White and Son Construction, Inc. SW 1/4 NE 1/4, NW 1/4 SE 1/4, Section 17, TGS, R93W, more practically described as a parcel located south of Rifle, off of U.S. Hwy 6 & 24. A 56.5 acre gravel mine operation with a temporary asphalt batch plant. RELATIONSHIP TO THE COMPREHENSIVE PLAN The parcel is located in District F, River/Flood Plain, severe environmental constraints. The proposed use will not have any permanent structures or residences on the property thus no hazard to the health, safety and welfare of the County residents. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is a relatively flat alluvial floodplain that has been disturbed by gravel mining operations. B. Protect Description: The application is for a mobile asphalt batch plant to be located within the gravel pit for a period starting June 1 and ending August 1. The asphalt will be used for the Mamm Creek Interchange project. The batch plant has an initial emission control permit from the Colorado Department of health (No. 83 WE 334P). The proposed plant is a "state of the art" plant with a wet scrubber. There will be wet wash ponds required to operate the plant. All contaminants from the ponds will be removed and trucked to an appropriate disposal site. The site will be rehabilitated after completion of the project. Asphalt will be trucked from the site via U.S. 6 & 24 to 1-70 and then to the site. There will be 10 round trips per day, 5 days a week, between the hours of 7 a.m. and 6 p.m. III.MAJOR ISSUES AND CONCERNS A. Zoning: An asphalt batch plant is special use in the Agricultural/Industrial (A/I) zone district. • • B. Review Agency Comments: 1. The Colorado Department of Health, Grand Junction office, has no relocation permit for the proposed batch plant. Prior to the issuing of the Special Use permit on the property, a copy of the Colorado Department of Health relocation permit should be submitted to the County. C. Staff Comments: 1. The applicant has verbally stated that the plant will operate from 7 a.m. to 6 p.m., five days a week, Monday through Friday. This should be a condition of approval. 2. The applicant has verbally stated that there will be 10 round trip, truck trips per day. Again, this should be a condition of approval. IV. SUGGESTED FINDINGS 1. That the proper publication and public notice was provided as required by the Garfield County Zoning Resolution; 2. That the application meets the requirements of the Garfield County Zoning Resolution; 3. The proposed use is compatible with the uses existing and permitted in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with; 4. That neither the impact on traffic volume and safety or on utilities, or any other impact of the special use will be injurious to the established neighborhood or zone district in which the special use is to be located; 5. That for the above stated and other reasons, the proposed special use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That all proposals of the applicant shall be considered conditions of approval, unless otherwise stated below; and 2. That the permit shall be valid for the period of time between June 1, 1934 to August 1, 1984, only; and 3. That the asphalt batch plant will operate only between the hours of 7 a.m. to 6 p.m., Monday through Friday; and 4. That not more than 10 round trip, truck trips per day for the hauling of asphalt will be allowed; and 5. That prior to issuance of the Special Use permit; a copy of the approved Colorado Department of Health relocation permit for the plant in question will be provided to the Department of Development. 7
