HomeMy WebLinkAbout5.0 Resolution 2002-371111 11111 11111111111 11111 mil 11111111111 1111 1111 )1419 04/16/2002 01:21P B1346 P658 M ALSDORF of 4 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday , the 15 t h day of April A.D. 20 02 , there were present: John Martin Larry McCown Walt Stowe Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2 0 0 2-37 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION OF A GUEST HOUSE FOR JANE BAKER VEIT LOCATED AT 1426 COUNTY ROAD 107. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Jane Baker Veit, for a special use permit to allow for approval of a guest house within the A/R/RD zone district; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a public hearing on the 1st day of April, 2002, upon the question of whether the above described guest house should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners; 2. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the guest house Special Use Permit is hereby approved subject to compliance with all of the following specific conditions: A. All items indicated in the staff report, recommended by the Board of County Commissioners, and included by the Board of County Commissioners at the public hearing as itemized below: 1. All representations of the applicant made in the application and during the public hearing shall be considered conditions of approval. 2. The applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended, and shall meet all building code requirements. 3. That the following information must be provided prior to issuance of a special use permit: 1) That a four (4) hour pump test be performed on the well to be used; 2) A well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; 3) The results of the four (4) hour pump test indicating the pumping rate in gallons per minute and information showing drawdown and recharge; 4) A written opinion of the person conducting the well test that this well should be adequate to supply water to the existing home and a guest house; 5) An assumption of an average or no less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day; 6) The water quality be tested by an approved testing laboratory and meet State guidelines concerning bacteria, nitrates and suspended solids. 2 I 1 111111 1101 111111 11111 11111 11111 in pi 1111 1111 601419 04/16/2002 01:21P B1346 P6 M ALSDORF 3 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO 4. That all State and Local health standards be complied with; The applicant shall provide a qualified engineer's opinion as to whether the ISDS is sized appropriately for the existing house and the guest house prior to issuance of the special use permit. If necessary, a new ISDS shall be constructed prior to occupancy of the guest house. 5. This approval shall be valid until 04/01/03. If the applicant fails to meet these conditions by 04/01/03, and subsequently the special use permit is never issued, the approval shall be automatically revoked, unless an extension is granted by the Board of County Commissioners. 6. Proof of a legal water source for the guest house must be deemed in writing by the Division of Water Resources. Dated this 15th day of April , A.D. 20 02 .
