Special Use: For construction, operation and maintenance of a 230,000
volt electric transmission line as described herein.
Legal Description: Refer to Exhibit A, attached hereto and made
a part hereof.
Requirements:
1. Plans and specifications for proposed use.
2. Letters of approval from utility companies, sewage and water.
Evidence of road access and other information deemed necessary.
3. A vicinity map, drawn to scale, depicting the subject property,
location and use of buildings and structures on adjacent lots.
4. An impact statement on the proposed use where required by Sections
5.03-5.03.12 of the Zoning Regulations.
5. Notice, including the name of the applicant, description of the
subject lot, a description of the proposed special use and the time
and place for the hearing, shall be given in the newspaper of general
circulation in that portion of the County at least fifteen (15) days
prior to such hearing time. The applicant shall bear the cost of
advertising.
6. A copy of Assessor's map showing property; and a listing of all
adjoining property owners of said property. Notice, containing
information described under paragraph 5, shall be mailed to all owners
of record of these lots, at least 5 days prior to the hearing, by
certified, return receipt mail, and the receipts shall be presented at
the hearing by the applicant.
7. A fee of $500.00 shall be charged for each application and shall be
submitted with the application.
8. Attach copy of proof of ownership (deed; title insurance).
This Special Use permit is in compliance with Sections 5.03 and 9.03 of the
Garfield County Zoning Resolution and as per application.

LEGAL DESCRIPTIONS
As -built legal descriptions and drawings of the transmission system
rights-of-way and substation sites will be provided to Garfield County and
become a part of a Special Use Permit issued pursuant to this application
as they become available. Below are general legal descriptions of the
proposed electric transmission rights of way and substation locations.
230,000 Volt Electric Transmission Line From Public Service's Rifle
Substation to Cogeneration Technology, and Development Company's
11 Substation/Plant
Beginning at Public Service's existing Rifle Substation located in the
Southwest Corner of Section 16, Township 6 South, Range 92 West of the 6th
Principal Meridian, thence Southwesterly and parallel to the South side of
the existing Cameo -Rifle 230,000 volt electric transmission across SEASE4
of Section 17; the NINE* and the NNW of Section 20; the N2 of Section 19
11 all in Township 6 South, Range 92 West, and the Nz of Section 24, Township
6 South, Range 93 West to a point near the North-South centerline of said
Section 24; thence northwesterly to the Cogeneration Technology and
Development Company Substation located approximately 1700 feet East and 500
feet South of the Northwest Corner of said Section 24.

PLANS AND SPECIFICATIONS
The transmission line will be a single circuit 230,000 volt line from the
Cogeneration Technology and Development Company (CTDC) Substation to Public
Service's Rifle Substation. A separate line interconnecting the Rifle
Substation is necessary to insure the reliability of the major power
system. By constructing a separate line on separate structures, electrical
faults, outages or maintenance can be corrected without interrupting
service to residences and businesses relying on the main power transmission
system.
The transmission line will be constructed on wood poles 75.0 feet southerly
of the existing line owned by Public Service as shown on Exhibit B1. The
in-line structures will be H -Frames and the angle structures will consist
of three (3) wood poles guyed for additional support. These structures are
illustrated on Exhibits 62 and B3.
At the existing Public Service Rifle Substation additional facilities must
be installed to terminate the new transmission line. This will include
extending the existing bus approximately 100 feet to the south, installing
a line dead-end structure, and the associated circuit breakers and
switches. The existing chain link fence will be extended to encompass the
new facilities. Please refer to Exhibit B-4.
The total estimated cost for this project is '1,250,000.

