Resource Natural Gas, Inc. of Houston proposes to construct a gas gathering system to gather gas from the Gasaway Unit in Garfield County, Colorado approximately 32 miles north of Grand Junction, Colorado near the Colorado-Utah border. The proposed gas gathering system will be named for Roan Creek, a prominent local fe a ture along which the existing wells in the Gasaway Unit have been d r illed. The proposed gas gathering system will collect production from the following existing wells at the indicated locations: WELL Sheffield 1-17 Turner 1-27 Tate 1-30 Tate 1-25 Tate 1-26 LOCATION T.6S.-R.99W. Section 17 T.6S.-R.99W. Section 27 T.6S.-R.99W. Section 30 T.6S.-R. lOOW. Section 25 T.6S.-R. lOOW . Section 26 The proposed gas gathering system will deliver the gas from the above wells to Northwest Pipeline's 26" mainline at the Calf Canyon Compressor Station located in T.6S.-R. 104W. Section 34. Additional wells may be connected to the proposed gas gathering system along the route. The north/south segment of the pr o posed gas gathering system will originate at the site of the Sheffield 1-17 well in T.6S.-R.99W. Section 17 and follow County Road No. 207 along Carr Creek through all or part of the following sections: T.6S.-R.99W. Section 17 (col l ect gas from Sheffield 1-17) T.6S.-R.99W. Section 20 (jun c tion with east/west segment) The east/west segment of the proposed gas gathering system will originate at the site of the Turner 1-27 well in T.6S.-R.99W. Section 27 and follow County Road No. 204 along Roan Creek through all or part of the following sections: T.6S.-R.99W. Section 27 (collect gas from Turner 1-27) T.6S.-R.99W. Section 28 T.6S.-R.99W. Section 29 T.6S.-R.99W. Section 20 (j u nction with north/south segment) T.6S.-R.99W. Section 30 (collect gas from Tate 1-30) T.6S.-R. lOOW. Section 25 (c ollect gas from Tate 1-25) T.6S.-R. lOOW. Section 26 (collect gas from Tate 1-26) A gas treating station will be located adjacent to the site of the Tate 1-26 well. If required, a field booster compressor will be located at this same site. Assessor's maps indicating the route of the gathering system. 2. Copy of Oil and Gas Lease from Kenneth and Marilyn Tate. This lease has been assigned to AA Production and Resource Natural Gas, Inc. 3. Copy of Surface Agreement between John LaMicq, Jr. and American Resources Management Corp. This agreement has been assigned to AA Production and Resources Natural Gas , Inc. You will note by the route of the pipeline we will be crossing K. Don Hitchborn and Young, Inc. We have visited with Mr. Hitchborn and he has indicated we will have no problem acqu i ring an easement and the preparation of the agreements are in progress. Northwest Pipeline Co. has an existing easement across Young Inc. and they have advised us that we will be able to use the existing easement. We plan on starting construction in mid-December and completing our program in 45-60 days. There should be very little adverse impact on the area in that the construction period will be very short and we anticipate no unusual circumstances. The entire project including restoration and clean up will only last 60-90 days. Of course the above schedule is subject to weather conditions and the possibility exists that construction could be delayed until the Spring of 1989. NOW, THEREFORE , in consider a tion of the premises and of the cov e n a nts h e rein contained, it is mutually agreed as follows: I. PENDING MATTERS 1 . La mi cq installed a gate on the road up the left fork of Carr Cre e k , commonly known as Bear Gulch. American shall p r omptly re i mburse Lamicq $1, 200. 00 for installation of such gate. 2 . Th e road on 4A Ridge was widened and the parties have a g reed upon a sur f ace disturbance payment by American to Lamicq of $6 60 .0 0, whi c h American shall promptly pay to Lamicq. I I. MATTERS SPECIF ICALLY CONCERNING ROAN CREEK PROPERTY UPS T REAM FROM RES URVEY TRACT 45, SECTION 28, T6S, RlOOW, 6TH P.M. TO THE HEAD OF SUCH CANYON 3. Ame ri c an Well No. BG7-3 is to be commenced on or before Au g u s t 15, 1983. Am e ric a n will use its best efforts to keep gat e s closed and locked on th e Roan Creek road leading to such we ll; h owever, i t is recognized that this will not be possible at all times. Amer ic an immediately will install two (2) cattle guards to U.S. F orest Service approved specifications, with a 10-foot wide pipe gate to the side of such ca t tle guard for the mo vemen t o f livest ock (at an expense per gate of not more $150 each t o Am e rican), one (1) such cattle guard to be installed at th e l o c a t ion of the fence crossing the Lamicq property on the ea s t s i d e of Re su rv ey Tract 45 a s s hown on attached Exhibit B as #1 an d one (1 ) at the location of the Lamicq fence in Section 17, as s h own on Exhibit B as #2. There are two (2) additional fence 2 • • lines which cross the Roa n Creek road between the lower and upper c attl e guards to be ins t alled under this paragraph as shown on Exhibit B as #2 and #3 . A cattle guard and pipe gate as des cribed above s ha ll be ins t alled by American on the lower of such two ( 2 ) fence lines ( # 3) if it is still in the process of dri l li ng Wel l No . BG7-3 two (2) weeks after Lamicq gives notice that he is movin g his cattle into a pasture which will be controlled by that cattle guard. I n the event such third c attle gu ar d and gate are not installed by Ame r ican while drilling Well No . BG 7-3, such cattle guard and gate and a cattle guard and gate at the other fence line crossing between the first two (2) mention ed cattle g uards above (#4) shall be installed by American in any of the follo win g events: a. It is convenient and in the best interests of America n to do so; b. Well No . BG7-3 i s not a dry hole or if Well No. BG7 -3 is a dry hole, at suc h time as American dril ls another well upstre am from Well No. BG7 -3. Upon ins tallati on, s uch c attle guards an d gates shall become the prop erty of Lamicq, but the mainten an ce of such cattle guards and gates s0a ll be at th e ex p e n se of American during all such times a s American uses such right-of-way, subject t o contribution for ma intenance by all third party users and limitation of liability as set forth in para graph 7 below pertaining to rights-of-way maintained by Americ an. 4. American sha ll prompt l y provide materials to Lamicq to construct a substa ntial tempor ary fence which will go on Lamicq private property up stre am from Well No. BG7-3, such fence to be i nstalled at the ex pense of La mi cq. If Lamicq desires to remove such fe nce and ins t all it upstr e am from any other well drilled by American on Roan Creek, Lamicq ma y do so at his expense. 5. Commencin g two ( 2) ye ars from date hereof i n 198 5, Lami cq shall be entit l ed t o a $1 ,000.0 0 per yea r road maintenance and upgrading credi t to be used as Lamicq deems advisable 3 • • anywhere on the Roan Creek road upstream from Resurvey Tract 45; provided, however, if American does not have equipment in the area convenient to do such work during the time requested b y Lamicq that such work be done, such credit shall carry forward to the following year at which time there shall be a credit of $2,000.00 of road maintenance and upgrade work. In the second year , if American does not have equipment reasonably convenient to cio th e wor k wi thin the time r equested by Lamicq, American sha ll ob ta in such e quipment, move it into the area and do $2,000 .00 worth of work as requested by Lamicq. The work set f orth in this numbere d paragraph is in addition to the requirement of maintena nce set fo rth in paragraph n u mbered 7 below. , II I. GENERAL APPLICABILITY 6. American, its su ccessors, assigns and contractors shall hav e the right at al l times, solely for the purposes of thei r oil and gas operations within the terms of the various oil and gas leases on minerals under the sur f ace lands of Lamicq, to use all of the presently existing roadways on the property of Lamicq for ingress and egress both to the Lamicq property and to other prop erty adjac e nt or contiguous to property of Larnicq. Oil and ga s operations, for purposes h erein, are defined as, but not necess<lrily limited to, the conduct of geolog ic al, geophysical and other explorato ry work, including core drilling and the drilling and operating for, produc ing and saving all of the oil, gas, casinghead gasoline, an d all other gases and their r espective constituent vapors an d constructing roads, laying pipe lin es, building tanks, storing oil, building power stations and other structures necess ary to the oil and gas operations of American on Lamicq lands or conjointly with other lands. American shall consult with Lamicq as to the precise location of rights-of-way to be enlarged or newly constructed, well sites, cattle guards, gates and other improvements upon the property of 4 • • Lamicq and receive Lamicq's prior written approval thereto, which approval shall not be unreasonably withheld. 