I. DESCRIPTION OF THE PROPOSAL:
A. Development Proposal: The Applicant requests approval for the construction and operation of a
natural gas booster compressor station ("Compressor") at the existing Rifle Gas Plant Discharge
Compressor Station ("Rifle Gas Plant").
B. Project Description: Due to growth in Garfield, Eagle and Pitkin Counties, the existing 12 inch
pipeline, which provides gas to Silt, New Castle, Glenwood Springs, Basalt, Aspen, Gypsum, Eagle,
Edwards, Avon and the Vail Valley, has reached capacity. The installation of the proposed natural gas
booster compressor, which includes a 37' X 72' structure and two engines, will allow the Applicant to
provide reliable natural gas service to all the customers served by the pipeline.
The Compressor will reinforce the existing 12 -inch high-pressure natural gas pipeline that delivers gas
between the Rifle Gas Plant and the Edwards Meter Station. The reinforcement is accomplished by raising
the operating pressure of the pipeline from 750 pounds per square inch gauge (psig) to 1,200 psig to
provide a greater throughput volume for the existing pipeline. The Applicant indicated that the only
pipelines required for the project would be the lead lines to connect the new compressor to the existing gas
plant. Two 12 -inch pipelines would be installed from the existing discharge to the Rifle Avon 12 -inch

pipeline that is located 200 feet east of the discharge.
The Rifle Gas Plant will consist of a utility building, a control building, and the compressor building. A
37' X 72' and 31' 9" high structure will house the compressor. Due to the energy demands, one
compressor engine will be installed immediately and the building will be constructed immediately after the
engine is operational. The second engine will be installed at a later date depending on the demand for
natural gas. The Applicant asserted that the compressor engine(s) will comply with Colorado Revised
Statutes 25-12-103, Noise Abatement, for industrial zones during all phases of the project.
C. Site Description: The majority of the subject property is fairly level. There are slopes on the
subject property, however, they are along the edge of all existing and proposed improvements outside of
the security fencing. The proposed Compressor will not encroach onto any slopes. The site consists of a
utility building, a control building, skids and liquid storage tanks. The site contains 9 acres of which 3.5
acres are used for the Rifle Gas Plant. A security fence encompasses the 3.5 acres and encompasses all
improvements.
D. Background: Pursuant to Resolution No. 94-091, a Special Use Permit was approved by the
Board for the installation of a twelve inch (12") natural gas pipeline. There are no outstanding conditions
of approval.
E. Zoning: The subject property is zoned R/L (Resource Lands). The R/L zone district has four sub -
zones and this application is located in the Gentle Slopes and lower valley floor zone. The compressor
station and compressor engine are a use by special review, pursuant to the definition of processing under
the definition of Industrial Operations Classification, in the R/L zoned district. Within this sub -zone, the
maximum residential building height is 25', with no height limitation for non-residential structures. Even
though the structure exceeds the residential maximum, it does comply with the zoning requirements for
building height since there is no non-residential restriction.
F. Relationship to the Comprehensive Plan: According to the Garfield County Comprehensive Plan
of 2000, on the Proposed Land Use Districts, Study Area 3, the property is located within the City of Rifle
2 -Mile Sphere of Influence, but outside to the Rifle Annexation Boundary.
G. Adjacent Land Uses: Similar type industrial processing uses are occurring on the subject property
on private lands.
H. Road/Access: Access to the site is via a 20' ingress/egress easement (described on the site map)
which intersects with of Highways 6 & 24. No modifications to the road system is required as part of this
approval.
I. Applicability: Pursuant to Section 9.03.04 of the Zoning Resolution, an application for a Special
Use Permit shall be approved or denied by the Board of County Commissioners after holding a public
hearing thereon in conformance with all provisions of the Zoning Resolution.

