ground improvements are included as a portion of the application. The primary impact should be addressed as a function of revegetation. Rocky Mountain Natural Gas's revegetation policy provides for either reseeding damaged areas or paying the applicant the costs of reseeding. IY.SI.IGGESTE,D FINDINGS That proper publication and public notice was provided as required by law fior the hearing belore the Board o[ County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were subrnitted and that all interested parties were heard at the hearing. That ttre application is in compliance with the Garlield County Zonrng Resolution of 1978, as amended. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. RFCOMMENDA'I'ION APPROVAL, subject to the following <;onditions: All proposals of the applicant shall beconsidered conditions of approva-l unless stated otherwise by the Board of County Commissioners. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use have commenced. All revegetation shall be in aocordance with the revegetation agreements approved by each property owner. All revegetation shall be conducted with certified weed-free seed. Rocky Mountain Natural Gasshall be responsible for weed control in accordance with State and County regulations. When providing access to the pipeline's right-of-rvay, all rivers, strearns, and washes will be crossed at existing roads or bridges; any clther crossings nrust be approved and desig- nated by the controlling jurisdiction. Where drainages will be crossed by temporary roacls, dirt fills, or culverts rvill be placed and rernovetl upon cornpletion of the project. Culverts on tenlporary roads will rneet the approval of the controlling jurisdiction. All streanr chanttels and washes will be returned as near as practical to their natural state. 7. Clearing and Site Preparatiort 1. To rnirtirnize disturbance associated with installation of the pipeline, RMNG ancl PSCo will not grade the right-of-rvay outside the trench line, except where necessary, on all level and gently sloping terrairr. 2. Sideltill cuts tvill be kept to a ntittiutunr to protect local resources while providing a sa[e and stable ltlane for the efficient use o[ ecluipment. 3. Existing grouttcl cover such as grasses, leaves, brush, and trees rvill be clearecl only wltere necessary for operatiolt of equiprnent. In general, grass, forbs, ancl shrubs will be cut olf near groulrd level leaving their root systenrs intact. The cuttings will be reclistrib- uted over the right-of-way during reclamation or clisposed of as directecl by the lanrl-. owner/agency representative. 4. Trees and large sltrubs tltat are not clearect from the right-of-way will be protccted frorn damage during cottstruction by avoiding tlrern with e<luipnrent.