7. American shall pay to Lamicq as liquidated damages the amount of $1,500.00 for each dr ill site located upon his private surface estate. American shall use its best efforts to minimize the surface disturba nce of such drill sites, it being agreed that approxima tely two (2) acres is the average size drill site. All ponds, plants, tanks, equipment and other structures of American shall be located on such approxi mately two (2) acre parcel. 8. Ame rican shall pay to Lamicq as liquidated damages the amount of $3.00 per rod for any roadways widened across Lamicq's private surface estate and shall pay the amount of $6.00 per rod as liquidated damages for any roadways newly constructed across Lamicq' s private surf ace estate. No payment shall be made for ~ pipelines placed in existing roadways. Pipelines through undisturbed private surface estate of Lamicq shall be treated as constr uction of new roadways. Any rights-of -way constructed or existing roads improved to permit access will not ex c eed a total surface width of twen ty (20) f e et and in no case shall the total disturbance exceed a maximum of two (2) rods in width, except on turns and curves where the engineering requirements are for more width. Occasional turnouts to al low large vehicles to pass each other shall also be permitted. Any such rights-of-way shall be non-e xclusive, Lamicq reserving the right to use such righ t s-of -wa y and to grant additional, successive use of such rights-of-way not incompatible with the rights of American. Provided, however, that any third party user except the employees of Lamicq and hunting parties gu ided by Lamicq, shall contribute t o the maintenance of such roads in the proportion of such third party's use to the use being made by American and any other contributing third party. During drilling of any well with water using a water truck, the right-of-way being used shall be regularl y sprayed with water to minimize dust. It is recognized that if any well is comp l eted as a producing well or shut-in 5 • wel l, that the considerably more fact a nd, while consideration to right-of-way t o such well will r e ceive traffic . American shall be mindful of such under no obligation to do so, shall give graveling port ions of such right-of-way , install i ng culverts, and making such other improvements as may be necessary for the proper upkeep, maintenance and drainage of said r ight-of-way. Rega rd less of any upgrading by America n , American s hall main tain all rights-of-way used by it in a state of good cond i tion an d r epair at its sole cost and expense. Am e rican's repair and maintena nce of rights-of-way used by it shall be prompt and of a qua lity and quantity to insure safe travel by four-wheel drive v eh icles and upo n its termination of use of any su c h right-of-w ay,· to insur e they be left in as good or bet t er co ndition than pre sently exists. With regard to any r i ghts-o f-way constructed by Amer ica n which it desires to abandon a nd whi c h La micq does n ot desire f or his purpo ses , American will promptly restore any such right-of-way in c o nf ormance with s peci ficatio ns re q uired by the Unite d States Bureau of Land Mana g ement for r estoring disturbed p rope r ty of the United States in th e a rea immedia tel y adj oini ng the area o f such right-o f -way and a s set forth be low. 9 . It is anticipate d that water for drill ing purpo ses will be requi r ed by Am e rican for o ne or more of its wells on or in the ar ea o f the Lamicq property. Lamicq has water approp r ia ti ons from Roan Cr eek and other water sources for use with his pri v at e su r face e state. In the event Lamicq h a s water in excess of the amount need ed f or his livestock operation, Americ an shall have the right to us e of such water for drilling its wells and sprinkling roads. American shall pay to Lamicq the sum of $1, 500. 