LETTERS OF APPROVAL
11 The proposed electric transmission and substation system will have no need
for sewer, water, or gas service. Therefore there will be no need for the
extension of any of these services. Telephone service may be provided at
the substation sites when, and if, service is extended and available.
The proposed facilities will not involve the construction or upgrading of
any roadway or road system which requires public or county maintenance.
Public Service will coordinate the crossing of other utilities by the
proposed electric transmission system prior to construction. Mountain Bell
11 and all participants in the proposed common utility corridor will be
contacted to ensure the compatibility of all systems.
Subject to the granting of the Special Use Permit herein applied for,
Public Service will acquire the subsequent crossing permits. Also subject
to the granting of the Special Use Permit herein applied for, Public
Service will initiate negotiations to acquire the required easements.
Should negotiations through normal procedures be unsuccessful, Public
Service has the power of eminent domain to secure the required land rights
(CRS 1973:38-5-105).
11 As a public utility, Public Service is well aware of the coordination
required with other utility facilities and will design and construct the
11 proposed electric transmission line and substation system accordingly. All
of the electric facilities have been designed to provide the most
economical and reliable service and to augment Public Service's bulk power
11 system. Cogeneration Technology and Development Company will incur the
cost for the entire system.

11 5.03.07 INDUSTRIAL OPERATIONS
5.03.07(1) Impact Statement
Location and Scope
The federal Public Utility Regulatory Policy Act of 1978 provides that
electric utilities must purchase electric energy made available by
qualified cogeneration and small power producers.
I/ The Cogeneration Technology Development Corporation project is a
qualified cogeneration and therefore must be connected into the
utility system. Public Service has contracted for the purchase of
this electric energy.
The 80 megawatts to be connected into the electric transmission system
must be done in such a manner as not to jeopardize the stability of
the existing bulk power transmission systems. As a result, the
proposed electric transmission line and substation system has been
designed to become a part of the electric system which can be isolated
during faults, outages or maintenance at either the CTDC Substation or
on the existing Public Service system.
The project will consist of a separate 230,000 volt electric
transmission line between the CTDC Substation and Public Service's
Rifle Substation.
The specific description and location of the proposed facility are
included in the response to Requirements 1 and 3 of this Special Use
Application.
Design
The design specifications of the proposed facilities are included in
the response to Requirement 1 of this Special Use Permit Application.
Refer to Exhibit B and Exhibit D.
Construction Schedule
I/ Construction of the facilities required for the proposed transmission
line and substation system is scheduled to be completed prior to April
1987. In order to meet this in-service date, the following activities
are scheduled:
1 Transmission Line Survey Complete
Transmission Line Construction January - February 1987
I/ Rifle Substation Construction November 1986 - February 1987
Operational Characteristics
All Public Service facilities are designed, constructed, and operated
to meet or exceed all applicable standards of design and performance

11 set forth in the National Electric Safety Code. The transmission
lines are patrolled periodically to detect wear or any damaged
II equipment. Periodic patrol and maintenance of the substations
requires two employees once a week on the average. All Public Service
personnel receive safety training for emergency situations.
1 5.03.07(1)(a) Effect on Use of Water
The proposed project will have no significant adverse effects on
II the existing lawful use of water through depletion or pollution
of surface run-off, stream flow or groundwater.
I The proposed electric transmission line and substation system has
no water requirements. Minimal quantities will be consumed by
construction workers and may be required for dust suppression
II during construction. Pollution of the surface run-off, stream
flow or groundwater by erosion will be prevented substantially by
limiting access to existing roads and trails. Where soil
disturbances occur at the structure locations and substation
I sites, the disturbance will be kept to a minimum and revegetated
(Refer to Section 5.03.07(5)).
II 5.03.07(1)(b) Effect on Adjacent Land
The proposed project will have no significant adverse effects on
adjacent land through generation of vapor, dust, smoke, noise,
II glare or vibration, or other emanations. The generation of dust
will be a temporary condition during construction and will be
limited by keeping soil disturbances to a minimum and timely
II revegetation of disturbed areas. The generation of noise during
construction, operation, and maintenance of the proposed
facilities will temporarily disturb the area wildlife. The
II degree of this disturbance will be insignificant when compared to
the activities resulting from the other uses permitted adjacent
to all of our facilities. The generation of glare by the
proposed facilities will be reduced by the use of non -specular
11 conductors, dull galvanized steel, and limited use of paints or
stains.
II5.03.07(1)(c) Effect on Wildlife and Domestic Animals
The proposed project will have no significant adverse effects on
the wildlife and domestic animals through creation of hazardous
11 attractions, alteration of existing native vegetation, blockade
of migration routes, use patterns or other disruptions.
1/ Public Service has participated in, and co-authored, several
studies concerned with the design of transmission structures to
prevent the electrocution of raptors and migratory birds, and to
I/ enhance their nesting habitats. The findings of these studies
will be implemented in the design and construction of the
transmission system.

