Ata regurar meeting of the Board of County Commissioners lor Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on Mondav the lst day of Auqust A.D. 19 94 , there were
present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. e4-oel
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION FOR ROCKY MOLINTAIN NATURAL GAS.
WHEREAS, the Board of County Commissioners olGarfield County, Colorado, has received
application from Rocky Mountain Natural Gas lorconstructing a natural gas transmission pipeline
on the following described tracts ol land:

(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public hearing on the l6th day of May 1994, upon the question
ofwhether the above-described Special Use Permit should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions regarding the
issuance olsaid Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
alorementioned hearing, has made the following determination of fact:
l. That proper publication and public notice was provided as required by law for the
hearing belore the Board of County Commissioners.
That the hearing belore the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.

3. That the application is in compliance rvith the Garfield County Zoning Resolution of
1978, as amended.
4. For the above stated and other reasons, the proposed use is in the best interest of the
health, salbty, mortls, convenience, order, prosperity and wellare of the citizens of
Garlleld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Spe,cial Use Permit be and hereby is authorized permitting the construction
of a natural gas pipeline, upon the lollowing specific conditions:
l. All proposals of the applicant shall be considered conditions of approval unless stated
otherwise by the Board of County Commissioners.
2. The applicant shall have 120 days lrom the date of the Resolution of Conditional
Approval to meet all conditions set lorth in the Resolution. The Special Use Permit
shall be issued when all conditions are met and shall expire 120 days alter issuance,
un-less construction or use have commenced.
3. A1l revegetation shall be in accordance with the revegetation agreements approved by
each property owner. All revegetation shall beconducted with certified weed-free seed.
Rocky Mountain Natural Gas shall be responsible lor weed control in accordance with
State and County regulations.
4. The applicant shall submit hnal easement agreements orevidence olhnzul condemnation
proceedings prior to construction on properties that still require such agreements.
5. Utility crossing agreements shall be obtained from the Garfield County Road and
Bridge Department prior to any crossing of a County Right-of-Way.
6. Contact County Road & Bridge Department regarding any County Road closures.
7. The crossing of Four Mile Creek will require a Floodplain Special Use permit.
8. The existing staging area is recognized as pre-existing non-conforming.
