• • • BOCC 7/19/99 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: A request for review of a Special Use Permit to allow for storage of propane. APPLICANT: Bob DeVan of Propane Services, Inc. LOCATION: 1058 County Road 100, west of the Town of Carbondale, across from Willow Lane, on the Mid Con site SITE DATA: 38.12 +/- acres with 18,000 sq.ft. leased for propane storage ACCESS: CR 100 WATER: None proposed SEWER: Portable toilet EXISTING ZONING: L/I Light Industrial I. RELATIONSHIP TO THE COMPREHENSIVE PLAN According to the 1995 Garfield County Comprehensive Plan, this site lies in the Light Industrial and Rail Corridor areas. The stated goal of the comp plan is: "[toJ encourage the development of a diversified industrial base for the County which recognizes the human resources, natural resources and physical location -to -market capabilities of the community, and which further recognizes and addresses the social and environmental impacts of industrial uses". The stated policies of the comp plan as it relates to industrial uses are as follows: 4.1 Commercial development will be encouraged in areas where existing infrastructure (water and wastewater facilities) are currently available. 4.2 County zoning regulations regarding industrial and commercial development will be compatible with land use policies of adjacent jurisdictions. 4.3 Landscaping and screening will be required to address specific visual impacts of industrial and commercial development. 4.4 The project review process will include the identification and mitigation of transportation impacts related to commercial and industrial development. 1 of 8 N • The proposal is in general conformance with the comp plan goal and policies with exception to the mitigation of traffic impacts. II. DESCRIPTION OF THE PROPOSAL The existing site is currently used in a light industrial capacity by Mid Continent Resources. The applicant intends to lease about 18,000 sq.ft. of the property for storage of propane. The lease area lies on a natural bench well above the railroad tracks. Mature cottonwoods provide screening of the storage area. The propane would be distributed from this site but would not be sold on a retail basis. The following are proposed to be stored on the site: L Ht.(' - ) • An 18,000 gallon tank (approx. 41'x 6' in size) • Empty tanks of 500 and 1,000 gallons • 100 lb. cylinders • Portable office trailer about 200 sq.ft. in size • Portable toilet • Bulk truck and pickup trucks The applicant proposes to run underground electrical wiring from the existing power lines to operate equipment. A small propane powered generator will be situated for back-up/temporary power. Electricity is needed to run a 1 1/4 horsepower pump inorderto pump propane form a large truck to the 1001b. cylinders and truck. (See J e) HI. REVIEW AGENCIES This application was sent to the following review agencies/departments: • Town of Carbondale- no comment • Carbondale Fire District- has concerns about a hazardous materials management plan and access issues. NFPA 58 -LPG code applies. See letter, page 111 • Garfield County Road & Bridge Department- has concerns about access and a code violation. Comments received via phone are in section E of this report, see photos, page i t.,1-1; 1 C t t) • Garfield County Emergency Management- does not have specific concerns but wants to be sure the Fire District has an opportunity to comment, see memo on page 12 • Roaring Fork Railroad Holding Authority- assumes access will be from existing Mid Con access. Any new access may require a new permit to cross the railroad right of way. See comments, pages,`, • Garfield County Engineer- no comment IV. MAJOR ISSUES AND CONCERNS A. Zoning: The site lies in the L/I Light Industrial zone district. Section 3.12.033, states 2 of 8 • that bulk storage (>2,000 gal) of liquid petroleum gas (LPG) requires a special use permit. Section 2.02.30 states that storage is a industrial operation classification. All industrial operations must meet the standards set forth in Section 5.03.07 and 5.03.08. B. Conditional and Special Uses: Special Uses are subject to the standards set forth c,ppfi Cut k* in Section 5.03 of the Zoning Resolution. Utilities adequate to provide water and d,,j cVC Y<V-A, sanitation service, street improvements, and design of the proposed use to ;y cat 1 minimize impact through various means are specified in this section. Provisions (7 ,� yr : shall be made to comply with these regulations. C. Industrial Operations: All industrial operations must meet the standards set forth in � � �(.0- Section 5.03.07 and 5.03.08. Section 5.03.07 states the following: � (1) The applicant for a permit for industrial operations shall prepare and p v submit to the Planning Director ten (10) copies of an impact statement on the proposed use describing its location, scope, design , F 71)/\- and construction schedule, including an explanation of its operational characteristics. One (1) copy of the impact statement shall be filed with the County Commissioners by the Planning Director. The location and design can be seen on the site plan provided. The scope and operational characteristics have been described in Section II of this report. The applicant plans to enter into an agreement to lease the property pending approval of this request. He