Dear Brad & Flynn:
This letter is provided to you as the owner's representatives for the Goldstein
application for an amended Final Plat for Lots 29 and 30 Roaring Fork Mesa at
Aspen Glen, Filing No. 2. The Application requested elimination of the common
lot line and combining the lots on those properties also known by Assessor
Parcel Numbers 2393-191-01-033 and 2393-191-01-034.
Your Application has been reviewed in accordance with the Administrative
Review procedures contained in Section 4-103 and 4-101 of the Unified Land
Use Resolution of 2008 as amended (ULUR). Said provisions require a Decision
by the Director of the Cornmunity Development Department on whether to
approve, approve with conditions, or deny the request.
A decision is hereby issued regarding your Application for an Amended Final Plat
for Lots 29 and 30 Roaring Fork Mesa at Aspen Glen, Filing No. 2. The
Director's Decision is to approve the Application including a finding that the
application meets the requirements of the Garfield County Land Use Resolution
of 2008 as in effect at the time of submittal subject to the following conditions:
1. That all representations of the Applicant contained in the Application
submittals shall be conditions of approval unless specifically amended or
modified by the conditions contained herein.
2. All requirements from the County Surveyor shall be met prior to submittal
of the plat for final execution.

3. The Plat including easement vacations shall be subject to final review and
approval by the County Attorney's Office prior to submittal of the plat for final
execution.
4. Utility locates on the site have been completed. Prior to recording of the
Plat, the Applicant shall contact Xcel Energy in accordance with their email —
letter dated June 5, 2013 to review the utility location information and confirm that
the utility locates do not show anything within the easement.
5. The Plat shall include a plat note indicating the purpose of the amended
plat to be the combination of Lots 29 and 30 and an adjustment to the building
envelope for the combined lot. A plat note shall also be included indicating that
all previous plat notes set forth on the Final Plat of Roaring Fork Mesa at Aspen
Glen, Filing No. 2, recorded at Reception No. 516965 and any amendments
thereto shall remain in effect.
6. The Amended Plat shall be subject to compliance with the Aspen Glen
Homeowners Association approval letter dated 5/23/13 and email attached as
Exhibits A & B.
The ULUR requires notification to the Board of County Commissioners for their
review and potential call-up of the application for a public hearing. The Board
review is for a period of 10 calendar days commencing on the date of the
Director's Decision. The call-up period shall expire on August 2"d. The Amended
Final Plat will be scheduled on the Board of County Commissioner's consent
agenda after expiration of the call-up period and once all conditions of approval
have been satisfied.
