Access to two of the 5 acre parcels is thru an adjacent piece f land. There is no proof of legal access to the parcels in uestiop. This proof will have to be provided prior to the igning of a Resolution of Approval. Additionally, an internal erpetual access easement will have to be developed as a part of he exemption plat and 1egal descriptions. 1 o q s p t 2. Domestic water is proposed to be provided by wells and springs. The 105 acre parcel will be large enough to obtain a well permit for a parcel of 35 acres or more. Additionally, all irrigation water rights should be transfered to this parcel. One spring is noted as being on one of the five (5) acre parcels, but there is no record of it being legally adjudicated to the land in questions. The parcel with the house has an existing weII. The femaining five acre parcel will have to obtain a well permit, which will require entering into a contract with the West Divide Water Conservancy District to purchase Ruedi Reservoir water. The contract will require an annual payment to the Water District. Notice of the requirement should be made a part of the deed by deed restriction and the exemption plat should have the following plat note: Lot(s)__-is/are subject to a contract with the West Divide Water Conservancy District and all annual payments required by said contract. 3.
