Smit.h Don DeFord , CountY Attorney Mildred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 9T-O41 A RESOLUTION CONCERNED WITH THE APPROVAI OF A SPECIAI USE PERMIT APPLICATION FOR ROCKY MOUNTAIN NATURAL GAS. ,-*_ WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Rocky Mountain Natural Gas for a natural gas pipeline on the following described tract of land: See Attached Exhibit A (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 4th day of September, 1990, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons $/ere given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that alI pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County Zoning Resolution of 1978r ds amended. For the above stated and other reasons, the proposed use is inthe best interest of the heaLth, safety, morals, convenience,order, prosperity and welfare of the citizens of Garfield County. 1. 2. 3. 4. NOW, THEREFORE, BE IT RESOLVED by the Board of county commissioners of Garfield County, Colorado, that thL Special Use Permit be and hereby is authorizea perinitting the use of the above described tract of land for a natural gas pipeline, upon the foLlowing specific conditions: 1. Alt proposals of the applicants shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicants, contractor and subcontractors shall notify the County Clerk's office and Assessor's office to ensure proper Iicensing and assessment of equipment and vehicles based in the operation, prior to final approval. 3. The applicants shall construct and operate the pipeline in accordance with aI1 applicable State and Federal Regulations. 4. The applicants shall provide to the Planning Department approved right-of-way and reclamation agreement from each individual property owner prior to the commencement of any work on that property. 5. The applicants sha1l submit evidence of approval from the Garfield County Road and Bridge Department for the placement of pipelines within County road rights-of-way, to include compliance with road restoration bonding requirements. 5. The applicant shall submit Highway Department for theright-of-way. evidence of approval from the State placement of pipelines within their 7. A11 seed and mulch used in reclamation activities shaIl be certified weed free. 8. The applicant shall have L20 days from the date of the Resolution of Conditional Approval to meet aII conditions set forth in the Resolution. The Special Use Permit shal1 be issued when all conditions are met and shall expire L2O daysafter issuance unless construction has commenced. 9. Any excavated materials not relocated in the pipeline trench sha1l be properly disposed of subject to the approval of the surface owner. Any off-site disposal shall be in an appropriate location.