00 for t h e u se of water for each wel l. With regard to well s dri ll e d in the Roan Cr eek Valley, on or upstream from Res urv e y T rac t 45, Section 28, T6S, RlOOW, 6th P.M ., it s hall be p r e sume d th a t any water used in dril l ing a well of American is water of Lamicq a nd such $1 ,5 00.0 0 shall be paid upon 6 • • commencement of such well using water for drilling , unless American establishes a licensed water well in such area for use in its well drilling. With regard to wells drilled outside of the Roan Creek Valley, either on the private surface estate of Lamicq or in close proximity the r eto, if Lamicq has a water sourc e within reasonable haul distance it shall be presumed that water is taken from such source for any well drilled with water an d $1,500.00 shall be paid to Lamicq upon commencement of any su c h we ll. 10. Lamicq shall furnish American with the combination to the locks on his gates and Lamicq will not change the locks or lo c k an y of the g ates wi t hout providing American, in advance t h ere of, with a c ombination or a key. There shall only be one (1 ) lo c k on e ac h ga te. American's personnel, successors, assigns and c o n t ra cto rs s h a ll be authorized to have and know such c o rnb in a t i o ns or t o possess a key to such locks; however, use th e r eo f s h all be lim ited solely to t he oil and gas operations of Ame ri c a n. With r e gard to the r oad going up Left Fo r k Carr Creek, known a s the Be ar Gulch Road, American's personnel, successors, a s s ig n s and c ontractor s s hall not use such road when the r e is any ot h e r ac ce s s av a ila ble to the d estination of such persons; pr o vid ed , h ow e v er , not h ing her e i n is intended to rest r ict the rig ht o f Am eric a n to p er form its oi l and gas operations a d joining s u ch r oad . 11 . Americ a n sha l l provide Lamicq with copies of all bonds with s ta t e an d fed er al ag e ncies r elating to the drilling of any we lls u p on t h e private surface estate of Lamicq prior to the d ril ling of an y we lls thereon. 1 2. Lami cq opera t es a hunting and guiding serv ice during t h e p er iods of a pproximately May 15 through June 20 and S e pt e mb e r 1 th r ough November 15 of each year. American a nticip a tes that d uring such periods of time the only work it wi ll nee d to d o o n o r through the Lamicq private s urface estate i s o r di na r y maint e nance work and emergency work. Commencing with 7 • • 1984, Americ a n ag rees to schedule all of its discretionary work, such as dril l ing of wells and construction of new rights-of-way, during the p eriod June 20 through September 1, weather permitting. American will not schedule the commencement of dr ill i ng o f a well on such pro perty after August 1 of any year, it being un d erstood that weath er or the requi rements of a unit ag reement may require that su ch well be commenced after s uch date . 13 . Ame rican shall not construct any roads which connect the ridges adjoining Roan Cree k with the road in the bottom of Roan Creek u p str eam from Resurvey Tract 4 5, Section 28, T6S, H l 0 OW , 6th P • M • 14. Americ~n being particularly mindful of the periods May 1 5 through J u ne 20 and September 1 throug h November 15 of each yea r as ref e rr ed to above and the use by its personnel, succe ss ors , assigns and contracto r s of all road s on t he private surface est ate o f Lamicq and leadi ng to or from the p r iv a te s u rface estat e of Lamicq, sha l l be guided by the following restrictions : a. American sha ll not enter upon any surface estate owne d by Lamicq excep t as may be required in t he day-to-day oil and ga s ope r atio ns under the te rm s of its oil and gas leases, options or other contracts; b. Am er ican s hall not allow any unauthorized pe r so n nel to en t e r upon an y sur f ace estate owned or used by Lamicq , in particular bein g mindful that friends, family and acq uaint ances of American 's personnel, and its contractors' personnel, ar e not authorized pe r sonnel. American's pe r sonnel and its contractors' p e r s onnel shall not permit any l i tter to accumulate or r e main on th e roadways on any property owned or used by Lamicq; e. American's personnel and its contractors ' personnel shall not hunt for wild game of any type or chase wild game with dogs on any property owned or used by Lamicq; f . Ame r ican's personnel and its contractors' per son nel sh a ll not fish on any property owned or used by Lami cq; a n d g. American's personnel and its contractors' pe rsonn el s h al l not carry a n y firearms of any kind, except as ma y be r e a s onab l y requir ed to provide security for their equ ipment a n d facilities on the roadways or on any property owned or us ed by Lamicq. 1 5. In the event American, its successors, as si g ns or cont r actors disturbs an area which has been reseeded and such disturbed area then nee d s to be restored, restoration shall b e in c o nformance with the system set forth above. 