January A.D. 19 89 , the , Commissioner Chairman Commissioner Commissioner County Attorney Clerk of the Board County Administrator others were had and done, to-wit: day of , , WHEREAS, the Boaro of County Commissioners of GarfieLd County, Colorado, has received application from Resource Natural Gas, Inc. for a Special Use permit for a natural- gas pipeline and compressor station onthe following described tract of land: Legal Description: See nxhibit A. (in the State of Colorado and the County of carfield); and WHEREAS, the Board held a public hearing on the 19th day of December, 1988, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public andinterested persons were given the opportunity to express thei.r opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basls of substantial competent evidenceproduced at the aforementioned heari ng , has made the followingdetermination of fact: 1.and public notice was provided ashe hearing before the Board of County 2.the Board of County Commissioners wasthat all pertinent facts, matters andthat all interested parties were heard ? 4.For the above stated and other reasons, the proposed use is inthe best interest of the health, safety, morals, convenience,order, prosperit.y ano welf are of the citizens of Garf ield County. NOW, THEREFORE, BE IT RESOLVED by Lhe Board of County Commissionersof Garfield Countyr Coloraco that Ehe Special Use permit be and hereby is authorized permitting the use of the above described tract of l-and for a natural- gas pipeline and compressor staLion upon the following specific conditions: That the applicati-on is in compliance with the Garfield County Zoning Resolution of 1978, as amended. l A11 representat ions of t he applicant application or stated aL the public lieari County Commissioners shall be considered unless stated othervrise by the Board of Cou , either within the ng before the Board of conditi-ons of approval nLy Commi ssioners. 4. 5. 2. The applicant, contract.or, and subcontractors shalf notify the County Clerk's office and Assessor 1 s office to ensure proper licensing and assessment of equipment and vehicl-es based in theoperation, prior to final approval_. The applicant shal-1 comply with al-l regulations of Ga rf ield County relating to industrial operations in the zone districts inwhich the pipeline will be located, and shall construct andoperate the pipeline and compressor in accordance with allapplicable State ulU Federal regulations. Should the compr,essor station be built, the applicanE shallsubmit an approved Air pollution Emission Permit from the Colorado State Department of Healtlt. The applicant shall- submit permits, leases or agreements with theB.L.M., and all private property owners for the pipeline andcompressor/treatment station prior to any Resol-ution ofConditionaf ApprovaJ.. Restoration sha11 be addressed by these agreements or separate restoration agreements shall be submitted. The applicant shall apply for and receive any driveway accesspermits, overweight vehicle permits, and building permits as required by the County Road and Bridge Supervisor and the ChiefBuilding Official. In aodition, the applicant sha1.l- submitverification that the $ZSTOOO road restoration bond, required bythe County Road and sridge Department, is in place. The applicant shall have 180 days from the date of the Resolutionof Conditional approval to meet all conditions set forth in EheResolution. The Special Use permit shall be issued when allconditions are met and shall expire 180 ciays after issuance, unless construction or use has commenced.
