PROGRESS REPORT FOR THE REVEGETATION OF WEST FOUR MILE HILL July 30, 1996 INTRODUCTION The purpose of this report is to document the progress of revegetation on West Four Mile Hill during the second year after planting. This report includes a review of the project's compliance with the revegetation performance standards and recommendations to meet the performance criteria. SUMMARY OF FINDINGS De Leuw, Cather staff walked West Four Mile Hill on July 17, 1996 noting the number and species of surviving shrubs, the density coverage of grasses and erosion or weed problems. Objectives set forth in the performance standards provided criteria to measure the progress of revegetation. Performance Standards: - "Revegetation will be considered successful when seeded plant species are established, woEds are a minimal threat, other desired vegetation is invading into the disturbed area, and it meets the objectives given for the reclamation of the areas disturbed by the pipeline construction." Perfo rm an c e Sta n d a rds O bjectives : . Erosion is controlled to the background levets shown on the adjacent undisturbed areas. Erosion was controlled in all areas except at Waterbars #24, #26, #27 and #28 near the power line access road. . Noxious weeds are controlled though the establishment of perennial vegetation. Grasses are dominating all areas of the easement except at the bottom of the slope. Yellow Sweetclover is covering these areas slowing the progress of grass establishment. Thistle is growing in scattered clumps on the berm and on the slope above it. c Plant species that are seeded, shall be estahlished to allow a cover density of herbaceous vegetation, equal to or greater than So%i of the cover density of the herbaceous vegetation of the adjacent undisturbed area. The right-of-way has filled in with grasses and is filling in from the edges with new plants coming up from undisturbed root-mats. Grass covers all areas to a cover density of 90% except near Waterbar #20 (a steeply graded slope with 30% grass cover density) and at the bottom of the slope where sweetclover and thistle have invaded to be the dominant cover type. . The visual contrast between disturbed and undisturbed areas is minimized. This can be achieved by re-establishing ground covers, shrubs and trees of the same native plant species as found on the disturbed areas next to the right-of-way. lf less than 5O%o of the shrubs planted survive after a three year period, KN Energy will replace any plants that have died up to 5O% of the total number planted. Revegetation Progress Report - FouR MILE HILL July 3O, 1996 ,l The project has met the required 50% shrub survival rate. At least 54% of the Gambel,s,oak and serviceberry planted in waterbars and contour ditches are alive and well. Waterbars close to the bottom of the hill, #1 through g, and contour ditches A through E have an exceptional survival rate of over 70Yo. RECOMMENDATIONS Control spread of canadian thistle with spot applications of herbicides (Banvel or Telar) in the fall and spring. Monitor the control of these weeds for the next 5 years. Repeat herbicide treatment until grass and shrubs dominate all disturbed areas. Control of sweetclover is very difficult because there is grass growing under the weeds, making control with herbicides difficult without adversely effecting the grasses. Sweetclover is also growing in undisturbed areas next to the pipeline easement. Sweetclover, because it is an annual could most likely be controlled by mowing or pulling the plant early in the spring before it has had time to drop seed. Repair gully erosion at Waterbars #24, #26, #27 and #28 near the power line access road. Repair water bar where water has broken through. Add straw bales to divert water toward the waterbar ditch. Add bales at the end of the ditch to slow water flow thus minimizing gully erosion in undisturbed areas and along the access road. PROJECT BACKGROUND Duringthesummerandfall of 1994,KNEnergy, lnc.installed a1l-inch natural gaspipelineonthewest and east hills facing Four Mile Creek. The pipeline was constructed as an underground utility within a 50- foot wide easement crossing Bureau of Land Management (BLM) lands and private properties. Pipeline construction required clearing the easement of all trees, shrubs and ground cover before grading and trenching. The dense cover of Gambel's oak and serviceberry was removed, exposing a light iotoreOdirt stripe up the wooded hillside. The stripe could be seen from County Road 127 and a number of homes in the valley. In response to complaints from residents and a request from BLM, KN Energy asked revegetation specialists from De Leuw, Cather & Company to prepare a revegetaton plan for the west hillside. The plan and its performance standards were the result of numerous meetings with BLM staff and a CitizensAdvisory Committee during the summer of 1994. Revegetation activities included planting and transplanting seedlings of Gambel's oak, serviceberry and other native plants; spreading grass seed, and installing erosion control measures on the steep slope. A copy of the performance standards is attached to this report. REVEGETATION METHODS Erosion Control Measures: A total of 31 waterbars and 14 contour ditches were constructed to prevent gully erosion and capture surface water for use by plants installed along waterbar ditches. Waterbars were built to capture, slow and divert water off of the right-or-way. Contour ditches are v-shaped ditches built in the middle of the slope to hold water but not divert it. Waterbars were armored with large boulders to discourage access on the pipeline easement by ATVs or four-wheel-drlve