P. Williams LOCATION: A tract of land situated in the SE 1/4 SE 1/4 Section 27 and the SE 1/4 NE 1/4 ana the NE 1/4 NE 1/4 Section 34, T5S, R90 W; approximately 2.5 miles east of New Castle off St. Hwy. 6 SITE DATA: The site is to consist of an approximately 40 acre tract WATER: None Proposed SEWER: None Proposed ACCESS: Existing access drive off St. Hwy. 6 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD and O/S I RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, rural areas with minor environmental constraints, as designated on the Comprehensive Plan Management Districts Map. II DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County, with land uses in the vicinity agriculture/ranching, single-family residential and open space. The nearest residential structures are south of the shooting range along Hwy. 6. The site consists of moderate to steep south facing slopes and draws with native vegetation. B Project Description: The applicant proposes to develop a commercial recreation facility, specifically a sporting clays shooting range, on the site. Approximately 5-10 acres within a 40 acre tract is to be used for the shooting area. Improvements to the site are to include several shooting stations, a parking area, and an office. (See Pages S / Z ) III. MAJOR ISSUES AND CONCERNS 1. Information on the application has been provided to the State Division of Wildlife, and the Bureau of Land Management has been notified of the hearing as an adjacent property owner. No comments have been received at this time. 2. The applicant should submit verification that the State Highway Department has approved a driveway access permit or a change in use for the existing access drive allowing for the proposed commercial use. • • 3. The applicant has not addressed provisions of sanitary facilities and drinking water. Representations as to whether such facilities are to be developed should be made by the applicant. 4. The applicant has represented that all shooting will be orientated toward the hillsides on the north of the site in such a manner as to maximize the safety of the operation. The perimeter of the shooting range should also be fenced and marked with warning signs. 5. The proposed site is presently part of a large ranch owned by the Trust of H. P. Williams. The applicant has been advised that a separate parcel must be created for the proposed commercial use. The creation of a separate 40 acre tract has been proposed. 6. The applicant has expressed an interest in placing signs adjacent to Hwy. 6 for the proposed use. The applicant was advised, pursuant to the County Sign Code, that off -premise signs are not allowed by the County unless a sign code variance is approved by the Board of Adjustment. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION 1. That representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval, unless stated otherwise by the Board. 2. That the applicant submit proof of an approved driveway access permit or change in use for the existing access from the State Highway Department. 3. That the applicant adequately address needs for sanitary facilities and drinking water for the site. 4. That excessive noise, odor, dust, and other similar offensive impacts of the facility, including gun shot, be contained on the lot; and that the perimeter of the shooting area be fenced and posted with warning signs. 5. That the applicant comply with all other zoning requirements of Garfield County, including but not limited to, the creation of a separate 40 acre tract for the proposed use and compliance with sign code requirements. 6. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced.