II. REVIEW AGENCY AND OTHER COMMENTS:
Comments were received from the following agencies are have been integrated throughout this
memorandum as applicable.
1. City of Rifle Planning and Development Department has no objection. (Exhibit G, page /d ).
2. Rifle Fire Protection District did not provide a response.
III. REVIEW CRITERIA FOR SPECIAL USE PERMITS (SECTION 5:03)
Pursuant to Section 5.03.10, uses listed as Special Uses shall be permitted only:
1. Based on compliance with all requirements listed herein, and;
2. Approval by the County Commissioner, which Board may impose additional restrictions on
the lot area, floor area, coverage, setback and height of proposed uses or required additional
off-street parking, screening fences and landscaping, or any other restriction or provision it
deems necessary to protect the health, safety and welfare of the population and uses of the
neighborhood or zone district as a condition of granting the special use.
Response: As noted previously, the building height of the proposed structure exceeds the residential
maximum building height of 25', but since there is no non-residential limit the building is in technical
compliance. Given the relatively remote location of the site, staff sees no reason to require any
special conditions to address building height.
Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall conform to all
requirements listed thereunder and elsewhere in the Zoning Resolution, and the following standards:
1. Utilities adequate to provide water and sanitation service based on accepted engineering
standards and approved by the Board of County Commissioners shall either be in place or shall be
constructed in conjunction with the proposed use.
Response: The Applicant indicated that with the exception of water used for dust control, water is not
required in conjunction with the Compressor. No well water will be used and no wastewater will be
generated. During the construction of the Compressor, portable sanitary facilities will be installed.
2. Street improvements adequate to accommodate traffic volume generated by the proposed use and
to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction
with the proposed use.
Response: The Applicant noted that an increase in traffic volume as a result of the operation of the
Compressor will be minimal. No improvements to the existing roadway are necessary or anticipated. The
roadway is currently maintained as necessary.

3. Design of the proposed use is organized to minimize impact on and from adjacent uses of land
through installation of screen fences or landscape materials on the periphery of the lot and by location of
intensively utilized areas, access points, lighting and signs in such a manner as to protect established
neighborhood character.
Response: The Applicant asserted that impacts to adjacent uses from the Rifle Gas Plant will be minimal.
Building lighting, both inside and outside, will be manual. The structures proposed will be painted to
blend in with the surrounding natural environment. Signage will be posted on the fence to list emergency
contacts. The Applicant has asserted that weed control measures will be employed within the fenced area,
however, it is staff's opinion the weed management shall occur not only within the fenced are but the
entire property.
Section 5.03.07:
Pursuant to Section 5.03.07 of the Zoning Resolution, a permit for Industrial Operations requires the
submittal of an impact statement on the proposed use describing its location, scope, design and
construction schedule, including an explanation of its operational characteristics. The impact statement is
required to address the following:
(A) Existing lawful use of water through depletion or pollution of surface run-off, streamflow or
ground water.
Response: The Applicant asserted that:
• A U.S. Environmental Protection Agency (EPA) Phase II Stormwater permit has been
completed and filed with CDPHE (Colorado Department of Public Health &
Environment). A copy of this permit was not submitted with the application.
■ The natural gas booster compressor station will not alter stream flow or groundwater.
• A drainage plan will be designed and implemented to control surface run-off for the
project area.
(B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or
other emanations.
Response: The Applicant asserted the following:
■ Vapor: No vapor will be generated by the Compressor.
• Dust: Dust will be controlled, during construction, by water spray. Generator exhaust
will vent through a stack and will comply with all CDPHE air permitting requirements.

