The land for which the exemption is requested is currently zoned Agricultural / Residential / Rural Density, consequently, the division of the land into parcels of 2.27 and 10 acres would meet the minimum lot size requirements. Further, the division would create only one undeveloped parcel of land, with the undeveloped parcel being 10 acres in size. In discussing an exemption request earlier this year in this same area, I recommended denial because the request to create a parcel of one acre did not conform to the ordinance and represented a new precedent with respect to future densities for this area. The above request does conform to the ordinance, and the undeveloped parcel being created, at 10 acres in size, does not pose any problems of density. The parcel does not create any problems of water or septic system service either. Consequently, I would recommend approval of the request, with the understanding that no other Senate Bill 35 exemptions will be considered for either parcel being created.
