Senate Bill 35 Exemption Request
Gentlemen:
I have reviewed the above request for exemption.
The land for which the exemption is requested is currently zoned
Agricultural / Residential / Rural Density, consequently, the division
of the land into parcels of 2.27 and 10 acres would meet the minimum
lot size requirements.
Further, the division would create only one undeveloped parcel of
land, with the undeveloped parcel being 10 acres in size. In discussing
an exemption request earlier this year in this same area, I recommended
denial because the request to create a parcel of one acre did not
conform to the ordinance and represented a new precedent with respect
to future densities for this area.
The above request does conform to the ordinance, and the undeveloped
parcel being created, at 10 acres in size, does not pose any problems
of density. The parcel does not create any problems of water or
septic system service either.
Consequently, I would recommend approval of the request, with the
understanding that no other Senate Bill 35 exemptions will be considered
for either parcel being created.

RE: Letter of Feasibility for Sewage Disposal

Gentlemen:
Based on the information received by this office and past
experience with sewage disposal facilities in the immediate
area of the proposed exemption, it has been determined by this
office that on -lot sew -wage disposal facilities are both feasible
and practical, commensurate with both county and state regula-
tions, provided that proper permits are obtained prior to con-
struction.
It should be further noted that due to the following con-
ditions
only the following types of on -lot sewage disposal systems would
be acceptable:
x standard septic tank and absorption field
septic tank -dry well
x pre-engineered treatment plant and subsurface dispersal
area
sealed subsurface evapo-transpiration system
vault (with alarm system)
other as specified:
