and place for the hearing shall be given in the newspaper of
general circulation in that portion of the County at least
fifteen (15), days prior to such hearing time. Applicant shall
bear the cost of advertising.
6. A copy of Assessor's map showing property; and a listing of all
adjoining property owners of said property. Notice containing
information described under paragraph 5 shall be mailed to all
owners of record of these lots at least 5 days prior to the above
hearing by certified return receipt mail and the receipts shall
be presented at the hearing by the applicant.
7. A fee of $SO.00 shall be charged for each application and
shall be submitted with the application.

WATER AGREEMENT
Thie agreement entered into this the day of November 1973.
Between Dr. Ern C. Mooney, Robert Tharp and William Robichaud, all
property owners in the Sweetwater Drainage, Garfield County, Colorado.
This agreement covers the usage of water derived from springs that
were developed in 1971. Said springs being located on the property of
Dr. Ern C. Mooney. In as much as the cost of developing said springs
and the construction of a water distribution system was shared equally
between the three afore mentioned property owners, the water so developed
to also be shared equally between the three property owners.
It being further agreed that any one of the property owners involved shall
have the right 'o enter upon the property of each other for the purnoae
of repairing and or maintaining the water supply, main pipe lines and tanks
as ne='d arises. The cost of any repair or maintenance of said water system
to oe shared equally between the three property owners from the water source
to the main distribution tank located above the Mooney house..and from this
tank down to the tank located above the rharp house the expense shall be
divided equally between Tharp and Robichaud...All individual water lines from
the tanks to the individual homes shall be maintained by the individual
property owners involved. A.
It being further agreed that in case of the ownership of the property upon
which the springs and main water lines are located shall change, the terms
of this agreement shall then oecome binding upon the new owners. likewise
should there be a change of ownership of either or both of the other two
properties now owned by Tharp and Robichaud, the water usage rights as set
forth in this agreement shall remain with the property.
It being further understood and agreed that there shall be no additional
water hook-ups or connections upon this water distribution system without
the written consent of the three property owners or and subsequent owners.
All terms of this agreement shall be binding upon e11 present property
owners, and upon any subsequ nt owners of the three above described properties.
