A RESOLUTION NO. 79-53 WHEREAS, Albert L. and Dorette L. Carsten have petitioned the Board of County. Commissioners <of -Garfield .County, ,Colorado, for.. aT exemption from' definition of the terms "subdivision' and "subdivided land"under 1;973. 30-28-101 (10) (a) -(d) , as amended, and the 'Subdivision Regulations" .of Ga.rfie' County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d),°and`3;02:0.1 for the division of a 13.48 acre tract described as follows: that •tract=:of land as described in Document No. 253643 and Document No. 253916 as reo crded • the Office of the Clerk and Recorder or Garfield County,'`Colorado, into two tracts of approximately 5.88 and 7.60 acres each, more or less:, which -proposed divided tracts are more particularly described as follows: Tract A: A parcel of land situated in Lots 13 and 14 of Section 10, Township 7 South, Range 88 West of the Sixth .Principal Meridian, lying Southerly of a county road as constructed and in place and Northerly of the Southerly line of said Lot 14, said parcel of land is described '`:;>: as follows Beginning at a point on the Southerly line of said Lot 14 whence the South Quarter Corner of said Section 10 bears: S.83°10'43" E.;949 16: feet, thence N. 83°10'43" W. 251.80 feet along the Southerly line of said Section 10; thence N. 00°02'32" W. 611.71 feet; thence N. 13°42'20" W. 692.13 feet to a point on the Southerly line of said road; thence N. 86°25'00" E. 152.65 feet along the Southerly line of said road thence S. 13°42'20" E. 695.00 feet; thence S. 00°02'32" E. 666.33 feet to a point on the Southerly line of said Section 10, the point of beginning. The above described parcel of land contains 7.60 acres, more. or The above described parcel of land is subject to a 20 foot road easement running all along the Northerly line. Tract B: A parcel of land situated in Lots 13 and 14 of Section 10, Township 7 South, Range 88 West of the Sixth Principal Meridian, lying Southerly of a county road as constructed and in place and Northerly of the Southerly lines of said Lots 13 and 14, said parcel of .a and is described as follows: 1- BOOK 529 _PAGE Beginning at a point on the Southerly line of said Lot 14 whence the South Quarter Corner of said Section 10 bears: S. 83°10'43" E 1200.96 feet; thence N. 83°10'43" W. 201.44 feet along the Southerly lines of said Lots 13 and 14; thence. N. 00°02'32" W. 563.65 feet; thence N. 13°42'20" W. 693.77 feet to a point on the Southerly line of said road; thence N. 83°35'00" E. 201.63 feet along the Southerly line of said road; thence S. 13°42'20" E. 692.13 feet; thence S. 00°02'32" E. 611.71 feet to a point on the Southerly line of said Section 10, the point of beginning. The above described parcel of land contains 5.88 acres, more or less in the State of Colorado and the County of Garfield; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that these tracts were purchased under separate deeds; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, upon the motion of Larry Velasquez , seconded by R.C. Jolley and carried, the division of the above described tracts "A" and "8" from the above described 13.48 acre tract is hereby. exempted from such definitions and said tract may be divided into tracts. "A" and "B", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express under- standing and agreement of the Petitioners that no further exemptions be allowed on said tracts "A" and "8", and that a copy of this instrument or instruments BOOK 529 PAGEl9 conveyance when recorded, shall be filed, with this Resolution. this . 29th day. o_ May , A.D. 1979.
