APPLICANT: Martin Yenter LOCATION: Located south of the Town of Silt. 0604 Mineota Drive, known also as Lot 5, Mineota Ridge Estates Subdivision Filing No. 2. SITE DATA: Approximately 10 acres ACCESS: Mineota Drive via CR 331 WATER: Central SEWER: Proposed ISDS EXISTING ZONING: A/R/RD L RELATIONSHIP TO THE COMPREHENSIVE PLAN According to the Garfield County Comprehensive Plan of 1984, this site lies in "District B — Subdivisions / Rural Serviceable Areas / 0 to 1/2 Mile Radius". District B is described as having a good ability to absorb growth. The suggested density is no more than one (1) dwelling unit per two (2) acres (unless an adjacent subdivision has a higher density, in which case it may be increase, subject to certain parameters). II. DESCRIPTION OF THE PROPOSAL 1. Site & Project Description: A single family home and garage occupy the site. If approved, the garage will contain an 800 square foot guest house. HI. MAJOR ISSUES AND CONCERNS A. Zoning: An guest house is a special use in the A/R/RD zone district pursuant to Section 3.02.03 of the Zoning Resolution of 1978, as amended. It must meet the 1 of3 • • standards set forth in Section 5.03.025, as follows: (1) The gross floor area or the area used for residential occupancy shall not exceed one thousand (1,000) square feet; (2) The minimum lot size shall be fifty percent (50%) larger than the minimum required for a residential use in the same zone district; and (3) The length of stay of a guest shall be limited to thirty (30) days, unless said guests are the grandparents, parents, siblings or children of the occupants of the primary structure. (A. 81-263) The proposed finished floor area is 800 square feet. The lot exceeds the minimum lot size standard. The application states that the structure will be used for occasional out of town guests and that no extra vehicles will be accessing the site on a daily or weekly basis. B. Conditional and Special Uses: Special Uses are subject to the standards set forth in Section 5.03 of the Zoning Resolution. This section states that utilities adequate to provide water and sanitation service, street improvements, and design of the proposed use to minimize impact through various means shall be provided. Utilities are discussed elsewhere in this report. No street improvements are anticipated. The large lot size minimizes any impact to adjacent properties. C. Access: Access will be provided via a driveway extending from the dwelling unit to Mineota Drive. c6, Water: The Mineota HOA has stated (in a letter dated 3/1/00) they will supply water to the guest house if it is metered and paid for. D. Sewer: The existing home is served by an existing ISDS, The new guest unit will be served by a new ISDS. The applicant shall meet the Colorado Department of Public Health ISDS standards. No other State and Local health standards are applicable to the application. 1V. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 2 off • • 3. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. V. RECOMMENDATION Staff recommends APPROVAL, with the following conditions: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended, and shall meet all building code requirements. 3. That all State and Local health standards be met and that the applicant acquire an adequate ISDS permit at the building permit stage. 4. That the gross floor area of the guest house shall not exceed 1,000 square feet and that the length of stay of a guest shall be limited to thirty (30) days, unless said guests are the grandparents, parents, siblings, or children of the occupants of the primary structure. 5. That the guest house shall not be conveyed as a separate interest or leased. The primary purpose of the guest house shall be to provide temporary quarters for guests. 6. That it is the applicant's responsibility to comply with any applicable Mineota Homeowners' Association rules. Page 3 of 3