hopes to get the business up and running this fall. The impact statement shall address the following: (A) Existing lawful use of water through depletion or pollution of surface run-off stream flow or ground water; The applicant states that "there should be no activity which would impair the water quality". Water quality impairment shall not occur. (B) Impacts' on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations; The applicant states "there should be no activity which would cause any of the listed emanations". These impacts shall not occur. (C) Impacts on wildlife and domestic animals through the creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions; The applicant states "No hazardous impacts are known to be generated by this business. Native vegetation will not be changed. Wildlife will not be impacted. Migration of wildlife will not be blocked". These impacts shall not occur. (D) Affirmatively show the impacts of truck and automobile traffic to and 3 of 8 from such uses and their impacts to areas in the County; The applicant states "there is only one road out of the area. This is County Road 100, which is a paved road and which extends westerly to Carbondale and easterly to Highway 82". He also contemplates that on a daily basis three (3) pick up trucks and one (1) bulk propane truck will access the site. Twice per week one (1) tanker truck will access the site. Little impact is expected to occur. (D) That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s); The applicant states "no damage is known to occur to adjacent property as a result of operations of this nature". The site abuts Mr. Eubank's property to the east. Sufficient setbacks shall be maintained. (E) Mitigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section 5.03.08 of this Resolution The applicant states "none should be needed, except normal signage warning of flammable products, and the site will be fenced to protect against trespass". (2) Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issued; No site rehabilitation plan was provided. In this particular case site rehabilitation is not a foreseen need. (B) The County Commissioners may require security before a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners; No security was provided. In this particular case security is not a foreseen need. (C)Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. (A. 93-061) Section 5.03.08 states the following: Industrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, 4 of 8 i smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards; (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (A. 93-061) The applicant states "equipment used on this operation complies with all state and federal statutes with regard to noise". Adherence to the applicable noise regulations shall be maintained. (2) Vibration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located; The applicant states "no vibrations that would be detectable from any distance are known to occur from this type of equipment". No nuisance vibration shall occur. (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards; The applicant states "machinery to be used complies with all applicable air quality regulations and standards". Emissions shall comply to the applicable regulations. (4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision; The applicant states "no such emanations that would extend to adjoining properties are known to occur with a propane storage facility. Emission of heat, glare, radiation and fumes shall not emanate to adjoining properties. (5) Storage area, salvage yard, sanitary landfill and mineral waste t ()\ disposal areas: (A97-112) (A)Storage of flammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply with the national, state and local fire codes and written recommendations/comments from the appropriate local protection district regarding compliance with the appropriate codes; (A97-112) Page 5 of 8 • • (B) At the discretion of the County Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall adequate to conceal such facilities from adjacent property; (A97-112) (C) No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural causes or forces; (A97-112) (E) Any storage area for uses not associated with natural resources, shall not exceed ten (10) acres in size. (A97-112) (F) Any lighting of storage area shall be pointed douwnward and inward to the property center and shaded to prevent direct reflection on adjacent property (A97-112) The applicant states "N/A". These regulations are applicable. The applicant shall comply with these provisions. D. Fire Protection: The Carbondale Fire Marshall submitted comments in his letter dated 7/2/99 (see page )4). He has requested that a hazardous material management plan be provided in accordance with UFC Section 8001.3.2. Routing should avoid the Town of Carbondale. He has also stated that the access should be in accordance with the UFC 1997 ed. Section 902 with a minimum unobstructed width of twenty (20') feet. His understanding is that the access road will be extended to create a loop road with the adjacent Eubank property to the east. However, no information has been provided to this effect. He also states that water supply for fire protection will be limited to water carried on responding fire apparatus. During