17 . In c onjunction with its operations, American shall: a. Imm e diately repa ir damage to fences, gates or ca ttle g uar ds caused by its employees or independent c ontract o r s ;,~ b. Compensate Lamicq (or the owner if other than Lamicq) for .tnjury or death to any livestock caused by its emp loyees or i ndependent contractors; and c. Co mp ly fully with the terms of any rehabilitation plans now in e xistence or imposed by any governmental entity which has j uri sdiction over the private sur f ace estate of Lam icq or t h e public domai n up on which Lamicq has a permit t o .ru n liv estock. 18 . Am erica n sh a ll prov i d e its employees and ind e pendent co nt rac tors with a c opy of this Agreement and, in order to insure com p li o nc e wi th i t s t e rms , shal l take the following action: a. Wi t h regard to employees of its contractors, if t hey vi o l a t e the terms o f this Agreement, American will re quest the s ubcontractor t o either discharge the employee or pro h ibi t the employee from working on operations of Ame ric an wh ic h are subject to this Agreement; b. With regard to employees of American, issue a r e primand to the offending employee and if such activity d o e s not i mm e diately cease, discharge such employee or move suc h employee to other work of American on operations of Ame r ica n wh i ch are not sub j ect to this Agreement. 10 • • 19. Lamicq shall not inte rf ere with or obstruct the operations of American in any manner, nor shall he allow any agents, employees of other persons under his supervision and control to interfere with or otherwise obstruct American's operations under this Agreement. 2 0. In the event of default by American as to any of the terms and conditions of th is Agreement, including a timely payment of any sums of money heretofore provided, Lamicq shall notify American of such default and American shal 1 have thirty (30) days after receipt of such notice of default within which to cure such def a ult. In the event s uch default is not of a nature which can be cured within thi r ty (30) days, American shall promptly commence · to cure such de fa ult and shall proceed promptly and diligently to cure such d efault, even though such curative work may extend beyond such 30-day period. In the event that American does not cure a default within the thirty (30) days set forth or , as to a default which cannot be cured within such thirty (3 0 ) days, does not proce ed promptly and diligently, then Lamicq shall have the right to enf orce this Agreement in court. All reasonable expen se s and attorney's fees incurred by Lamicq in enf or ci ng his rights under this Agreement sha ll be paid by American . 21. Lamicq warr~nts that as to the lands which he purports to ow n within the area descr i bed, American need not obtain permiss ion from any other person or entity for use of roadways and acce ss route s there on. 22. The holder shall immediately bring to the attention of the authorized officer any and all antiquities or other objects of historic or scientific interest including, but not limited to, historic or prehistoric ruins or artifacts discovered as a result of operations under this right-of-way grant. The holder shall immediately suspend all activities in the area of the object and shall leave such discoveries intact until told to proceed by the authorized officer. Approval to proceed will be based upon evaluation of the cultural significance of the object. Evaluation shall be by a qualified professional selected by the authorized officer from a Federal agency insofar as practicable. When not practicable, the holder shall bear the cost of the services of a non-Federal professional. The holder shall follow the mitigation requirements set forth by the authorized of fi cer concerning protection, preservation, or disposition of any sites or material discovered. In those situations where the authorized officer determines that data recovery and/or salvage excavations are necessary, the holder shall bear the cost of such data recovery and/or salvage operations. 