vehicles. for KN ENERGv, lNc. July 3O, 1996 1) 2) Native Shrub Planting Methods: Native species of Gambel's oak and serviceberry were planted along the waterbars and in contour ditches to reduce the visual contrast between disturbed and undisturbed areas. Three different sizes of plants were installed dependent on the planting location of the hillside: 5- gallon containers, 2-gallon containers, and tubelrng sized containers. Larger plants were placed near the bottom of the slope where they would be more visible to residents and motorists. Small oaks and junipers were transplanted from areas next to the easement, onto waterbars and contour ditches. The process involved trenching along each side of the oak, scooping it up with a track-hoe bucket, and immediately placing the plant in its new location. The moving distance was about 1S-feet, equal to the length of the track-hoe's arm and bucket. Special Techniques for Visual Mitigation: The base of West Four Mile Hill required special treatment because it was adjacent to valley residents. A 4-foot high berm was graded into the existing undisturbed slopes. Three 5 to 6 foot tall Utah junipers were placed on the berm to screen views to the pipeline easement. This is the only location junipers were planted on West Four Mile Hill. A temporary, gravity fed irrigation system was set up to water all plants as they were installed. The system was moved up hill as planting progressed. No additional irrigation was done after the initial planting. All plants were installed with fertilizer tablets and a synthetic humectant in the backfill mixture to help retain water in the plant root-zone. Plants were sprayed with a game repellent in an effort to minimize browsing by deer and elk. At the berm, weed barrier mats were used to cut down competition from weeds and retain as much moisture as possible. This material was used as far upslope as quantities would allow. Seeding Methods: The final step of the revegetation process, after earthwork and planting was complete, was to seed the right-of-way. Seeding was done with a predetermined seed mix called out in the Environmental lmpact Statement (E.l.S.) for this pipeline. The mix included western, slender and bluebunch wheatgrasses, indian ricegrass, small burnet, prostrate summer cypress, founruing saltbrush, and big sage brush. The seed was spread with hand-held rotary seeders at a rate of 9.3 pounds of pure live seed per acre. The seed was then raked into the soil and slash was spread out to cover the new seed. Upon laying the slash, West Four Mile Hill revegetation activities were complete. Growing Conditions Forthe first growing season in 1995, weatherconditions were excellent. Spring rains continued through early summer providing consistent moisture to germinate grass seed. Snowfall was good during the winter of 1995-96. To date, the weather during the 1996 growing season has produced less precipitation than the 1995 season. prepared by DE LEUW, CATHEF, e for KN ENERGY, lNc.July 3O, 1996 Typical landscape maintenance activities were not performed on the pipeline right-of-way. The berm was the only area to receive additional irrigation water (by truck) during the summer of 19g5. Present Conditions Arevegetation inspection was performed on July 17, 1996. The right-of-way has filled in with grasses to a cover density of 90%. Grass establishment was less successful near water bar #20. This is probably due to this south facing slope receiving more sun and the soil drying out at a faster rate. Two other areas where grass establishment is poor is at the berm and near water bar #10, where the ground was severely disturbed from a deep bench cut. Yellow Sweetclover, an invasive weed is slowing grass establishment. lt is thriving on the undisturbed outlying areas adjacent to the pipeline right-of-way. Sweetclover has invaded the rightof-way at these two locations and is the dominant plant cover specie!. Grasses have established themselves as an under story. Over time grasses will most likely out compete Sweetclover. Because Sweetclover is an annual, it could be controlled by pulling the plant early in the spring before it has had time to drop seed. New oaks are sprouting from undisturbed root-mats. Nursery stock planted in water bars ahd contour ditches are also well established. The attached spread sheet gives a detailed survival rate of planted stock by location and general comments on the easement condition. Five of the seven transplants have survived and are healthy. Performance Standards Based on the agreed to performance standards stat0d earlier in this document, the revegetation effort has met the criteria to this point with a survival rate of nearly 54o/o. A close look at the attached spread sheet shows that water bars #1 through 9 and contour ditches A through E had an exceptional survival rate of over 70o/o. These locations where closely mapped to show where and how many plants were installed. These locations are also believed to be a more accurate representation of the revegetation success rate of the overall length of Four Mile Hill. One factor that was not included in the attached spread sheet quantities was that of the number of volunteer oaks, serviceberry and rose growing from undisturbed root mats on the easement. This property and eguipment will be the beginning point of a pipeline project that Garfield count.y recently issued a specj-a1 use permit for (Rif1e/avon L2,, pipeline). This facili-ty was designed under 49 cFR, ch. 1-, part 192 and with therecognition of t.he fact that. there would be numerous "suppliers" of gasinto t.he pipeline with differing volumes and varying amounts of waLervapor, liguids and