At a regular meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Commissioners'
Meeting Room at the Garfield County Courthouse in Glenwood Springs on
the 6th day of November A.D. 19 89 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO.89-150
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION BY ORYX ENERGY, INC.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received application from Oryx Energy, Inc. for a natural
gas handling facility on the following described tract of land:
See attached Exhibit A
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public hearing on the 9th day of October,
1989, upon the question of whether the above-described Special Use permit
should be granted or denied, at which hearing the public and interested
persons were given the opportunity to express their opinions regarding the
issuance of said Special Use permit; and
WHEREAS, the Board on the basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as
required by law for the hearing before the Board of County
Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. That the application is in compliance with the Garfield County
Zoning Resolution of 1978, as amended.
4. For the above stated and other reasons, the proposed use is in
the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Garfield County, Colorado that the Special Use permit be and hereby is
authorized permitting the use of the above described tract of land for a
natural gas handling facility, including treatment, compression,
measurement and transfer into a gas transmission line, upon the following
specific conditions:
1. All proposals of the applicant shall be considered conditions of
approval unless stated otherwise by the Board of County
Commissioners.
2. The applicant shall notify the County Road and Bridge Department
and obtain overweight vehicle permits as required. Said
notification and permitting shall occur for all usage of County
roads including separate permits for hauling to the site and
separate permits for hauling out of the site.

3. That the facility shall be operated in compliance with the
Industrial Performance Standards, Section 5.03.08 of the Garfield
County Zoning Resolution, including, but not limited to
regulation of noise, vibration, emissions of smoke, particulate
matter, heat and fumes.
4. That the applicant submit a plan for restoration and reclamation
of the site including the use of weed free seed and mulch with
continued monitoring of the reclamation by the applicant or
applicant's delegate.
5. That the applicant shall provide evidence acceptable to the Board
of County Commissioners that all utility companies operating in,
or with equipment in the vicinity of, the well sites have been
notified to assure no damage occurs to existing utility
facilities.
6. The applicant shall have 120 days from the date of the Resolution
of Conditional Approval to meet all conditions set forth in the
Resolution. The Conditional Use permit shall be issued when all
conditions are met and shall expire 120 days after issuance,
unless construction or use has commenced.
7. The applicant shall submit an access route to the site which
shall be approved by the Road and Bridge Supervisor and shall
provide on-going maintenance to County roads used for access,
under supervision of the Road and Bridge Supervisor, including
but not limited to, returning the County roads to not less than
their condition prior to the commencement of construction
activities. The County roads shall be returned to said condition
at such time as all overweight vehicles have been removed from
the site. Dust control measures, including continual road
watering or the application of dust retardant chemicals, shall be
utilized on the sites and access roads, subject to approval by
the County Road and Bridge Supervisor.
8. The applicant's existing $100,000 road bond shall insure
compliance with Condition #7 and shall be maintained in place
until such time as all overweight vehicles have been removed from
the site.
9. That the applicant shall consider any mitigation measures which
would assure that the facility is in accordance with industrial
performance standards in Section 5.03.07 of the Garfield County
Zoning Resolution regarding impact to neighbors.

A tract of land situate in the SE/4 NW/4. NW/4 SE/4, SW/4 NE/4 and
NE/4 SW/4 Section 1, T8S, R92W, 6th P.M. lying Northeasterly of a
county road as constructed and in place described as follows:
BEGINNING at the SE/corner of said tract whence the East Quarter Corner
of said Section 1 bears N 87°59'35"E 2.225.43 feet; Thence W 600 feet
to a point on the Northeasterly line of said road; Thence N 18°13'W
10.70 feet along the Northeasterly line of said road; Thence N
20°26'56"W 125.88 feet along the Northeasterly line of said road;
Thence N 38°52'57"W 276.57 feet along the Northeasterly line of said
road; Thence N 76°27'W 41.15 feet along the Northeasterly line of said
road; Thence N 40°22'E 402.88 feet; Thence E 600 feet; Thence S 660•
feet to the SE/Corner of said tract, the point of beginning containing
10.80 acres more or less.
