John Martin Larry McCown Walt Stowe Don DeFord Mildred Alsdorf Ed Green • Commissioners for Garfield County, Garfield County Courthouse, in Glenwood A.D. 19 9 9 , there were present: , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 9 9- 0 9 4 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR THE BULK STORAGE OF PROPANE. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Robert Devan of Propane Services, Inc., for a special use permit to allow for approval of the bulk storage of propane in the Light Industrial (LI) zone district; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a public hearing on the 19th day of July, 1999, upon the question of whether the above described bulk storage of propane should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners; 2. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Propane Services Special Use Permit for the bulk storage of Propane is hereby approved subject to compliance with all of the following specific conditions: A. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. B. All items indicated in the staff report, recommended by the Board of County Commissioners, and included by the Board of County Commissioners at the public hearing as itemized below: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant meet all requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. The entrance to the Mid Con site shall be constructed to be in conformance with all federal, state, and local regulations. The illegal turnout shall be removed immediately and an engineered system that meets traffic safety and emergency access requirements shall be installed prior to issuance of a special use permit. Written approval of the reconstructed access shall be obtained from the County Road & Bridge Department, the Garfield County Emergency Manager, the 911 Communications facility, and from the Fire district. Said written approval shall be supplied to the Planning Department prior to issuance of the Special Use Permit. 4. A hazardous material management plan shall be provided to the Carbondale Fire Marshall, the Garfield County Emergency Manager, the 911 Communications facility, and the Garfield County Planning Page 2 of 3 1 11111111111 HIIM 111111 III 11111 V1111 1111111111111 . .552136 09/14/1999 04 02P B1578 M ALSDORF 3 of 3 R 0.00 D 0.00 GARFIEUNTY CO 1 Department. The plan must be approved prior to issuance of a special use permit. 5. Storage of propane shall be in accordance with accepted standards and laws and shall comply with the applicable national, state and local regulations. Any permits for propane storage must be obtained and provided to the Planning Department prior to issuance of the special use permit. 6. Any building placed on the site must meet the Uniform Building Code adopted by Garfield County.