■ Noise: Noise will be abated by enclosing the engine within a 37' X 72' structure and an
exhaust muffler will be installed on the engine. Although the engine will be operational
for a brief period of time (less than 60 days) prior to the construction on the structure, the
Applicant noted that pre- and post -construction noise levels will be less than 75 decibels
on the A -weighed scale (dBA) at the property line and will conform to the requirements
set forth for the Industrial Zone, Colorado Revised Statues.
• Glare: The structures on the site will be Painted Desert beige so that they blend in with
the existing landscape and will be reflective. Manual building lights will be installed for
safety and security. The lights on the facility will be positioned downward to minimize
glare.
• Vibration: The entire Rifle Gas Plant will be constructed, operated, and maintained in a
technologically sound and safe manner and will not cause vibration beyond the boundary
of the property.
(C) Impacts on wildlife and domestic animals through the creation of hazardous attractions,
alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions.
Response: The application did not contain an analysis of wildlife impacts on the property. The Applicant
asserted that the installation of the compressor station will have minimal impacts on the wildlife habitat.
The area, 3.5 acres, occupied by the entire Rifle Gas Plant in encompassed by a security fence. The
Applicant noted that all areas beyond the security fence will remain undisturbed. The Applicant noted that
noxious weeds will be monitored, treated, and controlled throughout the project area.
(D) Affirmatively show the impacts of truck and automobile traffic to and from such uses and their
impacts to areas in the County.
Response: The Applicant noted that during normal operation, the Rifle Gas Plant will be unmanned and
the site will be accessed by one vehicle per week. During an annual maintenance period of 1 week, the site
will be accessed by one vehicle per day. The Applicant indicated that an additional approximately 6
maintenance days per year will occur, with one vehicle per day accessing the site. Staff finds that the
proposed request for the Compressor will not increased traffic to the site.
During the construction period of the Compressor, the Applicant represented that 5 vehicles will access the
site daily. Construction is anticipated to occur 12 hours per day, 6 days per week over a 2 1/2 month period.
It is anticipated that approximately 5 to 20 laborers will access the site during various phases of
construction. The Applicant noted that construction will take place from September 15th through
December 1, 2002. However, the Applicant shall be aware that construction of the Compressor shall
not occur until approvals are in place and appropriate building permits are obtained.

The Applicant indicated that the following types of vehicles will access the site during various phases of
construction. These vehicles include: a semi -truck and lowboy trailer, bulldozers, graders, cement mix
trucks, drilling rigs, a 1,470 horsepower crane, smaller crane, and a water truck to control dust.
(E) That sufficient distances shall separate such use from abutting property which might otherwise be
damaged by operations of the proposed use(s).
Response: The Applicant indicated that the proposed compressor building is approximately 200 feet from
the nearest property line. The compressor with comply with the requirements for industrial zones in the
Colorado Revised Statutes 25-12-103, Noise Abatement. The Applicant asserted that the maximum
permissible noise levels for noise radiating from the a property line at a distance of 25 feet or more for
industrial zones is established to be greater than 80 dBA (A -weighted scale) during the daytime period of 7
a.m. to 7 p.m. and greater than 75 dBA during the nighttime period of 7 p.m. to 7 a.m.
(F) Mitigation measures proposed for all of the foregoing impacts identified and for the standards
identified in Section 5.03.08 of this Resolution
Response: The Applicant indicated that the mitigation for the Rifle Gas Plant will consists of visual
mitigation, noise mitigation, erosion mitigation, dust mitigation, glare, and vibration. These mitigation
measures are outlined in detailed on page 8 of the application.
Special Use Permits may be granted for those uses with provisions that provide adequate mitigation for
the following:
(A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for
conditional or special use will be issued;
Response: The proposed site for the Compressor is approximately 1/2 acres, within an existing 3.5 acre
fenced area. Gravel will be spread in the areas around the equipment within the fenced area. The
Applicant noted that noxious weeds will be controlled. In the event construction results in minor surface
disturbance beyond the fenced area, the area will be re -seeded with native seed. A drainage plan will be
designed and implemented for the Rifle Gas Plant.
(B) The County Commissioners may require security before a permit for special or conditional use is
issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified
check or other security deemed acceptable by the County Commissioners in the amount calculated by the
County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and
in accordance with the specifications and construction schedule established or approved by the County
Commissioners. Such commitments, bonds or check shall be payable to and held by the County
Commissioners;
Response: The Applicant has indicated compliance with this provisions if deemed necessary by the
Board.

