HomeMy WebLinkAbout2.0 BOCC Staff Report 03.10.1986REQUEST: • • G BOCC 3/10/86 PROJECT INFORMATION AND STAFF COMMENTS Public Hearing request for a Special Use permit for a Temporary Portable Asphalt Plant APPLICANT: United Companies of Mesa County, Inc. LOCATION: SITE DATA: WATER: SEWER: ACCESS: A tract of land located in the S 1/2, SW 1/4, SW 1/4 of Section 29, T7S, R 102W; approximately 3 1/2 miles north of the Garfield County/Mesa County line off of State Highway 139. The site consists of an approximately 5 acre parcel. Water to be hauled to the site. Portable toilets Existing access off of State Highway 139. EXISTING ZONING: R/L, Gentle slopes and valley floor. ADJACENT ZONING: R/L, A/R/RD, and O/S. I. DESCRIPTION OF THE PROPOSAL A. Site Description: The site lies in a rural portion of the County with surrounding land uses of open space and ranching/pasture land. The Young ranch is the nearest dwelling approximately 3/4 mile to the south. The site is relatively level, is fenced, and lies between State Highway 139 and East Salt Creek. B. Project Description: The applicant proposes to operate a portable asphalt plant and related facilities on the site from March 1, 1986 through August 10, 1986. Hours of operation are proposed as 5:00 A.M. to 6:00 P.M., Monday through Saturday, with approximately 25,000 tons of asphalt to be produced for the paving of State Highway 139. II. MAJOR ISSUES AND CONCERNS A. Review Agency Comments: 1. The Colorado Division of Wildlife has commented that "wildlife will not be adversely affected by this special use". (See letter, page g ). 2. Grand Valley Rural Power Lines, Inc. has indicated that power to the site is available. In addition, they have requested review of final site plans and construction once the location of the driveway is established to assure adequate clearance for oversized vehicles under their existing power lines. (See letter, page 7 ). 3 • • B. Staff Comments: 1. The applicant has addressed potential runoff hazards by the proposed use of berms and dikes and adherence to all applicable MSHA and OSHA regulations regarding fuel and asphalt oil storage. 2. The applicant's restoration plans include grading of the site and extension of irrigation water to the site allowing for use as pasture land. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board. 2. The applicant, contractor and/or subcontractor shall notify the County Clerk's office and the Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in the operation. 3. The applicant shall comply with all regulations of Garfield County relating to industrial operations in the zone district in which the property is located, and shall construct and operate the asphalt plant in accordance with all applicable State and Federal Regulations, including but not limited to the Colorado Department of Health, Air Pollution Control Division Emissions Permit. 4. The applicant shall submit a letter or permit from the State Highway Department indicating that the use of the existing access for the proposed industrial use is allowed, and authorizing any upgrading or signage of the access as may be required. 5. That the proposed Special Use permit shall be for a temporary asphalt plant and shall expire on September 30th, 1986, with restoration of the site to be completed within 12 months of the expiration of the permit. 6. Two mobile homes, for use as office space, shall be allowed on the site. The applicant shall apply for all building permits as required by the Chief Building Official. 7. The applicant shall work with Grand Valley Rural Power Lines, Inc. to assure adequate clearance for oversized vehicles under the existing power line on the site. 8. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall be valid for a period of 120 days from the date of issuance, and shall expire, unless construction or use has commenced within this period. • STATE OF COLORADO Richard D.
