HomeMy WebLinkAbout1.0 CorrespondenceMonday, January 12, 1976 The regular meeting of the Board o C110 ' Commissioners was held beginning at 10:00 on January 12, 1976, there being present Commissiners ynn Hill and Flaven Cerise, and Administrative ssistant Eshter Piper. Commissioner Pete Mattivi as excused to meet with the Governor's Energy Council. Mr. Cerise moved approval of the m nutes of December 19, 22 and 29 meetings. Seconded by Mr. Hill. Motior carried. County business discussed in the b -lance of the morning. Adjourned for lunch. Reconvened at 1:30, there being present County Attorney Jerr Hartert. Al Herring appeared for the public hearing on a zone change request. Bob Witkowski, County Planner, pre- sented proof of publication of not'ce of the meeting. Adjacent land owners were all advised. All legal requirements had been met. Mr. Wi kowski reviewed the request and discussion of the Planning Commission and their recommendation that it b approved. There were no letters of support. There was a letter from the Town of Carbondale in oppositio . There was a letter from William Crymble, who owns land further up the road, requesting it be zoned co mercial-limited. Arguments against the zone change is that it would be strip zoning. For it, was the fact that the 1968 General Plan showed commercial development in this area. Mr. Witkowski stated that he felt this would complete zoning in this area unless conditions changed. Mr. Herring had a petition of land .wners with no objections. Charles Post represented Union Oil, who owns property across the road from the a.plicant. They have no objections to this request, but at some future date they may want to use this plat- for some development that would call for some change and would want it to stand qn its own merits at th- time. Mr. Cerise moved adoption of the resolution to grant the zone change. Seconded by Mr. Hill. Moti.n carried. Mr. Cerise moved approval of the ap.lication for renewal of a liquor license for the Parachute Co. as the liquor inspector had approved using the form for new applicants. Seconded by Mr. Hill. Motion carried. Bob Witkowski presented an agreemen with the U.S. Forest Service to do the Wildfire Hazard Area mapping under the 1041 program. Mr. Cerise moved the Chairman be authorized to sign the agreement. Seconded by Mr. Hill. Motion carried. The public hearing continued from D cember 8, 1975, was held on the application for a Special Use Permit for Occidental Oil Co. Present for Occidental were Bill Nelson, Bruno Lukens, Randy Chew and Les Bender. Mr. Hill read the minutes of Januar 5, 1976, where the Building Inspector and Sanitarian reported that all fourteen counts on which Occide tal was not in compliance had been cleared up. Mr. Witkowski reviewed the application for dumping 8,000,010 cubic yards of spent shale. Problems discussed with the state in- cluded water quality, wildlife spec es, if the site would be stable, dust, etc. Randy Chew stated that since April 1974, they have expande. to 230 employees; 311 live in Garfield County; payroll is $1,300,000; basic mine development is complete. The next logical step would be to develop a full size retort and this is what the request is for --so they can dump the spent shale from the full size retort operation. If this process works, it will be a practic-1 demonstration. He complimented Mr. Witkowski and Mr. Milner for their professional,attitude. Mr. Witkowski recommended approval subject to the following conditions: 1. The current monitoring pro ram now being carried out by Occidental in Roan Creek, Logan Wash and Dry Gulch, with respect to water qu'lity, be continued. In addition, the following programs be undertaken: monitoring the water quality in the aquifer which exists below the area of Dry Gulch affected by the raw oil shale; a yearly photo series ac oss the pile as it builds up; a stream survey profile of Logan Wash, and at completion of the raw shale 'ile monitoring any build-up of groundwater within the pile itself. Data compiled in the past in the mo itoring program and in the future be supplied to Garfield County and be kept on file with the special us file. 2. For the purposes of this p rmit, the baseline water quality from which to judge any effects of the raw shale pile is considered to be he current water quality in Roan Creek, Logan Wash and the affected groundwater aquifer. Current water quality will be indicated by the most recent analysis that are a part of the current Occidental monitorin program. The baseline water quality standard of the aquifer shall be supplied as soon as it is possible o extract a representative water sample, which shall be extracted within 90 days of this date. If th- raw shale pile is found to degrade the water quality of the area through the monitoring program, the a suspension of the permit shall take place until mitigating action is taken to relieve the situation. Approval of the special use permit is conditioned upon the final estab- lishment of the baseline water qual-ty. 3. Upon completion of the raw shale pile, re -vegetation take place in order to restore the vegetative cover to a condition similar and co patible with comparable natural talus slopes in the vicinity. Mr. Nelson stated that he had read tie conditions that were in addition to what they had agreed to do with the application. His only concern was that 90 days would not allow them enough time. It was agreed to change that to 120 days. Charlie Post of Union Oil stated tha Occidental is in a critical stage. "A company that will spend the amount of money that they are spending for a process, every government should do all they can to support this type of operation".
