Gentlemen:
Occidental Oil Shale, Inc. hereby makes application for special use permit, to
use the following land as a parking lot:
A tract of land in Section 9, Township 6 South, Range 93 West
of the 6th P.M., containing 5.25 acres, more or less; beginning
at a point 15.0 feet North of the SE Corner of the NW4NW4;
thence North 755.0 feet, thence West 495.0 feet, thence South
110.0 feet, thence East 237.0 feet, thence South 645.0 feet,
thence East 258.0 feet to the point of beginning.
It is further requested that the duration of this Special Use Permit
be for one year. During that time, Occidental Oil Shale plans to apply
to the City of Rifle for annexation of this property.
Access to this property will be by extension of Howard Street and will meet
county and city road specifications. A plot plan accompanies this app-
lication showing the first phase of use. An area sketch also accompanies
this letter of application.

The stipulations to Special Use Permit No. 131 to construct and operate
a mineral waste disposal area require that Occidental Oil Shale, Inc.
supply you with baseline water quality standard of the aquifer.
An observation well was drilled in the immediate drainage area. This
well has proved to be dry. Therefore, we are forwarding analysis of a
sample taken from another well further down the slope. The well location
is marked on the attached map.
We regret the delay but because of contamination due to drilling methods
and subsequent lack of water in the well a true sample was not collected
as soon as was agreed. Please keep the data confidential.

SUBJECT: Special Use Permit - Rifle

In response to your letter of August 20, 1979, I would like to air the use
of the "Hoffineister property" as a parking facility for employees of the
C -b Project. The plat plan in your hands represents the maximum utiliza-
tion of the first phase of our parking lot development. It does not rep-
resent the number of cars that use the lot at the present time. We do not
foresee this number of cars using the lot before mid -1980. The employees
working at the tract do so on a three shift per day, seven days a week,
schedule so that no more than approximately 50% of the Project staff would
be using the parking lot at one time. In addition, there is a two hour
time difference from the time one shift enters the parking lot to the time
another shift leaves the parking lot.
There are two possible accesses into the lot; from the south, 16th Street
borders the property and to the north, with the construction of a "drive-
way" on the Howard Avenue right-of-way, 20th Street. To lessen the impact
of traffic on 16th Street, we are going to develop the Howard Avenue right-
of-way from the parking lot to 20th Street. With Mr. Merkel's approval, we
will construct a thirty foot wide access between the parking lot and 20th
Street. This access will provide for two way traffic and connects to the
Rifle bypass (20th Street). This will put the traffic flow off the local,
residential arterial of 16th Street and onto the major arterial of the
Rifle bypass, construction of which is scheduled to being in late 1979.
Based on a review of the State Highway 13 Rifle Bypass Plans, this appears
to be the most beneficial access for all parties concerned to the parking
lot.
I reviewed these plans with the Rifle City Council at their meeting of
August 15, 1979 and received their support for this project.
I have instructed the agent for this land sale, Rifle Realty, to furnish
Mr. Merkel, Planning Department Director, with all necessary information
to initiate the annexation process into the City of Rifle. We hope to

have this process completed in a timely fashion. I will be in attendance
at the public hearing scheduled for September 10, 1979 at 11:30 a.m. in
Glenwood Springs to answer any questions that may arise. If you have need

I am writing this letter to inform you that Keith Lindsay of
Occidental Oil Shale has been inquiring of my office the procedural
steps involved in annexing property to the City of Rifle. The spe-
cific parcel in which he is interested is known as the "Hoffineister
property" and is located between West 16th Street and the Public
Service Company Addition,:

AS annexation will• not be completed for several months at
best, Mr. Lindsay is negotiating to begin construction on his park-
ing lot improvements while the land is in the county. However,: if
annexed to the city, use of the land for a parking lot would still
require a special review and public hearing as a conditional use
under commercially zoned land.