2. The holder shall comply with the applicable Federal and state laws and regulations concerning the use of pesticides (i.e., insecticides, herbicides, fungicides, rodenticides, and other similar substances) in all activities and/or operations under this right-of-way grant. The holder shall obtain from the authorized officer approval of a written plan prior to the u se of such substances. The plan must provide for the type and quantity of material to be used; the pest, insect, fungus, etc., disposal of containers; and other pertinent information that the authorized officer may require. The plan should be submitted no later than December 1 of any calendar year to cover the proposed activities for the next fiscal year. 3. If need for emergency use of pesticides is identified, the u se must be approved by the authorized officer. The use of substances on or near the r i ght-of-way area shall be in accordance with the approved plan. A pesticide shall be used only in accordance with its registered uses and without other limitations if the Secretary of the Interior has not imposed restrictions. A pesticide shall not be used if the Secretary has prohibited its use. Pesticides shall not be permanently stored on public lands authorized for use under this right-of-way grant. 4. The holder shall comply with applicable State standards for public health and safety, environmental protection and s i ting, construction, operation and maintenance, if these State standards are more stringent than Federal standards for similar projects. 5. In the construction, operation, maintenance, and termination of the facilities authorized by this grant, the holder shall not discriminate against any employee or applicant for employment b e cause of race. creed, color, sex, or national origin. All subcontracts shall i n clude an identical provi s ion. 6. If outstanding valid mining claims exist on the date of this grant, Resource Natural Gas, Inc. shall obtain such permission as may be necessary on the account of any such claims. SPECIAL STIPULATIONS Exhibit C COC-49003 1. The holder shall request a preconstruct i on conference with the authorized officer at least three days prior to the commencement of any surface disturbing activities under this grant. The request shall be directed to the Grand Junction Resource Area. 764 Horizon drive. Grand Junction. Colorado 81506. or phone (303) 243-656 1 . The holder and his representatives and contractors or agen t s involved with construction under this right-of-way shall attend this con f erence to review stipulations and plans of development. 2. If outstanding valid mining claims exis t on the date of this grant. Resource Natural Gas Inc. shall obtain s uch permission as may be necessary on account of any such claims. 3. In order to avoid disturbing wintering big game animals. construction activity and surface disturbance will be allowed only during the period from May 1 to December 1. Any exceptions to this requirement must be authorized in writing by the authorized officer. 4. The pipeline shall be laid above ground from SEXSW~~NWX, Section 20. to NW X SW~~NE~. Section 19. T.6s •• RlOOW., and from SE~NE~XNEX Section 33 to NEXNW ~~NEXNEX. Section 29, T.6S •• RlOlW •• both in the 6th P.M .• (see map exhibit B) and blading or vehicle access shall not be allowed within this area without written permission of the authorized officer. 5. All construction activities shall be confined to the minimum area necessary, not to exceed 35 feet in width. The exterior boundaries of the right-of-way shall be clearly flagged prior to any surface construction. 6. Construction taking place along an exis ting road shall utilize that road as part of the construction width. Where feasible the pipeline shall be located 2 to 3 feet from the outside e d ge of the barrow ditch and the existing road shall be on the working s ide of the trench. 7. Crossings of Roan. East Salt, and Barrel Springs Creeks shall be made with the minimum of disturbance to the ripa r ian area as possible. Wet or dry drainage crossings will be cut to the bottom of the natural stream channel and spoil/fill material shall be stockpiled out of the drainage for use during reclamation. No soil material s hall be used for fill in any drainage and all cut material shall be kept out of the drainage. 8. Brush will be windrowed on the trench s ide along the ri ght-of-way for use as a mulch during reclamation and witho ut mixin g the brush wi th topsoil or fill/ spoil material. Brush removal wil l be "limited" to only those areas where necessary to allow access. C. A vegetative cover at least equal t o that present prior to disturbance and a plant species composition at least a desirable as that present prior to disturbance has been established. Establishment of the required seeded species will be considered as desirable at the original species. Additional work will be required u n til these conditions are satisfied. 