5.03.07(2) Traffic
I A temporary impact on the road system will result from construction
activities. This temporary affect will not be of sufficient magnitude
to require any changes to the County's existing maintenance program.
II The truck and automobile traffic to and from the proposed facilities
for Public Service's operation and maintenance will not create hazards
or nuisance. Transmission line patrols are done from the air.
Monthly surface patrols will be limited to maintenance activities. No
II employees will be permanently located at the substation facilities and
periodic patrol and routine maintenance will require two employees
once a week on the average.
1 5.03.07(3) Safe Distances
All Public Service facilities are designed and constructed to meet or
II exceed all applicable standards of design and performance set forth in
the National Electric Safety Code.
I The right-of-way requirements are designed to provide sufficient
distances to separate the proposed transmission lines from abutting
properties. Vertical clearances, established by the National Electric
II Safety Code, are also maintained at all crossings of transportation
facilities; i.e., railroads, interstate highways, state highways,
county roads, and any other area where vehicular use may occur.
II Public Service installs automatic and instantaneous breaker devices on
both distribution feeders and transmission lines. The proposed
substation will be equipped with automatic switching gear and
II supervisory equipment which protect the system and maintain a high
level of reliability.
5.03.07(4) Additional Information
IIThis section reserved for submission of response to additional
information if requested by the County Commissioners.
1 5.03.07(5) Rehabilitation
II 5.03.07(5)(a) Rehabilitation Plan
When the construction activities are complete, all crates, boxes,
bands, reels, lagging, wrapping, wire pieces, and other material
11 or equipment waste of every kind will be cleaned up and properly
disposed of. All light material which might be spread by the
wind will be cleaned up and disposed of on a daily basis.
11 Vegetation and soil disturbances will be minimized and
revegetation will be initiated after construction of the
I/ transmission line is completed. The following specification was
prepared with assistance from the Garfield County Extension
Office and will be implemented to reclaim all disturbed areas:

1. Lightly scarify the disturbed area with a rake or a disc set
straight, depending on the size of the disturbance,
topography and access.
2. Fertilizer shall be surface applied evenly at the rate of
100 pounds (bulk)/acre (33-0-0) and 100 pounds (bulk)/acre
(18-46-0).
3. The following seed mix shall be broadcast uniformly at the
rate of 30 pounds pure live seed/acre and lightly raked into
the soil.

4. Native hay mulch shall be evenly applied by a straw blower
at the rate of 1000 pounds/acre and crimped into the soil
with a shovel or by lightly discing with the disc set
straight.
5.03.07(5)(b) Security for Execution of Rehabilitation Plan
Security for the execution of the Rehabilitation Plan will be
provided if required.
5.03.08 INDUSTRIAL PERFORMANCE STANDARDS
5.03.08(1) Volume of Sound Generated
The proposed electric transmission and substation system will be so
operated that the volume of sound inherently and recurrently generated
will not exceed eighty (80) decibels at any point on any boundary line
of the property on which the use is located.
The sound generated by an electric transmission line is minimal
directly beneath the conductors. Wet and foggy weather provides a
more favorable condition for the sound that is generated and a
crackling noise is more perceptible. However, the ambient noise level
is usually higher during these conditions also. The maximum sound
levels expected on this right-of-way during worst conditions should
not exceed 50dbA.
5.03.08(2) Vibration Generated
The proposed transmission and substation system will be so operated
that the ground vibration inherently and recurrently generated is not
perceptible, without instruments, at any point on any boundary line of
the property on which the transmission line or substation is located.