the summer months water could be supplied from ditches as well. E. Access: Access will be from County Road 100. The Road and Bridge Department visited the site and observed a code violation. Dirt had been removed from the Mid Con entrance and dumped on the opposite side of the County Road in order to create a turn- out (see photos, page fir)°f ( and letter, page 9 ). The Code Enforcement Officer sent a letter and then contacted Mr. Delaney and Mr. Wardlaw, of Mid Con Resources, on 7/7/99 in regards to the violation. They said they would contact the Road and Bridge department and become compliant. M,TY) . In a phone conversation with the R&B department on 7/1/99, Ken said that the applicant must have a traffic engineer redesign the Mid Con entrance. There is a low spot which needs to be mitigated to ensure adequate site distance. A "Y" type intersection is needed. The Carbondale Fire Marshall has stated that the access should be in accordance with \ the UFC 1997 ed. Section 902 with a minimum unobstructed width of twenty (20') feet.(01 , J His understanding is that the access road will be extended to create a loop road with the adjacent Eubank property to the east. However, no information has been provided to this effect. Page 6 of 8 t IV. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. V. RECOMMENDATION Staff recommends APPROVAL, with the following conditions: 1. To ensure that the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County: That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. Pursuant to Title 30, Article 28, and Title 29, Article 20 of the Colorado Revised Statutes: That the applicant meet all requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. Pursuant to Section 9.03.01 (1), 5.03 (2), and 5.03.08 (5) of the Garfield County Zoning Resolution of 1978, as amended, and Section 902 of the Uniform Building Code of 1997: The entrance to the Mid Con site shall be constructed to be in conformance with all federal, state, and local regulations. The illegal turnout shall be removed immediately and an engineered system that meets traffic safety and emergency access requirements shall be installed prior to issuance of a special use permit. Written approval of the reconstructed access shall be obtained from the County Road & Bridge Department and from the Fire district. Said written approval shall be supplied to the Planning Page 7 of 8 • • Department prior to issuance of the Special Use Permit. 4. Pursuant to Section 9.03.01 (1) and 5.03.08 (5) of the Garfield County Zoning Code of 1978, as amended, and the Uniform Fire Code Section 8001.3.2: A hazardous material management plan shall be provided to the Carbondale Fire -'1 Marshall and the Garfield County Planning Department. The plan must be approved prior to issuance of a special use permit. 5. To ensure that the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County and pursuant to section 5.03.08 (5) (A): Storage of propane shall be in accordance with accepted standards and laws and shall comply with the applicable national, state and local regulations. The applicant is Propane Services, Inc. ("Applicant"), which has received a 90 -day option from Midcon Realty, LLC pertaining to a tract of Midcon property approximately 60 feet x 280/300 ft. westerly of the Unit Train Loadout along the railroad right-of- way and also westerly of the tract leased to Alpine Waste Services. The physical address of the subject property is 1058 County Road 100, Carbondale, Colorado 81623. The 90 -day option is to allow Applicant sufficient time to process this Special Use Permit request and, if approved, then Applicant will enter into a 3 -year lease for the subject property. The written lease agreement will not be entered into pending approval of this application. A copy of the special warranty deed which describes the subject property is attached. Applicant intends to use the premises as a propane distribution point without retail service to the public. The equipment on site would consist of an 18,000 gallon propane tank mounted on skids, smaller propane containers, and propane service and delivery trucks. There will be three pickup trucks and one bulk truck entering and leaving the premises at least once per day and less frequently during summer months. The following are the conditional and special use requirements for Garfield County as applicable to this proposed business use. 5.03 CONDITIONAL AND SPECIAL USES ^ 5e6_, 6_�� ��-H- / '11 6_, rhoC — 1. U and sanitation. No permanent structures will be needed for this business and no utilities, -lect ' •, water, sewer, and the like will be required. There will be one 18,000 gallon storage tank, one 10' x 20' x 8' portable office trailer, and 100 lb. propane cylinders, 500 gallon tanks and 1,000 gallon tanks to be stored empty. 2. Street improvements. Present roads are adequate to provide access to the business and the existing roads on the site are adequate. 3. Project location. The project is distant from any other regular daily use, and should need no special mitigation efforts to protect surrounding activity. 1 6 5.03.07 INDUSTRIAL OPERATIONS A. Existing lawful use of water. There should be no activity which would impair the water quality. B. Generation of vapors, dust, smoke, noise, glare, vibration, or other emanations.
