PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973, 30-28-101(10)(d) and the Sub-
division Regulations of Garfield County, Colorado, adopted
1 September, 1972, Sections 1.02.17(d) and 3.02.01, the Colorado
Rocky Mountain School, Inc., a Colorado non-profit corporation,
acting by its Board of Trustees, Mark H. Bearwald, Chairman,
and Anne Holden, as Secretary, respectfully petitions the Board
of County Commissioners of Garfield County to exempt by resolution
one certain parcel of land, more fully hereinafter described,
from the definitions of "subdivision" and "subdivided land"
as those terms are used and defined in C.R.S. 1973, 30-28-101(10)(d)
and the Garfield County Subdivision Regulations, for the reasons
set forth below.
1. Colorado Rocky Mountain School, Inc. is the owner
of the following described real property, to -wit:
Lot 11, Section 33, Township 7 South, Range 88 West,
6th P..M. ,
which property is zoned agricultural/residential/rural density.
2. Petitioner desires to exempt therefrom in order to
convey, a tract of land described as follows:
All that part of Lot 11, Section 33, Township 7 South,
Range 88 West of the Sixth Principal Meridian, lying
Westerly of a county road as constructed and in place
and Northerly of the Southerly line of said Lot 11,
Garfield County, Colorado, said parcel of land is des-
cribed as follows:
Beginning at a point whence the East Quarter Corner of
Section 29, Township 7 South, Range 88 West of the Sixth
Principal Meridian bears: N. 22°43'30" W. 6710.20 feet;
thence N. 89°55'00" E. 372.53 feet to a point on the
Westerly line of said county road; thence S. 23°30'00"
E. 190.83 feet along the Westerly line of said County
Road; thence S. 54°39'00" E. 185.16 feet along the
Westerly line of said road; thence N. 89°26'00" W.
113.57 feet to a point on the Southerly line of said
Lot 11; thence S. 89°28'00" W. 480.52 feet along the
Southerly line of said Lot 11; thence N. 01°07'00"
W. 284.97 feet, to the point of beginning.
The above described parcel of land contains 2.93 acres,
more or less.
Attached hereto are copies of a portion of a U.S.G.S. Topo-
graphical map showing the aforementioned property.

3. The tract sought to be conveyed is contiguous to an
existing County Road and hence has access to a public road.
4. There is presently located upon the tract sought to
be exempted a single family residence which gets its water
supply from the Town of Carbondale; is served by electricity
and telephone utilities; utilizes a septic tank and drywell
for sanitation.
5. The tract herein sought to be exempted for purposes
of conveyance is located at the South and West extremity
of petitioner's holdings and its conveyance would not create
any other non-contiguous parcels with petitioner's property.
6. A copy of the deed of conveyance will be filed with
this Petition and the resolution if the exemption is granted.

Re: Colorado Rocky Mountain School
Senate Bill 35 Exemption
Gentlemen:
We have reviewed the proposed exemption and find it in compld4nce
with the Garfidld County Exemption procedures.
The zoning is correct. Water and sewer are installed and are
presently provided by the Carbondale Sewer District and the City
of Carbondale. Access is to a County mead.
Therefore, we would recommend approval.
