HomeMy WebLinkAbout2.0 Staff Report• a A;,,,,LJ, • PROJECT INFORMATION AND STAFF COMMENTS PROJECT NAME: Public Hearing regarding a request for a temporary Special Use Permit to operate a portable asphalt drum dryer mixer APPLICANT: Roberts Construction Company LOCATION: Approximately 1.5 miles northeast of Carbondale at the Zemlock and Sons Gravel Pit on the Blue property off County Road 104. WATER: To be supplied by property owner SEWER: Portable chemical toilet ZONING: A/R/RD ADJACENT ZONING: North: A/R/RD South: Highway 82 & PUD (Ranch at the Roaring Fork) East: A/R/RD West: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN: District A - Urban Area of Influence for the City of Carbondale II. DESCRIPTION OF THE PROPOSAL: A. Site Description: The site is located on a bench to the north of Highway 82. The Zemlock pit, where the applicant proposes to locate, was approved by the Board of County Commissioners in December of 1981 (Resolution No. 81-384). B. Project Description: The applicant proposes to operate a temporary drum dryer mix- for the production of hot bituminous pavement. The operation is §olely for the purpose of State Highway project FC 082-1 (5) & (7). (This project will improve the area near the stage coach property.) The proposed mixing plant is completely self-contained. The plant utilizes a self contained generator and fuel supply. The primary stack on the plant emits a cloud of white steam which is the result of superheating water to eliminate expelling dusts from the dried aggregate into the air. The applicant proposes to operate between the hours of 8 A.M. to 5 P.M. The permit request is for a two week period. The operation will have 3 or 4 employees. One state inspector will make a daily inspection of the plant. There will be 26 truck trips per day for approximately 3 or 4 days. III. MAJOR ISSUES AND CONCERNS: A. Review Agency Comments: 1. The Town Manager of Carbondale stated that he felt the City of Carbondale would have no problems with the proposed project. B. Staff Comments: 1. The applicant has been granted a State of Colorado Department of Health permit #C-11467. However, the Planning office does not have a copy of this for our records. 2. The applicants request to operate between the hours of 8 A.M. and 5 P.M. is within the permitted hours of operation for the Zemlock Special Use Permit. 3. The Zemlock pit operates on a daily basis. The applicant did not address whether he wished to run on a daily basis or on a Monday - Friday basis. 4. The application did not include verification of the property owners ability to serve water to the applicant. -4- • • IV. FINDINGS: 1. The proposed special use permit conforms to Sections 5.03.07 and 5.03.08 of the Garfield County Zoning Resolution of 1978, as amended. 2. That the proposed land use will be compatible with existing and permitted land uses in the area. 3. That for the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION: Approval of the temporary Special Use Permit with the following conditions: 1. All cond_tions of the applicant shall be considered conditions of approval. 2. That a copy of the Colorado Department of Health permit #c-11467 for acceptable 1_mits of pollution be given to the Planning Division prior to the signing of the Special Use Permit. 3. That the Special Use permit shall be valid for 14 days only after the date of issuance. 4. That the applicant shall submit verification of the property owners ability to serve the proposed project with water. -5 -
