A/I (Agricultural/Industrial) A/I (north, west and east); Town of Silt zoning designation (south) Access is off of County Road 311. I. DESCRIPTION OF THE PROPOSAL: A. Development Proposal: The Applicant requests approval for the storage of a Canberra Concrete Pumping truck and associated pumping equipment within an existing metal structure on the subject property. The company truck is a Ford one -ton with a concrete line pump mounted on the back. B. Site Description: The property is improved with an existing modular, trailer, tack shed and metal shop. The existing modular residence is occupied, however, the existing trailer is vacant. The subject property contains approximately 4.2 acres. C. Background: The property was red -tagged by Steve Hackett, Garfield County Compliance Officer, April of 2002, for the existing metal building and the operation of a business on the subject property. According to Mr. Hackett, the metal structure is currently in compliance with County's building regulations. Staff understands that Canberra Concrete Pumping Company is located and operated out of Glenwood Springs. The truck, and associated equipment (i.e. tools, pump lines, etc.), is stored within the existing metal structure on the subject property. The truck leaves the subject property early in the mornings and returns on site in the evenings. Hours vary. A sign has been installed on the face of the existing metal structure. No sign permit has been issued. Staff understands that the installation of the sign is to provide advertisement of Canberra Concrete Pumping Company in the area. A sign permit has been submitted to the Building and Planning Department, however, this permit will not be issued until approval for the conditional use permit is granted. Staff is not opposed to the Applicant submitting a request for a sign permit, however, the Applicant should be aware that the sign will need to comply with the sign requirements for the A/I zone district. • • Middleton/Grace Conditional Use Permit BOCC —12/02/02 Page 2 D. Zoning: The subject property is zoned A/I (Agricultural / Industrial). The zoning to the north, east and west of the subject property is also A/I. To the south of the subject property, across County Road 311, the zoning is the Town of Silt designation. E. Relationship to the Comprehensive Plan: According to the "Proposed Land Use Districts Study Area 2 & 3" map in the Garfield County Comprehensive Plan of 2000, the subject property is located with the Town of Silt Urban Growth Boundary. The recommended land use for the subject property is "Commercial". F. Road/Access: The site is accessed off of County Road 311. G. Applicability: Pursuant to Section 9.03.03 of the Zoning Resolution, an application for a Conditional Use Permit ("CUP") shall be approved or denied by the Board of County Commissioners after holding a public hearing thereon in conformance with all provisions of the Zoning Resolution. H. REVIEW AGENCY AND OTHER COMMENTS: The application was referred to the following agencies for comments. Comments that were received have been integrated throughout this memorandum where applicable. 1. Town of New Castle. No comments. III. REVIEW CRITERIA FOR CONDITIONAL USE PERMITS Pursuant to Section 5.03.10, uses listed as Conditional under the appropriate Zone District Regulations shall be permitted based on compliance with section 5.03 and elsewhere in the Zoning Resolution. 1. Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Response: There is an existing well on site. The Applicant indicated that water from the well is used periodically for the cleaning of the truck. No sanitation service is required for the storage of the truck and associated equipment. 2. Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. Response: The Applicant indicated that no proposed expansion to the existing access is necessary or requested for the proposed use. • • Middleton/Grace Conditional Use Permit BOCC —12/02/02 Page 3 3. Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. Response: The existing metal structure complies with County building code requirements. The Applicant is proposing to store a company truck within the exiting structure. No complaints from adjacent neighbors have been received regarding the visibility of the metal structure on site. IV. STAFF FINDINGS: 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed Conditional Use Permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application has met the requirements of Conditional Use (Sections 5:03 and 9:03) in the Garfield County Zoning Resolution of 1978. V. RECOMMENDATION: Staff recommends that the Board APPROVE the Middleton/Grace Conditional Use Permit for the storage of a company truck, and associated equipment, within an existing metal structure, subject to the following conditions: 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended, and the Colorado Department of Public Health and Environmental standards. 3. Only one (1) Canberra Concrete Pumping truck with a concrete line pump mounted on the back truck, and associated equipment, shall be stored within the metal structure during all times. • • Middleton/Grace Conditional Use Permit BOCC —12/02/02 Page 4 4. The Applicant shall submit and receive a sign permit for the existing sign. The sign shall comply with County requirements for signs in the A/I Zone District. Shall the sign permit not be approved, the sign shall be removed immediately. • • 11/26/2002