oEher deleterious matter ftowing in t.heir gas. Toprotect pipeline operations, and subsequent customer serviee, the scopeof t.he inret, facilities was designed to incrude gas filtrat,ion andliguids separation, vorumetric and t.hermal measurement, dehydration,outlet gas odorization and the infrastructure need.ed to support andcontrol these operations. upon further investigation of the pipeline gas supplies, it was foundthat certain portions of the inret gas wirl have a hydrocarbon composition with the potential- to ,,cond.ense" to liguid once deriveredinto customer distribution operations. As a result, the inletfacilities have been expanded to include addit.ional gas conditioningeguipment (a gas plant) which will refrigerate t.he gas, condense and remove the unwanted port.ion and eLiminate this concern. Many residents of the area are very concerned about the damage that is occurring as a result of this project and I would expect that this level of concern will continue from other parts of the county as the project moves forward. As you know, nearby property owners did not receive notice of the proposed project and therefore did not provide input during the period of public comment. However, following review of the plans submitted by Rocky Mountain Natural Gas, I seriously doubt that any reasonable person would have strongly opposed the project. The description of the effort which was to be implemented to minimize visual and environmental damage that is stressed throughout the plan is significant and would satisfy the concerns of most people. Examples include statements such as: "...will trim trees in preference to cutting trees, and will cut trees in preference to bulldozing. ... Ihese techniques will be used in combination to produce a natural looking or feathered edge appearance rather than a strai ght-l i n ed ap pearan ce." "Vegetation - creis will remove vegetation only above the trench ... This method of limiting the complete removal of vegetation improves the success of rehahilitation. ... Thus, the opportunity exisfs for many plants to recover by re-sprouting ... Also, the undamaged roofs help hold the soil, decreasing the potential for erosion. ..." I have talked with one of the company's construction supervisors and he has advised me that at no point along the project have the above techniques been employed. ln fact, he told me that he has never seen the Plan of Construction document and has never been instructed by the company to employ any measures of this type. The company's total disregard for any action to minimize damage is exemplified throughout the work completed to date and occurs on both public and private land. Additionally, the company also appears to be regularly working outside of its right-of-way and appears to occasionally arbitrarily pick the easiest route up a particular hill. There are many other inconsistencies between the plan documents which you based your approval upon and the actual practices which are currently occurring. I do not feel that any private developer or property owner would ever be allowed to continue a project which is so totally out of compliance with the provisions of the documents upon which approval was based. For good and sufficient cause Grantor may, at any time, require Grantee to relocate such portion or portions of Grantee's right-of-way by giving Grantee at least ninety (90) days prior wriffen notice of such requirement, and by amending the foregoing legal description, reflecting such change, but with the understanding and agreement by the parties that such new and different course will cause the Grantee the least hardship of any alternate course available. This relocation provision shall apply only during such time as Grantor is the owner of the underlying fee. 9. In the event of termination, Grantee, at its own expense, shall remove all appurtenances from the property which it has installed and shall return the property, as nearly as is practicable and to Grantor's satisfaction, to the condition of the property existing immediately prior to Grantee's first use, including revegetating all areas where vegetation existed prior to the construction on the subject right-of-way. Revegetation shall consist of local native plants and grasses as specified in writing by Grantor 10. If the property is used by Grantee for any purpose other than that stated herein, this right-of-way may be terminated as provided in paragraph 11. 11. DEFAULT. In the event of default by either party under the terms of this agreement, notice of such default shall be given in writing by the non-defaulting parry to the defaulting party as provided in paragraph 2. If such default is not cured within ninety (90) days of receipt of written notice of default or the party in default has not begun curing the default within said period and continued to pursue curative action with due diligence, the agreement may be terminated by the non-defaulting parly by giving wriffen notice of termination, given in the manner provided in paragraph 2, effective thirty (30) days from the date of mailing of the notice of termination. 12. Grantee agrees that no vegetation will be destroyed except within the immediate right-of-way area and that all excavations or other temporary removal of soil as required for proper installation, use and maintenance of the right-of-way shall be immediately replaced and reclaimed including revegetation to the satisfaction of the Grantor. Grantee shall be responsible at all times for the immediate repair and restoration of the right-of-way area and for any damage to the properry due to the construction, reconstruction or maintenance of Grantee's facility.
