I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District F - River/Floodplain Severe Environmental
Constraints as designated on the Comprehensive Plan Management District's Map.
IL DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject property is located within the Chelyn Acres
subdivision, in the Four Mile Creek drainage. An Assessor's Map identifying
the specific location of the proposed crossing included in the submittal packet
(attached).
B. Development Proposal: The applicant is proposing a crossing of Four Mile
Creek, associated with previously approved portions of a pipeline stretching
from Rifle to Avon. The pipeline will be placed at a minimum depth of 48"
below the creek bottom. All original contours will be replaced following
trenching and installation. The relationship between the project and the
regulated floodplain is shown in the submittal package (attached).
III. MAJOR ISSUES AND CONCERNS
1. Floodplain: The proposed project site is located within the regulated floodplain.
Section 6 of the Zoning Resolution requires an approved Special Use Permit for
any development within a regulated floodplain. The purpose of the Special Use
Permit review is to assure compliance with various applicable state and federal
regulations as well as reviewing technical issues.
As indicated earlier, the pipeline will be trenched under Four Mile Creek, so any
possible modification to the 100 -year base flood level would occur during
excavation and installation. The applicant has indicated that all contours would
be replaced to original condition. A statement from the applicant's engineer also
concluded that there would be no impact to the floodplain (packet attached).
2. Wetlands: The Army Corp of Engineers has issued a nationwide permit allowing
for the discharge of dredged or fill material into "waters of the United States" in
association with utility line backfill and bedding. A February 14, 1994 letter
from the Army Corps of Engineers is included in the packet
IV. SUGGESTED FINDINGS
1. That proper publication and public notice was provided as required by law for
the hearing before the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at the hearing.
3. That the application is in compliance with the Garfield County Zoning
Resolution of 1978, as amended.
4. For the above stated and other reasons, the proposed use is in the best interest
of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
Staff recommends approval of the Special Use Permit based on the following
conditions:
1. All representations of the applicant, either contained in the application or
represented in the public hearing before the Board of County Commissioners are
considered conditions of approval.
3'
All earthwork associated with the crossing shall be returned to natural grade.