22. Thirty days prior to abandonme nt of the right-of-way. the ho l der shall contact the authorized officer to arran g e a joint inspection of the right-of-way. This inspection will be h eld to agree to an acceptable abandonment and rehabilitation plan. Th is plan shall include removal of facilities. recontouring and seeding. The authorized officer must approve the plan in writing prior to the holder's commencement of any abandonment activities. 9. All trees over 4 inches in diameter requiring removal within the right-of-way shall be disposed of by the holder. Where earth blading i s required. stumps shall be removed from or scattered on public land outside the disturbed area. Where earth blading i s not required. stump height shall not exceed 12 inches. Slash under 4 inches in diameter can be scattered by hand or windrowed with the brush for use as a mulch. 10. Brush and tree removal operations will be completed pr i o r to any construction in areas where brush or tre e remov a l i s required. 11. Six to eight inches of surface soil (topsoil) if it exists s h all be stripped and windrowed along the right-of-way on the trench side without mixing with brush or fill/ spoil material. Stripping will occur "only" from the areas to be disturbed by cuts. fills and ditch excavation. No stripping of topsoil will be allowed if topsoil is saturated with moisture to a depth of 3 inches. or frozen deeper than the stripping depth. Topsoil shall not be used as pipeline padding or mixed with spoil. 12. The pipeline shall be buried to provide a minimum cover of 36 inches through normal terrain. The pipeline shall be buried deep enough to avoid problems with irrigation ditches. canals. potential irrigation areas and existing pipelines. as designated by the authorized officer. In rocky areas. a minimum cover of 24 inches will be provided. 13. In areas adjacent to roads the pipeline will be buried a minimum of 48 inches and in rocky areas 36 inches. Crossing acce s s roads. the pipeline shall be buried a minimum of 66 inches or buried 36 inches i n rocky areas. 14 The holder shall accomplish the crossing or paralleling of the pipelines owned by NorthWest Pipeline Company or other companies in accordance with agreement(s) with that company and the holder. 15. All roads used for construction will be maintained i n as g ood or better than existing condition. This may incl ude. but i s not limited to, blading the roadway, cleaning ditches and drainage facilities. and dust abatement. After construction existing roads shal l be re s tored to meet or e x ceed conditions existing prior to construct i on. This may require stabilizing the running surface with shale or gravel in some areas. 16. Functional use of all range and other i mprovements must be maintained at all times. Prior to cutting any fence s along the right-of-way, the fence shall be firmly braced and tied to prevent slacking of the wire. All braces shall be permanent H-frame cons t ruction. The holder shall install and maintain a stock tight gate at fence cut locations. After construction is completed, the holder shall remove a ll facilitie s installed during construction and replace the fence acro s s the right-of-way unless otherwise directed by the authorized officer. 17. The grantee shall construct water bars or kicker dikes. on all of the rights-of-way, as directed by the authorized officer. The water bars or dikes shall be constructed across the full width of the disturbed area. 18. The holder shall promptly remove and dispose of all waste caused by its activities. The term "waste" as used herein means all discarded matter including, but not limited to. human waste, trash, garbage, refuse. petroleum products. ashes and equipment. No burning of trash, trees. brush, or any other material shall be allowed. 19. Pipeline location warning signs shall be installed within five days of construction completion. Each sign shall be permanently marked with the right-of-way serial number. 20. All above-ground structures not subject to safety requirements shall be painted juniper green to blend with the natural landscape. 21. All disturbed areas shall be contoured to blend with the natural topography within 30 days of project completion or cessation of construction activity. 22. All disturbed areas shall be seeded with the following mixture. Applications rates are for pure live seed (PLS). Seed tags must be submitted to the authorized officer within 30 days of seeding. Four temporary use areas outside the 35 foot right -of-way width are needed for construction purposes connected with the ~'le g -off" of the surface pipeline sections.
