Box 2999, Grand Junction, Colorado Special Use: to construct and operate a mineral waste disposal area This Special Use Permit is in compliance with Sections 4.03 and 7.03 of the Garfield County Zoning Resolution and as per application. Building Permit No. (if applicable): This Special Use Permit is hereby granted , (state whether granted or denied) subject to compliance by applicant with all statements, representa- tions, provisions and conditions set forth in the application and also subject to the following conditions: made by Mr. Witkowski: 1 The current monitoring program now being carried out by Occidental in Roan Creek, Logan Wash and Dry Gulch with respect to water quality be continued. In addition, the following -programs be undertaken: monitoring the water quality in the aquifer which exists below the area of Dry Gulch affected by the raw oil shale, a yearly photo series across the pile as it builds up, a stream survey profile of Logan Wash, and at completion of the raw shale pile monitoring any build-up of groundwater within the pile itself. Data compiled in the past in the monitoring program and in the future be supplied to Garfield County and be kept on file with the special use file. For the purposes of this permit, the baseline water quality from which to judge any effects of the raw shale pile is considered to be the current water quality in Roan Creek, Logan Wash and the affected groundwater aquifer. Current water quality will be indicated by the most recent analysis this are a part of the current Occidental monitoring program. The baseline water quality standard of the aquifer shall be supplied as soon as it is possible to extract a representative water sample, which shall be extracted within 90 days of this date. If the raw shale pile is found to degrade the water quality of the area through the monitoring program, then a suspension of the permit shall take place until mitigating action is taken to relieve the situation. Approval of the special use permit is conditioned upon the final establishment of the baseline water quality. 3. Upon completion of the raw shale pile, re -vegetation take place in order to restore the vegetative cover to a condition similar and compatible with comparable natural talus slopes in the vicinity.
