There are no requirements for hook-up to a sewage system or construction of leach fields necessary for plant operation. Sewage requirements for personnel will be handled by portable toilets in accordance with applicable state laws. Water No domestic or industrial water systems exist at the proposed site. An existing draw in the vicinity of the site runs water. This water will be used to supply water for construction purposes and to supply the emission control equipment on the plant. Water for domestic use will be supplied in packaged form from a commercial vendor. The entrance to the site is through an existing gate in the fence line. Plans would include widening of the existing access including extensions of the existing culvert pipe. The existing gate would be enlarged and upgraded to allow for two-way traffic. The proposed site access offers excellent visibility both directions of oncoming traffic. Visibility is in excess of 500 feet each way which is adequate for the existing 55 m.p.h. speed limit. IMPACT STATEMENT The proposed use of a portable asphalt a significant adverse of the site for installation production plant will not have effect upon: (A) Existing water will not be affected by depletion or pollution. Surface runoff, stream flow, and ground water will also not be affected. Potential for water runoff concerns will be dealt with by con- struction of berms and dikes. All applicable MSHA and OSHA regulations in regard to fuel storage and asphalt oil storage will be adhered to. All containment vessels will comply with state regulations in regard to safety. (B) Generation of vapor, dust, smoke, noise, glare, or vibration will not exceed state and federal regulations. The asphalt plant is certified for emissions by the Colorado Department of Health. (A copy of the permit is enclosed.) (C) Wildlife and domestic animals will not be affected by creation of hazardous attractions, alteration of existing native vegetation, or blockade of migration routes. The site of proposed use has been, and is currently, fenced which will protect wildlife from contact with production operations. Existing vegetation is wild -15- • 11 grasses. Upon completion of operations, the area is to be graded and made into pasture land to be irrigated ' by extension of an existing irrigation ditch on the adjacent property. (D) Traffic congestion on State Highway 139 will 1 not be increased through the operation of the plant at this site. Truck traffic will be less than or equal to the impact of the construction project if the 11 plant were to be located elsewhere and the material trucked to the project site. ' (E) The reclamation of the proposed site will leave the property in a significantly better condition for use as pasture land than it now exists. Serial number of the equipment must be submitted to the Division prior to final approval issuance. 8. Equipment shall only be operated when connected to scrubber. 9. This source shall be limited to 70 tons per hour and 30,000 tons per year throughput of asphalt and 30,000 gallons per year annual consumption of burner fuel oil. Results of throughput shall be maintained and made available to the Division upon request. The above emission limitations were based on annual throughput submitted by the applicant and emission factors from AP -42. 10. A Relocation Notice shall be filed with the Division if this plant is moved to a new site. 11. Only virgin aggregate is to be used. No recycled material can be used at this facility unless a revised permit is requested and received from the Air Pollution Control Division. 12. A source test must be conducted on this equipment prior to issuance of a final approval permit, unless a Division inspector determines that a source test is not necessary. The Division must be notified 30 days in advance of source test and a Division observer must be present during the test. 13. This permit automatically expires if you (1) do not commence construction by April 26, 1985, (2) discontinue construction for a period of 18 months or more, or (3) do not complete construction within a reasonable time of the estimated completion date. Extensions of the expiration date may be granted by the APCD upon a showing of good cause by the permittee. This permit is issued in reliance upon the accuracy and completeness of information 'supplied by the applicant and is conditioned upon construction, installation andoperation or its in accordance with this information and with representations made by the applicant agents. I2. This permit is valid only for the equipment and operations specifically identified herein. 3. Each and every condition of this permit is a material part hereof and is not severable. Any challenge to, or appeal of, a condition hereof shall constitute a rejection of the entire permit and upon such occurrence this permit shall be deemed denied ab initio. 4. This permit may be revoked at any time prior to final approval by the Air Pollution Control I Division (APCD) on grounds set forth in the Colorado Air Quality Control Act and regulations of the Air Quality Control Commission (AQCC), including failure to meet any express term or condition of the permit. I5. This permit must be retained and made available for inspection upon request at the location set forth herein. With respect to a portable source which is moved to a new 'location, a copy of the revised Air Pollutant Emissions Notice (APEN) (required by law to be submitted to the APCD whenever a portable source is relocated) should be attached to this permit. The permit may be reissued to a new owner as provided in Section III.B. of AQCC Regulation No. 3 upon transfer of ownership. 6. Initial approval of an emission permit does not provide "final" authority for operation of this source. Final approval of the permit must be secured from the APCD in writing in accordance with the provisions of C.R.S. 1973, Section 25-7-114(4)(j) and Section IV.H. of AQCC Regulation No. 3. Final approval cannot he granted until construction is completed and operation and construction have been verified by the APCD as conforming in all respects with the conditions of the initial approval permit. If the APCD determines that the terms and conditions of the initial approval permit have been satisfied, the APCD will issue a final approval permit, which does constitute "final" authority to operate as discussed in Paragraph 6 above. Violation of the terms of a final approval permit or of the provisions of the Colorado Air Quality Control Act or the regulations of the AQCC may result in administrative, civil or criminal enforcement actions under C.R.S. 1973, Sections 25-7-115 (enforcement), 25-7- I 121 (injunctions), 25-7-122 (civil penalties) and 25-1-114 (criminal penalties). 11. Unless specifically stated otherwise, the general and special conditions contained in this permit have been determined by the APCD to be necessary to assure compliance with the provisions of C.R.S. 1973,25-7-114(4)(g) and, as such, shall be enforceable under the provisions of C.R.S. 1973,25-7-115 after final approval of the permit has been 1 granted. This contract shall not take effect or be in force until said Contractor shall have furnished and delivered to the party of the first part a surety bond, acceptable to said first party, in a penal sum equal to the nearest integral $100.00 in excess of the estimated contract price as per "Schedule" hereto attached, duly executed by a corporate surety, qualified and licensed to do business in Colorado and maintaining a general agent therein. It is especially understood and agreed that the Invitation for Bids, the Contractor's Proposal, the Plans, Standard Specifications for Road and Bridge Construction, and Special Provisions, all being applicable to the project and on file in the office of the Division of Highways at Denver, Colorado, together with such alterations and modifications as may be made in accordance with the provisions of said Plans and Specifications, are each and all included in and made a part of this contract. (Also refer to PR 1273 of this Contract). In consideration of the foregoing the party of the first part hereby agrees to pay to the Contractor, according to the requirements of the specifications, the amounts required for the completed -work at the unit prices set forth in the Contractor's Proposal, and such further amounts as may be required for extra work or materials, all according to the provisions and subject to the conditions as set forth in the specifications above referred to. All conditions are to be completed within 120 days of the granting of conditional approval or no later than July 17, 1986. The only remaining condition to be accomplished is the notification to the Garfield County Clerk and Recorder's Office and Assessor's Office regarding the equipment to be used on the site. Please advise this office as soon as notification has been completed. Included in the conditions of approval is the stipulation that the Special Use permit is temporary and to expire on September 30, 1986. If current delays prevent completion of the project by this date, extensions can be requested. However, as the permit and time limiting condition were approved at a public hearing, an extension or modification to the conditions must also be accomplished during a public hearing. As with the original hearing, publication of notice 15 days prior to the hearing date and mailing to adjacent property owners 5 days prior would be required. This public hearing could be scheduled at your convenience, even conceivably at such time as you determine during construction that completion by September 30th will not be possible.
