A gas line extending from aregrrlator station west of C.R.M.S. to the east side of Highway 133 to Highway 82, then along Highway 82 to the end of the four-Iane then onto private property to C.R. 100 at Catherine's Store. REI.ATIONSHIP TO THE COMPREHENSIVE PI,AN The pipeline alignment is located in District A - Carbondale Urban Area of Influence and District D - Rural Areas with Moderate Environmental Constraints as designated on the Comprehensive Plan Management District's map. II. DESCRIPTION OF THE PROPOSAL Site Description: The pipeline wiII be partially locatedon the unincorporated urban fringe of Carbondale from C.R.M.S. to Highway 82. The intended alignment wiII alsopass through agricultural lands on the north side of Highway 82 and east of C.R. 100. Roughly, 50t of theproject will lie within State and County road rights-of-way. (See map on page ) ) Project Description: The applicants are proposing toconstruct approximately 7 miles of 10" buried naturalgas transmission line. The proposed line wiII parallel an existing pipeline for those portions of the aligrunentfrom C.R.I{.S. to Highway L33 and from Catherine,s Storeto the Carbondale Compressor Station. The applicantshave obtained easements/rights-of-way for some, but notall of the proposed alignment. No structures are beingproposed in conjunction with this request. The easementrequired for construction and maintenance will tlpicatlybe 50 feet in width. A. B. r-l\- -/ III. II{AJOR ISSUES AI{D CONCERNS 1) The applicants have submitted evidence of existing easements and rights-of-way for a portion of the alignment. The applicants are currently negotiating with property owners for the remaining required rights-of-way. The applicants have not formalized a permit with the County Road and Bridge Department. As a public utility, the applicants have the power of eminent domain. 2) Information on the application has been provided to the Town of Carbondale and the State Highway Department, with no response received to date. 3) This project is necessitated by increased natural gas demands in the Roaring Fork and Eagle valleys. Inaddition, it wiII relocate an existing high pressure line out of subdivisions in the Town of Carbondale. 4) The proposed revegetation policy is as follows: On allprivate lands crossed that are currently growing a croP, R.M.N.G. pays the landowner the cost of reseeding thefields and on aII non-agricultural lands, R.M.N.G. wiII reseed or pay the owner to reseed with a conmon seed mix used in that area. IV. SUGGESTED FINDINGS That proper publication and public notice was provided asrequired by law for the hearing before the Board of County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that aII pertinent facts, matters and issues were submitted and that all interestedparties were heard at that hearing. That the application is in compliance with the Garfield County Zoning Resolution of L978r BS amended. For the above stated and other reasons, the proposed useis in the best interest of the health, safety, morals,convenience, order, prosperity and welfare of thecitizens of Garfield County. RECOMMENDATION APPROVAL, subject to the following conditions: A11 proposals of the applicants shall be consideredconditions of approval unless stated othenuise by theBoard of County Commissioners. The applicants, contractor, and subcontractors shallnotify the County Clerk's office and Assessor,s office toensure proper licensing and assessment of equipment andvehicles based in the operation, prior to final approval. 1. 2. 3. 4. v. 1. 2. 3. 4. The applicants shall construct and operatein accordance with all applicable State andRegulations. the pipeline Federal The applicants shall provide to the Planning Department approved right-of-way and reclamation agreement from eachindividual property owner prior to the commencement ofany work on that property. The applicant shall submit evidence of approval from theGarfield County Road and Bridge Department for theplacement of pipelines within County road rights-of-way,to include compliance with road restoration bondingrequirements. 5. -2- o 5. 7. 8. The applicant shall submit evidence of approval from the State Highway Department for the placement of pipelines within their right-of-way. AIl seed and mulch used in reclamation activities shall be certified weed free. The applicant shal} have 120 days from the date of the Resolution of Conditional Approval to meet aII conditions set forth in the Resolution. The Special Use Permit shall be issued when aII conditions are met and shall expire 120 days after issuance unless construction has commenced. Any excavated materials not relocated in the pipeline trench shall be properly disposed of subject to the approval of the surface owner. Any off-site disposal shall be in an appropriate location.
