HomeMy WebLinkAbout4.0 Resolution 2002-971111111 111111 111111 111111 11111 11��111 11111 1111 1111 614271 11/07/2002 04:27P B P772 M ALSDORF�� 1 of 3 R 0.00 D 0.00 GARFI COUNTY CO STA 1'E OF COLORADO )ss County of Garfield • At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday the 4th day of NovemberA.D. 20 0 2 , there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Walt Stowe , Commissioner Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2 0 0 2— 9 7 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR THE CONSTRUCTION AND OPERATION OF A NATURAL GAS BOOSTER COMPRESSOR STATION AT THE EXISTING RIFLE GAS PLANT DISCHARGE COMPRESSOR STATION FOR PUBLIC SERVICE COMPANY, A SUBSIDIARY OF XCEL ENERGY WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application from Public Service Company, a subsidiary of Xcel Energy, for a special use permit ("SUP") to allow for approval of a natural gas booster compressor station ("Compressor") at the existing Rifle Gas Plant Discharge Compressor Station within the R/L zone district; and WHEREAS, the Board held a public hearing on the 7th day of October, 2002, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners and proof thereof submitted in the record; 2. That the hearing before the Board of County Commissioners was extensive and complete, that sufficient pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting; 1 1 11111 HIE 111111 11111 1111 1111 614271 04:27P B14'd4 P773 M ALSDOR F 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO 3. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that SUP is hereby approved subject to compliance with all of the following specific conditions: 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended, and the Colorado Department of Public Health and Environmental standards. 3. The natural gas booster compressor station shall comply with all State and Federal regulations and standards, such as Noise Abatement and Air Quality. 4. The Applicant shall comply with the Garfield County Noxious Weed Management Plan. Weed management shall take place on the entire permitted property. Prior to completion of work of the Compressor, an inventory and mapping of any listed Garfield County Noxious Weeds shall be submitted to the Building and Planning Department. 5. The installation of the second compressor engine shall required applicable building permits. Prior to installation of the second compressor engine, an air quality permit shall be submitted and obtained by the Colorado Department of Public Health and Environment. 6. An application for an air quality construction permit for the second compressor engine, prior to its installation, shall be submitted and approved by the Colorado Department of Public Health and Environment. 7. At the time of building permit submittal, the following shall be submitted for record: A. A drainage plan. 8. The following commitments shall be adhere to: A. Building lighting, inside and outside, shall be manual. Lights shall be positioned downward to minimize glare. B. The exterior color of the structure shall blend with the surrounding environment. C. Emergency signage shall be posted 'and comply with County sign regulations. D. The building height of the 37' X 72' structure shall not exceed 31'9" as calculated in the Garfield County Zoning Resolution of 1978.
