HomeMy WebLinkAbout5.0 Resolution 2002-20111111 1111] ililil 1111 1111 11111111 11111 III 11111 1111 1111 599001 03/13/2002 11 21A B1336 P995 M ALSDORF 1 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO • STATE OF COLORADO )ss County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday, the 11th day of March A.D. 2002, there were present: John Martin Walt Stowe Larry McCown Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2002- 2 0 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR GREG AND DIANNE PARK. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Greg and Dianne Park concerned with a Special Use Permit to allow for a Resort at 1213 County Road 112, Carbondale, Colorado; WHEREAS, the Board held a public hearing on the 14th day of May 2001 upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. • • 4. For the above stated and other reasons, the proposed special use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for a Resort, upon the following specific conditions: That all representations of the applicant, written, implied or verbally stated at the hearing, before the Board of County Commissioners shall be considered conditions of approval, unless approved otherwise by the Board. 2. That the applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended and the Uniform Building and Fire Codes. 3. The applicant should work with the Fire Protection District to develop a fire -safe envelope around the buildings and to work and obtain and comply with the Fire Protection Plan from the Carbondale Rural Fire District Association with a letter from the Rural Fire Department stating that there is an agreement that this plan will provide adequate protection. 4. The Special Use Permit is valid for one-year and is to be reviewed by the Planning Department and inspected for compliance to Zoning Regulations, Building and Fire Codes at the end of one year. 5. The ISDS or systems will be designed by a registered professional engineer and installed according to the engineer's recommendations. 6. This Resort is for guest staying only for short periods of time, three weeks or less. 7. This Resort will be limited to six guests at any one time. 8. There will be no expansion of this Resort without a full Special Use review. 9. That prior to signing this Resolution, the applicant will have provided staff with the following information: that there are no restrictive covenants on this property disallowing this type of use; proof that they are their guests have legal access of the driveway shown in the plat; and the new plat will show the well placement. 10.