(C) Impacts set forth in the impact statement and compliance with the standards contained in Section
5.03.08 of this Resolution. (A. 93-061)
Response: See responses in Section 5.03.08 below.
Section 5.03.08:
Pursuant to section 5.03.08 of the Zoning Resolution, all Industrial Operations in the County shall comply
with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall
not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in
such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable
environmental effects beyond the boundaries of the property in which such uses are located, in accord with
the following standards:
(1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised
Statutes at the time any new application is made.
Response: As noted previously, noise from the natural gas booster engines will be mitigated with a 37' X
72' structure, and by installing a muffler on the compressor engine's exhaust. One of the two proposed
engines will be installed prior to the construction of the structure, which will be added no more than 60 day
after the engine is on line. The Applicant represented that pre- and post -construction noise levels will be
less than 75 decibels on the A -weighted scale (dBA) at the property line. According to the Applicant, the
A -weighted scale provides the best measure of the response of the human ear.
(2) Vibration generated: every use shall be so operated that the ground vibration inherently and
recurrently generated is not perceptible, without instruments, at any point of any boundary line of the
property on which the use is located.
Response: The Applicant asserted that the Compressor will be constructed, operated, and maintained in a
technologically sound and safe manner, and will not cause vibration beyond the boundary of the property.
(3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all
Federal, State and County air quality laws, regulations and standards.
Response: The Applicant asserted the following:
• Fugitive dust emissions from grading, excavation, cut -and -fill operations, vehicle traffic on
unpaved surfaces, and material storage and handling will be controlled by periodic applications of
water.
• Fugitive dust from construction vehicle traffic on paved surfaces will be minimized by periodic
cleaning of the paved road surfaces near the construction area.

• The design of the compressor engine includes a catalytic converter to control criteria air pollutants
including oxides of nitrogen (NO,), Carbon monoxide (CO), and non -methane -ethane volatile
organic compounds (VOC). An application for an air quality construction permit for the initial
compressor station engine has been filed with CDPHE. Approval of the permit is pending. The
construction permitting process addresses general operational compliance criteria for the
compressor engine. The permit will ensure that any operational air emissions will comply with
Colorado air quality rules.
• Tailpipe emissions from diesel -fueled earthmoving and construction equipment may result in a
temporary increase in emissions of air pollutants at the location of the compressor station.
(4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it does not emit
heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or
which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective
painting of storage tanks, or other such operations which may be required by law as safety or air
pollution control measures shall be exempted from this provision.
Response: The Applicant asserted the following:

■ Heat: The level of heat will be minimal and well below the industrial standard.
■ Radiation: Minimal amounts of radiation will occur during construction of the project. Once the
project is in operation, there will be no radiation resulting from the project.
■ Fumes: An application for an air quality permit for the initial compressor station engine has been
filed with CDPHE. The permit review and issue process ensures that any operational air emissions
form the compressor engine would comply with Colorado air quality regulations. The Applicant
shall submit an application to CDPHE for the second engine prior to installation.
• No flaring of gases will occur and the project does not required aircraft warning signals.
Generator exhaust will be vented through a stack, which creates emissions of particulate matter.
The Compressor will comply with all CDPHE air permitting requirements.
Storage area, salvage yard, sanitary landfill and mineral waste disposal areas:
(A) Storage offlammable or explosive solids or gases shall be in accordance with accepted standards
and laws and shall comply with the national, state and local fire codes and written recommendations /
comments from the appropriate local protection district regarding compliance with the appropriate codes;
Response: The Applicant indicated that the Rifle Gas Plant does not involve storage of excessive amounts
of flammable or explosive solids or gases. The Applicant asserted that since the activity is subject to
potentially hazardous conditions, all applicable safety and emergency policies will be followed.

(B) At the discretion of the County Commissioners, all outdoor storage facilities may be required to
be enclosed by fence, landscaping or wall adequate to conceal such facilities from adjacent property;
Response: No outdoor storage facilities are associated with the Rifle Gas Plant.
(C) No materials or wastes shall be deposited upon a property in such form or manner that they may
be transferred off the property by any reasonably foreseeable natural causes or forces;
Response: No materials or waste are associated with the Rifle Gas Plant that requires disposal.
(D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and the following
standards:
1. The minimum lot size is five (5) acres and is not a platted subdivision.
2. The equipment storage area is not placed any closer than 300 ft from any existing
residential dwelling.
3. All equipment storage will be enclosed in an area with screening at least eight (8) feet in
height and obscured from view at the same elevation or lower. Screening may include
berming, landscaping, sight obscuring fencing or a combination of any of these methods.
4. Any repair and maintenance activity requiring the use of equipment that will generate
noise, odors or glare beyond the property boundaries will be conducted within a building
or outdoors during the hours of 8 a.m. to 6 p.m., Mon. -Fri.
5. Loading and unloading of vehicles shall be conducted on private property and may not be
conducted on any public right-of-way.
Response: The Applicant indicated that there will be no long-term storage of heavy equipment. There are
not residential dwellings adjacent to the subject site. The Applicant indicated compliance with sub-
sections 1-5 above.
(E) Any storage area for uses not associated with natural resources, shall not exceed ten (10) acres in
size. (A97-112)
Response: The Applicant noted that no storage area for uses not associated with natural resources is
planned.
(F) Any lighting of storage area shall be pointed downward and inward to the property center and
shaded to prevent direct reflection on adjacent property (A97-112)
Response: Not applicable. The site is not visible from adjacent properties or uses.
(6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install
safeguards designed to comply with the Regulations of the Environmental Protection Agency before

