To whom it may concern:
You are receiving this letter because you are either an adjacent property owner or a mineral interest under
the property owned by Philip A. and Katheryn J. Barrie and described as the Barrie Exemption
(subdivision). This letter is to inform you, pursuant to Section 4-104 of the Garfield County Land Use
Resolution of 2008 that the aforementioned Amended Exemption Plat application submitted to the
Garfield County Planning Department has been approved. As this application was reviewed under the
Administrative Review Process, adjacent property owners within 200' and mineral interests of the subject
property are afforded both the right to comment on the application within 21 calendar days following
mailing of this letter and the right to request an appeal of the decision within 10 calendar days following
the decision of the Director.
As a matter of process, a letter informing you of this application was sent to you on January 14, 2009 via
certified return receipt service. As notice to mineral interests and adjacent property owners within 200' of
the subject property were sent on January 14th, 2009, any comments were to have been returned to the
Garfield County Planning Department by February 4th, 2009. Aggrieved noticed adjacent property
owners, mineral interests and/or the applicant can, under Section 4-104(C), request to appeal the decision
of the Director to the Board of County Commissioners within 10 calendar days following the date of the
written notice of decision by the Director (February 11, 2009). Any requests to appeal the Director's
decision must be in writing. Please find a copy of the official Notice of Decision enclosed.

1. BACKGROUND AND DESCRIPTION OF THE PROPOSAL
This is an amended and corrected plat application for an approximately 165 acre common
ownership parcel which includes eight (8) Antlers Orchard Development (AOD) tracts and
two parcels created through the Garfield County Exemption process in 1990 (Barrie
Exemption). The intent of this application is to correct mistakes in the legal description in
the 1990 Exemption Plat, to add AOD Tract property lines and to adjust a couple AOD tract
property lines. The Exemption Plat as recorded in 1990 has both an error in the legal
description and does not include the AOD tracts which are legally sellable parcels despite
the approval of the Barrie Exemption Plat. As such, the Applicant has presented this
request in three applications, as follows:
1. Correct the aforementioned deficiencies within the recorded Exemption Plat of 1990;
2. Conduct a Boundary Line Adjustment; and,
3. Amend the AOD subdivision tracts 11B and 23B.
Although these three applications are presented here as one, it is procedurally necessary
to approve the correction application prior to the amendment of the AOD tracts or
completion of the Boundary Line Adjustment.
Since this application was deemed technically complete prior to January 1, 2009, the
applications were reviewed for compliance with the Zoning Resolution of 1978, as
amended. As proposed, the Corrected Plat and Plat Amendments are in conformance with
this Resolution.

2. Determination
Corrected Plat (MinorXDS 0109)
The Applicant has provided all required documentation and has satisfied the applicable
standards for this corrected plat. Therefore, The Director has APPROVED this corrected
plat request with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the
meeting before the Board, shall be considered conditions of approval.
2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy),
then signed and dated (mylar copy) by the County Surveyor, then signed and dated
by the Chairman of the Board and recorded in the Clerk and Recorder's Office of
Garfield County. The Corrected Final Plat shall meet the minimum CRS standards
for land survey plats, as required by Colorado state law, and approved by the
County Surveyor. Identify Parcel A including acreage on Corrected Plat.
Amended Plat (MinorXDS 0209)
The Applicant has provided all required documentation and has satisfied the applicable
standards for this plat amendment. Therefore, the Director has APPROVED this amended
plat request with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the
meeting before the Board, shall be considered conditions of approval.
2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy),
then signed and dated (mylar copy) by the County Surveyor, then signed and dated
by the Chairman of the Board and recorded in the Clerk and Recorder's Office of
Garfield County. The Amended Final Plat shall meet the minimum CRS standards
for land survey plats, as required by Colorado state law, and approved by the
County Surveyor. Identify Parcel A including acreage on Amended Plat.
Please note that the Director's Determination shall not be final for 14 calendar days
following the date of dE termination to allow the Applicant, affected property owners
and/or the Board of County Commissioners to pull this application up to be heard within
a public hearing as outlined in Section 1-104 (C) within the Land Use Resolution of
2008. If no aggrieved parties submit a written request within the required
Reconsideration / Call-up period (10 calendar days for Applicant and adjacent property

owners and 14 calendar days for the BOCC), then the Director's Decision shall be final.
Once the full 14 day call-up period has passed, the Final Amended Exemption Plats
may be signed by the BOCC and recorded with the Garfield County Clerk and
Recorder.
