BOCC 4/3/89 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Special Use Permit for a two-family dwelling. APPLICANTS: Joseph & Veronica Sauter James & Rose Meckley LOCATION: A parcel located in the SE 1/4 SW 1/4 of Section 14, T3S, R87W; more practically described as a parcel located approximately one (1) mile west of the Garfield/Eagle County line, off of Sweetwater Road. WATER: Existing spring SEWER: Existing individual sewage disposal system ACCESS: Sweetwater Rd. (C.R. 140) ZONING: A/R/RD I. DESCRIPTION OF THE PROPOSAL A. Site Description: The area around the site is a mountain terrain with relatively gentle slopes at less than 5% to very steep slopes over 45%. The tree cover is predominately spruce, fir and aspen, with various types of scrub. B. Project Description: It is proposed to convert two existing dwelling units into an attached two-family dwelling. Presently, there is an existing house and a mobile home on the property. The applicants propose to connect the two structures together with an 18 ft. long covered walkway. The mobile home will then be replaced over a period of time by adding sections to it and eventually replacing the structure with a standard stick built home. Both dwellings are provided water from a spring and have an existing individual sewage disposal system. II. MAJOR ISSUES AND CONCERNS A. Zoning: A two-family dwelling is allowed by Special use permit in A/R/RD zone district. The application is being made to deal with the expansion of a non -conforming use. This application will allow the applicants to make needed improvements to the mobile home and come into conformance with the Zoning Resolution. B. All of the improvements to the mobile home will have to meet the Uniform Building Code and sewage disposal system requirements. C. The creation of the two-family dwelling does not allow for separate sale of the individual dwellings. Should the property be sold, the two-family dwelling will be sold as a single ownership. • • Page Two III.SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. IV. RECOMMENDATION APPROVAL, subject to the following conditions: 1. That all proposals of the applicant shall be considered conditions of approval, unless specified otherwise by the Board of County Commissioners. 2. That the two-family dwelling shall be sold as a single ownership and the dwelling units may not be sold separately. 3.