Mr. Abplanalp told the Board he had received a letter from the attorney representing Lake Springs, question-
ing the county's position on allowing advertising and contracting for subdivided parcels before the
subdivision process has been completed. Since the question was whether the county would ignore the state law
prohibiting such activity, the Board felt they would have to enforce the state law and directed the
County Attorney to respond to the letter to that effect, and circulate the information to other interested
parties.
John Wix presented the final plat for Panorama Ranch. Mr. Wix said he would like to phase the improvements,
so that when Lots 1-31 are complete, he can sell those lots and then begin work on the remaining lots. This
will require a two-phase subdivider's agreement. Mr. Velasquez moved that the matter be referred to the
Planning Commission for review. Seconded by Mr. Jolley and carried unanimously.
Mr. Baldwin presented a site application for extension of the Grand Valley water line. Since there is no
longer a county sanitarian, it must be approved by the Board of Health. Therefore, Mr. Jolley moved that the
Board of Commissioners convene as the Board of Health. Mr. Velasquez seconded the motion. Carried unanimous
ly. Mr. Jolley moved that the Chairman of the Board of Health be authorized to sign the site application.
Seconded by Mr. Velasquez and carried unanimously. Mr. Jolley then moved that the meeting of the Board of
Health be adjourned. Seconded by Mr. Velasquez and carried unanimously. Mr. Jolley then moved that the
Chairman of the Board of Commissioners be authorized to sign the site application. Seconded by Mr. Velasquez
and carried unanimously.
A public hearing was held on the final plat of Lion's Ridge Subdivision. Present was Ron Liston, planner for
the developer, Allen Storey. Mr. Baldwin pointed out that both wells for the subdivision are off the propert
and there has to be an easement for the wells and the water line. Mr. Liston said that would be taken care
of. Mr. Velasquez moved that the final plat be referred to the Planning Commission. Seconded by Mr.Jolley
and carried unanimously.
A public hearing was held for a special use permit for a parking lot for Occidental Oil, located just north
of Rifle. Present were Assistant County Planner Septhanie Andreasen, and Keith Lindsey and Don Blausman,
both of Occidental Oil. Mr. Lindsey said they have applied for annexation into the City, but need this
parking lot now to provide parking for employees who are bussed to the job site. The City has no problems
with it but request a 60' easement for Hward Avenue. Ms. Andreasen said she had been concerned about
additional traffic on and off Railroad Avenue, but the City planner felt that would be eased by the Highway
13 bypass. Mr. Jolley moved that the permit be granted for a period of one year. Seconded by Mr. Velasque
and carried unanimously.
Mr. Velasquez moved that the Chairman be authorized to sign the following subdivision ekemption resolutions.
#79-102, Allen A. Bowles; 79-103, Andrew Julius; 79-104, William L. Weide and J.B. Dennie; 79-105, James

Mr. Jolley moved that the Chairman be authorized to sign the following resolutions. #79-112, concerning
the zone change for Four Mile Ranch and #79-113, concerning the time extension for Grand Valley Industrial
Park. Seconded by Mr. Velasquez and carried unanimously.

WHEREAS, Four Mile Ranch Company, a Partnership, being the owners of all of the following real
property situate in the County of Garfield, State of Colorado, to -wit:
A parcel of land situated in Section 27, Township 6 South, RAnge 89 West
of the Sixth Principal Meridian, Garfield County, Colorado; said parcel
created by subdivision of a boundary plat of portions of said Section 27
and of Section 34, said Township and Range, dated May 23, 1973, and revised
August 8, 1978, and signed and sealed by Jack W. Johnson, Colorado R.L.S.
84551; said parcel being more particularly described as follows:
Commencing at the South Quarter Corner of said Section 27, thence N.
39 11'02" E. more or less 7695.95 feet more or less to the True Point
of Beginning; thence S. 88024'24" E. more or less 291.37 feet more or

Colorado for a zone district amendment changing the zone district designation for all of said property from

WHEREAS, The Board of County Commissioners of Garfield County, Colorado has in accordance with the
requirements of Section 10.04 of the Garfield County Zoning Resolution referred said application to the
Planning Commission for its consideration and recommendation and;
WHEREAS, the Planning Commission upon consideration of said application has recommended that the
zone district amendment be approved upon the condition that the owner grant an easement thirty feet wide from
the centerline for public road and utilities, and the Planning Commission has accordingly forwarded to the
Board of County Commissioners its recommendation that said application be granted; and
WHEREAS, the Board of County Commissioners has considered said application and the recommendation of
the Planning Commission and held an advertised public hearing on the 4th day of September, 1979, on said
application all in accordance with the provisions of Section 10.00 of said Garfield County Zoning Resolution,
and;
WHEREAS, the Board of County Commissioners has determined on the basis of the evidence presented at
said hearing that the requested rezoning request would be consistent with the Garfield County General Plan,
with the orderly development of the County, and with existing uses in the area, if the condition recommended
by the Planning Commission is made a prerequisite to the effectiveness of the zone district amendment;
WHEREAS, the requested zone district amendment would be consistent with the General Plan for Gar-
field County, Colorado;
