The center line of said right of way and easement shall extend through and across the above
described land and premises as shown on a plat or map of said line to be recorded in the office
of the County Clerk and Recorder.
TO HAVE AND TO HOLD the same unto the said Rocky Mountain Natural Gas Company, Ittc. lts suc-
cessors and assigns, so long as such tacilities or any of them above referred to are owned,
operated or mainiained, with the right of ingress and egress to and from sai.d rlght of way to
maintain, operatei repair, altet, inspect, protect, remove, and replace the same.
The Grantor(s) shall have the use of premises exeept for any use which conflicts wlth the
purposes for which this right of way and easement is granted.
The Grantee hereby agrees to pay for damages to crops or fences resulting from the laying'
erecting, maintaining, operating, or removing of sald pipe lines and related facilities; sald
damages, it not mutually agreed upon shall be ascertained by three dislnterested persons, one
thereof to be appointed by the Grantor(s), one by the Grantee, and the third by the two so ap-
pointed and the written award of any two such Persons shall be final and conclusive.
The Grantor(s) sha1l not build or construct nor permit to be built or constructed any build-
ing or other improvement over or ecross said right of way. Thie easement and rlght of way
shalt be a covenant running with the land and shall be binding upon and inure to the benefit
of the heirs, successors and assigns of the Grantor and the successors and assigns of the
Grantee.
The terms and provisions herein contained constitute the entire agreeme-nt between the par-
ties and shall, supercede all prevlous communications, rePresentations, or egreements, whether
verbal or wri-tteh, between the parties hereto with respect to the subject metter hereof.

In reference to your question about converting the existingcompressor building into a machine and pipe-fitting shopr myresponse is that this is not a possibility. Neither the A/R/RDzone district regulations or the non-conforming use regrrlationswourd alIow this type of activity on this property. This tlpe ofactivity would only be allowed in a commerciit/inaustrial zoningclassification. r have included a copy of both the a/R/RD and non-conforming use regulations for your review.

Use Permit to bring existing facilities and future development into
conformance with current zoning regulations. The application does
not contemplate any major expansion in the near future.
The second application is for the deveJ-opment of a natural gas
pipeline from the compressor station west of CRI{S to the Carbondale
compressor station east of Carbondale off Highway 82.

I have put together some information for a special use perm|t fora new l-0rrsteel transmission pipeline in the Carbondale Lrea. Thisproject involves running a new pipeline on private easements,county Road right-of:hray and state Hwy. right-of-way. The newpipeline will accomplish a couple of difierenCthings. it will getthe current high pressure pipeline out of the suUaivisions inCarbondale. It will aIlow us to move the increased amounts ofnatural gas required to serve the Roaring Fork Valley and the EagleVaI1ey.
I have enclosed copies of the private easements acguired so far andthg highway permits obtained for this project. There are someprivate easeme-nt negotiations still taking p1ace. We are a publicutility and thus posses the regal right- to condemn to g;t thenecessary easements. we need to get with King Lloyd and have himlook at the portions of county roads that wi-ff Ue used for thepipeline installation. We will do this just prior to constructionso we can get the timing right on the permits.
r have enclosed a map showing the proposed route of the newpipeline. The starting point is at tni existing regulator stationon the Beulah Wilson property just west of the CnIAS School. Theline then travels in an easterly direction to the east side of
!{ighway L33. From here it wiLl proceed north to Highway Bz. Theline will follow Highway 82 in ah easterly directioi to near theend of the existing four lane. Then the line wiII go north to thetop of the bank and proceed easterly to the water tairf.on the Ranchat Roaring Fork. Then it will go south to the south side of Hicrhwav82- Then the line will go to Catherine Store and tuin south to-meet\with the existing easement on Blue Creek Ranch. Then the line willgo east to our existing carbondare compressor station, theterminus.
we feel that there will be minimal impacts associated with thispToject. Most of the pipeline wiII be installed within existingHighway and County Road right-of-way. There should be no adverse

Our current revegetation policy is as follows: 1.) On all private
lands crossed that are currently growing a crop (hay, etc. ) , we
prefer to pay the land owner the cost to reseed his fietd. This way
ne gets the seed mix that he prefers and the proper timing f9t
ptanting the seed.2.') On all pri-vate lands crossed that are not in
a cropr we reseed or pay the owner to reseed with a common seed mix
used in that area.
Please see the attached "Exhibit A'' for the lega1 descriptions of
the property we intend to cross.
I have enclosed a check in the amount of $250.00 to cover the
application fee for the Special Use Permit.