operation of the facilities may begin. All percolation tests or ground water resource tests as may be
required by local or State Health Officers must be met before operation of the facilities may begin.
Response: The Applicant asserted that the Rifle Gas Plant will preserve the integrity of the existing and
natural drainage patterns. At a minimum, the site will be constructed to control storm water runoff in
excess of historical flows. A drainage plan will be designed for the Rifle Gas Plant. A Phase II Storm
Water Permit has been filed with CDPHE in accordance with EPA's Storm Water Program. No
percolation tests or groundwater resources tests are required.
Section 9.03.05:
Pursuant to section 9.03.05 of the Zoning Resolution:
Any Special Use Permits may be made subject to a periodic review not less than every six (6)
months if required by the County Commissioners. The purpose of such review shall be to
determine compliance or noncompliance with any performance requirements associated with the
granting of the Special Use Permit. The County Commissioners shall indicate that such a review
is required and shall establish the time periods at the time of issuance of a Special Use Permit.
Such review shall be conducted in such manner and by such persons as the County
Commissioners deem appropriate to make the review effective and meaningful. Upon the
completion of each review, the Commissioners may determine that the permit operations are in
compliance and continue the permit, or determine the operations are not in compliance and either
suspend the permit or require the permittee to bring the operation into compliance by a certain
specified date. Such periodic review shall be limited to those performance requirements and
conditions imposed at the time of the original issuance of the Special Use Permit.
Response: Staff is of the opinion that a periodic review for the request Special Use Permit for the
operation of the Compressor at the existing Rifle Gas Plant not be required, since the installation of the
compressor station and engine(s) is part of the existing Rifle Gas Plant which is not required to conduct a
periodic review.
M. RECOMMENDED FINDINGS:
1. Proper posting and public notice was provided as required for the meeting before the Board of
County Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete, that all
pertinent facts, matters and issues were submitted and that all interested parties were heard at
that meeting.

III. RECOMMENDED FINDINGS:

that meeting.
3. The above stated and other reasons, the proposed special use permit has been determined to be
in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of
the citizens of Garfield County.

4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07, 5:03.08 and
9:03) the Garfield County Zoning Resolution of 1978.
IV. RECOMMENDATION:
Staff recommends that the Board APPROVE the Public Service Company Special Use Permit for a
natural gas booster compressor station and compressor engine(s), subject to the following conditions:
1. All representations of the Applicant, either within the application or stated at the meeting before the
Board of County Commissioners, shall be considered conditions of approval, unless specifically
altered by the Board.
2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution
of 1978, as amended, and the Colorado Department of Public Health and Environmental standards.
3. The natural gas booster compressor station shall comply with all State and Federal regulations and
standards, such as Noise Abatement and Air Quality.
4. The Applicant shall comply with the Garfield County Noxious Weed Management Plan. Weed
management shall take place on the entire property.
5. The installation of the second compressor engine shall required applicable building permits. Prior to
installation of the second compressor engine, an air quality permit shall be submitted and obtained by

6. An application for an air quality construction permit for the second compressor engine, prior to its
installation, shall be submitted and approved by the Colorado Department of Public Health and
Environment.
7. At the time of building permit submittal, the following shall be submitted for record:
A. A copy of the EPA Phase II Stormwater permit shall be submitted for record.
B. A drainage plan.
8. The following commitments shall be adhere to:
A. Building lighting, inside and outside, shall be manual. Lights shall be positioned downward to
minimize glare.
B. The exterior color of the structure shall blend with the surrounding environment.
C. Emergency signage shall be posted 'and comply with County sign regulations.
D. Fugitive dust shall be maintained.