5.03.08(3) Emissions of Smoke and Particulate Matter
There is no combustion or emission of any pollutants associated with
the operation of the proposed electric transmission and substation
system. Minimal quantities of dust and vehicle exhaust will result
during construction. These will be insignificant and of short
duration. There will be no measurable effect on air quality.
The proposed transmission and substation system will be operated to
11 comply with all federal, state, and county air quality laws,
regulations, and standards.
5.03.08(4) Emissions of Heat, Glare, Radiation, and Fumes
The emissions of heat, glare, radiation, and fumes from the operation
of the proposed electric transmission system will not interfere with
the existing use of adjoining property, and will not cause a public
nuisance or hazard.
5.03.08(5) Storage Area, Salvage Yard, Sanitary Land Fill, and
Mineral Waste Disposal Sites
The construction of the proposed transmission line and substation
system may require materials to be staged at the Rifle Substation and
at the CTDC site. When construction is complete the sites will be
rehabilitated as indicated in the Rehabilitation Plan.
5.03.08(5)(a) Compliance with National Fire Code
Storage of flammable, or explosive solids, or gasses will be in
accordance with accepted standards and laws and will comply with
the National Fire Code.
1 5.03.08(5)(b) Storage Area Enclosure
At the discretion of the County Commissioners, all outdoor
11 storage facilities for fuel, raw materials and products will be
enclosed by a fence or wall adequate to conceal such facilities
from adjacent property.
11 5.03.08(5)(c) Material Storage
11 No material or waste will be deposited upon the property in such
a form or manner that they may be transferred off the property by
any reasonably foreseeable natural causes or forces.
5.03.08(5)(d) Health Regulations
All materials or waste which might constitute a fire hazard or
I/ which may be edible by or otherwise be attractive to rodents or
insects will be stored outdoors in accordance with applicable
State Board of Health Regulations.

5.03.08(6) Water Pollution
11 The construction, operation, and maintenance of the proposed electric
transmission line and substation system will not result in any water
pollution. Pollution of the surface run-off, stream flow or
groundwater will be prevented substantially by limiting access to
existing roads and trails, and by helicopter construction. Where soil
disturbances occur at the structure locations, and substation sites,
the disturbance will be kept to a minimum and revegetated (refer to
Section 5.03.07(5)). The substation yard areas will be resurfaced
with gravel and road base material.
Any percolation tests or groundwater resource tests which may be
required by local or state health officers will be met before
operation of the facilities.
5.03.09 USES NOT ITEMIZED
Public Service does not request this review to have the proposed
facilities added to the list of permitted uses in the zone districts
involved.

Board of County Commissioners, Garfield County, State of Colorado, to grant
a Special Use Permit in connection with the following described property

No Action Alternative
' There is a No Action Alternative for this project as the Public Utility
Regulatory Policy Act of 1978 requires that power produced by qualified
independent power producers be purchased by electric utilities. In this
1 case, Public Service is required to purchase power from CTDC.
Alternative A - Tap Existing Rifle -Cameo 230kV Line
Tapping into the existing Rifle -Cameo 230kV Line at the southeast corner of
the CTDC project area would require the construction of one-quarter (1/4)
mile of double circuit or two separate single circuit 230,000 volt lines.
In addition, switching facilities would have to be constructed either at
the tap point or at the CTDC Substation. This alternative is illustrated
on Exhibit I-1. The Rifle -Cameo 230kV Line is one of the major East-West
' bulk power transmission system ties. Exposing this line to unnecessary
interruptions of power flows creates an unacceptable degradation of the
system reliability.
The estimated cost of this alternative is $1,800,000.
We find this alternative to be unacceptable due to system operating
' reliability and cost.
Alternative B - Construct 230kV Line Along the North Line of
' Sections 20, 19 and 24
This alternative requires the construction of approximately 2.6 miles of
single circuit -230,000 volt electric transmission line along the north line
' of Sections 20 and 19, Township 6 South, Range 92 West and the north line
of Section 24, Township 6 South, Range 93 West, as shown on Exhibit I-2.
The additional line terminations at Rifle Substation are the same as the
' proposed action.
The estimated cost of this alternative is $1,250,000.
' Routing the line as required for this alternative creates another
transmission line corridor from Rifle Substation. It would diverge from
the existing lines beginning at the south one-quarter (1/4) corner of
' Section 17 to the CTDC property in Section 24. A maximum separation of
some 1100 feet.
I The line would be routed along the south side of the county road from
approximately one (1) mile. There is a home located just north of the
section line, 1800 feet east of the northwest corner of Section 19.
1 With the cost of this alternative being equal to the proposed action it
would be proper to eliminate it from consideration due to the additional
burden it places on the land and its proximity to the residence in Section
II
