HomeMy WebLinkAbout4.0 Resolution 86-31{ STATE OF COLORADO County of Garfield At a Commissioners Meeting Room the 17th • r )ss regular meeting of the Board of County for Garfield County, Colorado, held at the Commissioners' at the Garfield County Courthouse in Glenwood Springs on day of March A.D. 19 86 , there were present: Larry Schmueser Robert Richardson Flaven .J.- .Cerise Don DeFord Mildred Alsdorf Roger Ludwig when the following , Commissioner Chairman , Commissioner , Commissioner-- r , County Attorney , Clerk of the Board , Administrative Assistant proceedings, among others were had and done, to -wit: RESOLUTION NO. 86-31 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY UNITED COMPANIES OF MESA COUNTY, INC. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from United Companies of Mesa County, Inc. for a Special Use permit for a temporary portable asphalt batch plant on the following described tract of land: A tract of land located in S 1/2, SW 1/4, SW 1/4 Section 29, T7S, R102W, of the 6th P.M. (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 10th day of March, 1986, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special Use permit be and hereby is authorized permitting the use of the above described tract of land for a temporary portable asphalt batch plant upon the following specific conditions: 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board. 2. The applicant, contractor and/or subcontractor shall notify the County Clerk's office and the Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in the operation. 3. The applicant shall comply with all regulations of Garfield County relating to industrial operations in the zone district in which the property is located, and shall construct and operate the asphalt plant in accordance with all applicable State and Federal Regulations, including but not limited to the Colorado Department of Health, Air Pollution Control Division Emissions Permit. 1 4 ZIP_ apD cant,,.„permit,.,.fcola the Hihwd StatAA q' y egaTtmentT rrd�cating"'"f'fi�t`" e�"u'se"o'f'"""tfie' existing access for the proposed industrial use is allowed, and authorizing any upgrading or signage of the access as may be required. 5. That the proposed Special Use permit shall be for a temporary asphalt plant and shall expire on September 30th, 1986, with restoration of the site to be completed within 12 months of the expiration of the permit. 6. Two mobile homes, for use as office space, shall be allowed on the site. The applicant shall apply for all building permits as required by the Chief Building Official. 7. The applicant shall work with Grand Valley Rural Power Lines, Inc. to assure adequate clearance for oversized vehicles under the existing power line on the site. 8. The applicant.:shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall be valid for a period of 120 days from the date of -issuance, and shall expire, unless construction _or use has commenced within this period.
